Good afternoon,
Thank you for your message. ...

We
understand the customer’s disappointment that there was zero visibility on the
day they visited.  However, these
tickets were purchased on February [redacted] 2013 and the customer had a
year until February [redacted] 2014 to redeem the tickets.  The
customer did come to the building a week prior to the expiration and was told
that an extension was not possible, but they still chose to visit on the last
day possible.  Additionally, when purchasing the tickets the customer
agreed to the Terms & Conditions, which clearly state:
 “Tickets are non-refundable.
No refunds due to weather conditions, length of lines, or wait times at the
building. Only the ESB Audio Tour is subject to refund in the event of
inclement weather or a special event which necessitates the closing of the
Audio Tour. The Empire State Building reserves the right to close the
Observatory early on very busy days. There may also be long wait lines to get
into the building during busy tourist times. Please feel free to call the
building ahead of time at ###-###-#### (Toll Free [redacted]) to check on
current wait times and hours.”
As it was solely the customer’s decision to wait to a year to redeem
the tickets on the last valid day, we have adhered
to our stated policy, and will be not issuing a refund or replacement tickets.
Please let me know if you need anything further.
Best regards,

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID# [redacted] and have determined that my complaint has NOT been resolved because:
I have asked for an extension a week prior over the phone, to which I was told that the [redacted] would be able to grant it for me if I came in, which I did and the [redacted] refused to make any kind of accommodations.  This resulted in me visiting on Saturday (2/**/2014) to go up to the observatory.
Upon arrival I was told that there would be no visibility since it was snowing.  So I asked to speak with the [redacted] and asked if the tickets could be extended to possibly the next day.  The [redacted], [redacted], was extremely rude and unprofessional.  He refused to hear us out and did not want to help.  He said that we had until 1am that day to use the tickets and must go up or lose them.
On 2/**/2014 there was no visibility which made that day totally unacceptable for viewing.  The management was very rude and refused to offer any kind of concessions at all. 2/**/2014 was not an acceptable day for viewing and the roof deck should not have been opened.
This business is not behaving ethically.
Sincerely,
[redacted]
