This letter is in regards to complaint ID #[redacted]. Sorry for the delay in our response to this matter,July 01, 2016Around 10 o clock in the morning an older gentleman, and his son, [redacted], came into our establishment, Emporium Medical Equipment inc., and immediately started yelling...

"Where's my Chair" and was kicking our merchandise as he walked around the store still shouting "Where's my chair" "You guys stolemy chair"We asked Mr. [redacted] "what chair are you talking about?" He then located what he thought was his chair. Mr. [redacted] did not come with any paperwork to prove that this was his chair. He did find an old Invoice located in the manual of the chair that had an old invoice for batteries that he or whomever had purchased. Now Mr. [redacted] had brought us this chair approximately 2 years ago when his sister had passed away asking us to sell it on consignment for him. I believe he had made a verbal agreement with one of our employees that is now longer with the company, [redacted]. Since then we have undergone a change in ownership. We asked Mr. [redacted] "How do We know that this is your chair. Why would we just give you a chair not even knowing if it was his chair or not?" Then he said "I'm calling the police" and we told him "go ahead". We were going to call them because he was causing a scene in our store and scaring our customers. Numerous times we told him "how do we know that this is your chair? I asked him several times "if you just show me you're identification Card and if the address on the Invoice matches the sci. Then I will let you take the Power Chair," then asked him if you had a business, which Mr. [redacted] does, and someone came in there ranting and raving that someone stole your chair and you have no paperwork to show its yours but its sitting right here in the store. Are you really going to let someone just walk off with your product?" "I don't think so." said, After told him that he calmed down a little bit. And again I told him if you just show me your id then I will be more than happy to let you take your chair. Mr. [redacted] then produced his D card the addresses matched and then let him leave the store with the chair. And as he was leaving he said he was going to leave usabad review and he was going to reportus for Elder Abuse. kind of chuckled at the thought of him reporting us for elder abuse seeing that no elder abuse occurred. He should actually beling paying us for storing his power chair because for the last 2 years ht has been in my store taking up space.The bottom line is this, he brought that chair to our store, sympathized with a young man in our store, reporting that his sister died, and they would like to sell the power chair on consignment. We usually do not do that, people donate them, and we take it to VA, or when people need them and cannot afford to buy them we donate them. [redacted], let them leave their power chair here, without inspecting it,so we were not aware what it had on it, or if its working or not, The chair was in one corner since then, nobody was interested on it, but both Mr. [redacted] were upset that the chair was here for 2 years and we were notable to sell it, At this time he was claiming that his father need it, and he has to take it, and we told them just show which chair is yours, and you can take it just take it, it is taking space here. He left the store about one hour leaving his elderly father here, he said he went to call a police, we told him just go ahead and call a police, sorry we were notable to sell your chair, the young man should have never let you leave your chair in our establishment. He took his chair as it has been in that corner claiming that there is brand new batterles on it, than we received letter from him saying that the batteries are missing, told him but you took that chair because you said there has been new battery invoice there, which you just purchased it when you brought it to our store.Following to this ireceived phone call from elderly abuse, Social Worker) told them, he brought his father with him that day, he was yelling at us here at the store, some of our customers were very nervous, the elderly man his father also was shaken up. We could not understand, how did we do anything wrong with his father, he sat on the reclining chair, he kept saying to his son calm down, he hardly said anything, offered him a water, when his son left, told him he does not have to come here and scream at everybody, specially the new owner, he kept asking to him which one is your chair show meshow me, because he bought the store as is. The Social Worker, saldi do not understand what this has to do with elderly abuse, when he is the one who took his father and came to your store, and was very upset because his chair was not sold. She told me" will close this case, thank you for the information and your time".Weapologize, for this explanation, I understand that it is kind of off, but we and I am doing my best to explain, what he did to us, he, I mean the son, he is complaining on behalf of his father, he ls using his father's name, who was in military and does not deserve to be treated like that. We are not even clear what we did wrong, were notable to sell his chair, he came and picked it up, for anything, the way We see the owe us 2 years of storage fee. We went to our Storage and asked them for estimate, they said $89.00 per month. (This was the lowest), so his fee would have been 89x24= $2,136.00Wethank you very much for your patience, please inform to us if we have to do anything for this matter, he left a chair in our store and we gave it back to him, whichever he claimed to be his chair.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below. 
