[Your Answer Here]
I not only called, I sent two letters (via registered mail, with return receipts that I still have) requesting the proof that my mother had a contract with them. I specifically stated, both on the phone and in both letters I sent (copies of both letter are in my possession as well), that my mother has early onset Alzheimer's, which is why I was requesting the contract. It is funny that the contract never made its way to me but their collection letters managed to find their way.

Response:

[redacted] signed a contract with ETR Inc., d/b/a Empire Tax Reductions to reduce his property taxes for the 2014/2015 tax year. His signed contract for the 2014/2015 property tax reduction is attached. Also attached is the proof from the Nassau County Assessment Review Commission confirming that ETR was the “Representative” responsible for [redacted]’s 2014/2015 property tax reduction. Additionally, [redacted] can confirm that ETR was responsible for his property tax reduction for the 2014/2015 tax year by contacting: The Nassau County Assessment Review Commission: [redacted] / Phone: ###-###-#### / Fax: ###-###-#### / E-mail ARC . Point of Contact: [redacted].

Review: Advertised they would do an appraisal. They never did. Did little or no work on property. Wasted my time and money sending them $30. They never called me or followed up.Desired Settlement: Refund $30 paid.

Response:

[redacted],Please view [redacted] signed contract with Empire Tax Reductions (ETR) to reduce his property taxes. Said contract clearly states that should his case require an appeal, Court imposed filing fee ($30) may apply. His case required an appeal, hence $30 Court imposed filing fee applied. His contract also states, NO REDUCTION-NO FEE. Unfortunately, ETR was not able to reduce [redacted] property taxes. [redacted] house is properly assessed at this time. [redacted] was not charged a fee.A Comparative Market Analysis (CMA) was done on [redacted] property. ETR does CMA's as part of the property reduction process. Again, unfortunately, ETR was not able to reduce [redacted] property taxes. The conclusion is: [redacted] house is properly assessed at this time.Sincerely,Joan K[redacted]Collections Mgr.

Response:

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

They did not address the false advertising issue. They never called me, and their only communication was a bill for $30. They never provided me a Competitive Market Analysis (CMA) and an appraisal as promised. They failed to provide the services promised and advertised with zero communication on their progress.

Sincerely,

Business

Response:

A Comparative Market Analysis (CMA) was done on [redacted] property. ETR does not advertise that CMAs will be provided to clients. Additionally, [redacted] was not charged for the CMA done on his property, therefore ETR is not obligated to provide the CMA to him.? Again, unfortunately, ETR was not able to reduce [redacted] property taxes because his house is properly assessed at this time.

Review: In November 2012, I authorized Empire Tax Reductions (ETR) to fie a tax grievance on my behalf disputing the school and town taxes. The company acknowledged my filing and my email address.

In the three years since my filing I have not had 1 written communication from ETR updating me as to the status of my filing.

Since I heard nothing from ETR, the following tax year I filed, on-line, for the Starr Exemption, and I also filed a grievance disputing the amount I was being taxed, as compared to the properties similar to mine, around the East Meadow area.

The first time any communication comes from ETR, they are demanding payment of $872.23, without any explanation or proof that ETR did anything at all.

They have sent a collection notice from "ETR COLLECTIONS", an "In-house division of ETR, Inc. stating "...to report any delinquent balance to the credit bureaus".

I am 63 years old and not one to sherk my responsibilities. But, I will not pay for something that I don't have proof that ever happened.Desired Settlement: I do not know if my filing or ETR's filing (I have no proof they did) had any effect on my tax bill, if any. If I am paying for a service, I sure would like to know, and have proof, that it did occur.

Response:

[redacted] signed a contract with ETR Inc, d/b/a Empire Tax Reductions on October **, 2012 to process his application for a property tax reduction in 2013 for the 2014/2015 tax year. ETR sent a tax reduction notification on August **, 2014. ETR sent a bill on November *, 2014 for the 2014/2015 School Reduction Fee at a discounted rate of 40%. Said discounted fee was offered for 60 days as per [redacted]'s attached contract. [redacted] did not pay within 60 days. ETR sent an statement in February of 2015 adjusting the School Reduction Fee to the Standard Fee of 50%. At that time, [redacted] was additionally billed for the General Tax Reduction Fee at the 40% discounted rate. Again, [redacted] did not pay within 60 days. ETR sent an statement in May of 2015 adjusting the General Reduction Fee to the Standard Fee of 50%. ETR sent a Statement July and then again in September of 2015. Then, on September **, 2015 [redacted] was sent a Collection Notice from ETR's internal Collection Dept. Attached is a Summary of

Reduction and proof that ETR, Inc was the representative responsible for successfully grieving [redacted]'s property taxes for the 2014/2015 tax year. The Summary and the Proof clearly states the tax savings. Additionally, [redacted] may

confirm that ETR, Inc. was responsible for his tax reduction savings by contacting: The Nassau

County Assessment

Review Commission: [redacted] / Phone: ###-###-#### / Fax:

ARC . Point of Contact: [redacted]s.

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

I have read the response from ETR. I have also logged onto the Nassau County Tax Assessors' website and brought up my tax history concerning General & School taxes from 2013 - 2015, using my property description [redacted].The official records of Nassau County shows that in 2013, 2014 & 2015 there were no changes in the amounts paid for General Taxes (1st half- $1798.83 & 2nd half - $1798.82). I went over my bank staements and checks of those amounts were written out the commissioner of taxes, Donald C[redacted].The official records of Nassau County shows that in 2013 & 2014 my School Taxes were the same, 1st half - $3554.30 & 2nd half $3554.29.The official records of Nassau County shows that 2015 School taxes were 1st half - $3133.19 & 2nd half - $3133.20.The difference from 2013 & 14 to 2015 was a total of - $842.20 If you take 40% of the "savings" the number is $336.88. 50% would be $421.10.I do not know how ETR calculated their amount, but as per the Nassau County Tax site, they were trying to collect 100% + of the difference. The numbers are there for anyone to see. Just do the math. The flyer submitted by ETR states "Upon reduction our Discounted fee is 40% of 2014/15 Tax Savings.

