Mr. gave us a an all inclusive quote to remodel a home in Saint Charles to remodel a home we purchased for a relocation from Tucson, AZ.
We Quote was provided after we returned to Tucson. Prior to leaving the Saint Louis Area we picked out the Granite. After we returned to Tucson and received the quote, We sent a check to Mr. for $20,000 to pay for the Granite and to cover the removal of popcorn coating on the ceiling. The entire project was to be completed in 3 to 4 weeks. After 9 week and little progress and much work, we had no choice but to let him go. When we returned to Saint Charles, we was presented with a completely different contract which required us to purchase many of the items that was to be paid for in the original quote. At every step of the project we were ask for more money. In Total we paid Mr. $38900 for work that was at best partly completed. We did have a 3 change orders and one request for Mr. not to complete work in the basement. Some of the work that was not done properly was a vanity in the Master Bathroom was furnished with a Kitchen Sink base which is wider then a vanity base by 2 inches. The Granite was already cut for a 22 inch Vanity and the holes for the sink drains will need to be cut in the Granite. The Sink base in the Kitchen was installed in a corner area without the plumbing being roughed in, the tile in the master bathroom was not placed as high as promised in the quote, the water line for the tub in the master bath was not properly installed as well as the drain for the Tub. The tile in the kitchen was not finished. The Ceramic in the guest bathroom had to be replaced because a smaller tub/shower enclosure was installed. Mr. painting had to be redone, Even though the painting was started twice, the color was wrong. Mr. took it upon himself to replace all the cabinets in the kitchen with Cheap unfinished cabinets which were finished like a 12 year old child did it. The list goes on and on.

I am in receipt of Mr.’s explanation of what happened during the course of our business dealings.

There are several Issues that need to be addressed

1: Myself and my Wife issues a certified check in the sum of $20,000 to Mr. in order for him to purchase Granite and other material before we left Arizona in order for to be ready to start on the day of the closing. We also made arrangements with the realtor to pass along a key to him.

2: He removed nice heavy cabinets in the kitchen without our approval. He then told my wife and son that he was doing it as a gift. These cabinets were replaced with construction grade unfinished cabinets. The finish that was applied to these cabinets are subpar at best. They are going to have to be refinished by the present contractor. At no time did we ask or insinuate that we wanted these cabinets removed. When the Sink base cabinet was installed with the Granite in place, Mr. failed to run the water lines, drain line or the drain for the Dishwasher. Because this was cabinet that sit cross ways to the corner of the room a fix was time consuming and costly. The cabinets sit for a few weeks because no one could decide on a fix for the poor finish on the cabinets.

3: As I stated the Granite was cut for all the rooms at the same time. In the master bath a kitchen Sink base was installed. To make it clear the base for a bathroom vanity is around 22 inches, which is what the granite was cut for. A kitchen sink base in 24 inches deep. Therefore, the Granite was too small to cover the base.

4: In the main entrance to the home one piece of 8” x 8” tile was loose. We ask Mr. to reinstall it. Again, he took it upon himself to remove all of the tile at the entrance. Another gift, that was never repaired.

5: During his painting he painted Electrical outlets, return air vents and anything else that got in the way of[GW1] the paint roller. As far as my wife seeing the paint as it was applied, Mr. refused to allow us to come to the house. In fact, I have a text message from him that states that the next time we show up unannounced, he and the crew would leave and not return till the next day.

6: The water lines to the master tub were installed improperly.

7: In the contract it was stated that Tile would be installed 48 inches up the wall around the entire bathroom. If fact it was only installed 32 to 34 inches in part of the bathroom. I ask if he was going to install it in the rest of the area and he told me that the room where the toilet set was not part of the bathroom nor was the entrance to the bathroom and that it would require a change order.

8: The Granite and cabinet base between to be the refrigerator and the stove are to long. The Granite will have to be cut and a new cabinet will have to be purchased.

Out of good faith I gave Mr. a working refrigerator, Dish Washer, Microwave, Stove. In turn he removed the garbage disposal, when I inquired about it he said it was junk. But during the home inspection, it was deemed in good order.

Mr. stated that there was never a completion date set. But 7 weeks is a little excessive in my opinion.

The stress Mr. has caused my family is taking its toll. When we initially entered into the agreement with Mr. we were told that the project would take approximately 3 to 4 weeks to complete. It was after seven weeks that we finally fired Mr.. Subsequently, we had to hire a new contractor to complete Mr. agreed to perform. That contractor has now been working on the house for three weeks, in cause weeks, and my wife and myself are still living in my son’s basement due to the uninhabitable state of our house. Before we moved in with our son, we lived 6 weeks in a hotel.

Also, I am now the target of a lawsuit. I am being sued, In cause number *** by ***, because Mr. hired, but did not pay.

I have paid Mr. everything I agreed to, and more. In turn, I have received nothing but great in conveniences and more expense.

In closing, I to have pictures of the mess he left the house in. He has written down that he would have been finished in three days, when in fact he could not have been finished in three weeks. It is causing me to spend more money then I can afford. But the project must go forward.