The "Revdex.com" is one of our States greatest  institution, but.......Does anybody really read these things ??Their offer, I guess is that we owe them $2,136.00 for storage fees? Their response and account of events (please read) defies any reasonable logic or believable explanation.We agreed to the following:That Medical Emporium accepted said Power Wheel Chair for a consignment sale on or about February 20th, 2015.That said chair has a retail value of $1600.95That [redacted]. [redacted] the Chair Owner, asked for his property back on July 1, 2016. Now needing it for his own personal use.That said chair, was not operating when owner retained possession of his property from Medical Emporium. That a receipt for new batteries was in the said chair pocket, made out to Mr. [redacted] the chair owner.That Mr. [redacted] has requested three times (twice written) for restitution in form of returning it to the condition in which it was in, when Medical Emporium accepted it orIf unwilling to do so, please reimburse Mr. [redacted] the retail value ($1600.95) so he may try to purchase another one.That Medical Emporium said " that they would do the right thing "  when responding to the verbal request.That Medical Emporium has never responded to our written request.What is in dispute ?Any offer of restitution.Any explanation for missing batteries, hand controls and control modular.For the record: January 2015 We purchased a back brace from Medical Emporium.  We noticed that they had many used Power Chairs for sale.  None as new or nice as the one we had sitting in the garage.  We inquired if they ever sold Power Chairs on consignment and they replied "yes we do, all the time." We purchased the back brace and left.February 2015We called Medical Emporium and inquired if they still needed a good chair for consignment, they said yes.We loaded the chair into the truck and drove it down to Medical Emporium, when we arrived their staff helped us unload the chair.We rode the said chair into the Medical Emporium, it was in excellent condition. Still had the original plastic on the head rest and "nubs" on the tires.We showed them the receipt for the new batteries as well.We asked for paperwork when dropping off said chair, and we were told they just write it down in our book, which we witnessed at that time.We were told by Medical Emporium that they would call Mr. [redacted] before accepting any offers on his chair.July 1, 2016Mr. [redacted] had never received any contact from Medical Emporium and assumed they had not sold his chair.  Now needing a chair himself, decided to retrieve his property.Upon arriving, we inform the lady (same lady as when we dropped it off) that we were there to pick up our chair.  She inquired of which chair was ours.  I pointed to our chair.  She said that could not be our chair-that chair is brand new chair, we purchased it from another business which had closed and we have a receipt for it (never produced).  We again told them we knew our chair.  We asked them to look in their book, where they had put the information when we dropped it off.  They stated that that book had been "lost" . We told them some circumstances of when we brought the chair in and how it actually  belonged to Mr. [redacted]'s daughter.  The lady then stated ,that she now remembered that " Mr. [redacted]'s daughter had actually came in and pick up the chair just a couple months after the chair had arrived and that we should contact her. Mr. [redacted]'s disabled and only Daughter passed away on February 16, 2013.  After this third "story" from the lady about the where a bouts of Mr. [redacted]'s chair, the conversation got heated and louder.  The lady again stated we had no proof that the chair was Mr. [redacted]'s.  We informed her that Mr. [redacted]'s chair had new batteries when we dropped it off and their should be a receipt in the pocket of the chair verifying this.  They then requested Mr. [redacted] to produce his drivers license thus verifying the name address on the receipt (from Sam's Club) for the batteries that was in the pocket of the chair. They then told Mr. [redacted] to take his chair and get out of their store.  Mr. [redacted] stayed with his chair at the store, while his son [redacted] left to go and get a truck, so the chair could be remove from their store.  When his son returned Mr. [redacted]'s chair had to be push out of Medical Emporium since it had been parted-out and the batteries stolen.  Mr. [redacted]'s nephew [redacted], met his son to help load the chair into the truck. The lady began harassing us verbally and making disparaging remarks concerning Mr. [redacted]'s deceased daughter and the attempted consignment sale, which continued out and in front of the store.  When we arrived home  is we discovered all the missing parts and that the batteries had also been stolen.July 9, 2016We had a cooling off period. We returned to the store and we talk with the other lady, who was also there when we picked up the chair.  We confronted in a calm demeanor as to the condition of the chair and missing parts and batteries.  She said that she knew and assured us that they would "do the right thing".  I thank her and told her I was leaving her with a letter stating our requested for restitution.  A couple weeks later we followed up with another letter since they had never answered us.In answer to their letter I will say : There were no other customers in the store when we trying to get our chair back.We did not touch any chair or any other property, besides our own chair while at their store.We did not raise our voice until the third story was told, concerning the where a bouts of Mr. [redacted]'s chair.