This

serves as an explanation and response to [redacted] complaint regarding his

tax reduction. ETR

reduced his assessment from 963 to 835. The General/School tax rate increases yearly.Had the

Total Assessed Value remained at 963 with the increased 2014/2015 School Tax

Rate, his School Taxes would have been $ 8,717.88. Instead, due to the reduced assessment of 835,

his School Taxes are $7,559.11. Hence; [redacted] received a School Tax Savings of $1,158.76.Had the

Total Assessed Value remained at 963 with the increased 2014/2015 General Tax

Rate, his General Taxes would have been $ 4,149.12. Instead, due to the reduced assessment of 835,

his General Taxes are $3,597.63. Hence; [redacted] received a General Tax Savings of $ 551.49Each tax

year stands alone due to the changes in tax rates. Therefore, you cannot merely subtract one tax

year from the next to get an accurate figure. Please

note, [redacted] has never called ETR, Inc. for an explanation of his tax

savings. [redacted] has been emailed

a detailed explanation of his tax savings. ETR, Inc. has also called and has attempted to

reach out to [redacted] to ensure he understands his tax savings.

[Your Answer Here]

I am in email correspondence with [redacted] of ETR. She has emailed me the company's explanation of my property tax reduction. On reviewing the spreadsheets, I still cannot see an explanation for the difference between their calculations and those on my Nassau County bill I have received from the TOH Receiver of Taxes, Donald X. C[redacted], **. I have requested from Ms. K[redacted] a breakdown of the 1st and 2nd half calculations of the 2014/15 tax year.I will continue to correspond with representatives from ETR via email, so there are no miscommunications, misunderstandings or verbal inaccuracies until this issue comes to an amicable conclusion.

Review: We called Empire tax Reduction to request more paperworks on what they say was tax reduction on the property that we already sold more than a year ago. More than a week after they promised to send us some papers we receive nothing. Here are some numbers they sent us:

General Tax Savings - $286.93

Exemption Credit - -0.00

Actual Savings $286.93

Discounted Fee $114.77

Prior Balance = $783.14

Total Due Now = $897.91 Pay this amount within 60 days

Prior Balance of $783.14 is a big question mark, what is this? We don't know how they are making this numbers all we receive from them are bills that we need to pay. We demand more proof and documentation to justify those fees they are charging us.Desired Settlement: We hope that we receive copies of paperworks or more detailed documentation of tax reductions to justify their exorbitant fees and eliminate the prior balance of $783.14 because we don't know where it came from.

Business

Response:

ETR, Inc. d/b/a Empire Tax Reductions has resolved this matter with [redacted].

Review: We used this company to help us reduce our property taxes. Company advertises that you pay them 40% of tax savings. Company saved us $121.79. They are charging us $191.93Desired Settlement: To pay 40% of $121.79.

Business

Response:

This serves as an explanation

of [redacted] property tax reduction. Please refer to the attached Summary of Reduction; proof of reduction (from the Nassau County Assessment Review Commission) and

2014/2015 School Tax Bill.Starting Assessment was 870.

Reduced Assessment is 824.2014/2015 School Tax: 870 x 1,043.116 (per 100) = $9,075.11 (Starting Assessment x Tax Rate = Taxes)2014/2015 School Tax: 824 x 1,043.116 (per 100) = $8,595.28 (Reduced Assessment x Tax Rate = Taxes)Had the Total Assessed Value

remained at 870 his School Taxes

would have been $9,075.11. Instead

the reduced assessment of 824 reduces School Taxes to $8,595.28. Total School Tax Savings = $479.83; 40% Fee

= $191.93 Joan

Response:

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

My 2014/2015 tax rate was as follows.2014/2015 School Tax: 870 x 1,005.350 (per 100) = $8,746.55 (Starting Assessment x Tax Rate = Taxes)

2015/2016 School Tax: 824 x 1,043.116 (per 100) = $8,595.28 (Reduced Assessment x Tax Rate = Taxes) Total School Tax Savings = $151.27; 40% Fee = $60.51Their advertising states: [redacted]. See attached flyer. So in the end they are charging me more than what I actually save! Makes no sense. It's false advertising! Who would sign up for this if they knew they pay more than they actually save?

Response:

This

serves as a further explanation and response to [redacted] complaint regarding his tax

reduction. ETR

reduced his assessment from 1062 to 870. The General/School tax rate increases yearly.Had the

Total Assessed Value remained at 1062 with the increased 2014/2015 School Tax Rate, his

School Taxes would have been $10,676.82. Instead, due to the reduced assessment of 870, his School Taxes are $8,746.55. Hence; [redacted] received a School Tax Savings of $1,930.27.Had the

Total Assessed Value remained at 1062 with the increased 2014/2015 General Tax Rate,

his General Taxes would have been $4,327.51. Instead, due to the reduced assessment of 870, his General Taxes are $3,545.14. Hence; [redacted] received a General Tax Savings of $782.38. Each tax

year stands alone due to the changes in tax rates. Therefore, you cannot merely subtract one tax

year from the next to get an accurate figure.

Response:

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

To whom it may concern,If you read their advertised fee, you would come up with a simple calculation of subtracting your new taxes from last year's taxes paid and 40% of that number would be the fee. There is nothing in their ad that supports their manner of billing. Again if I knew I would be paying more than they were saving me, I would never have hired them.
