EMSI Med-Ex Paramedical

Please be advised that Examination Management Services, Inc(“EMSI”) was forwarded the above referenced complaint made by Ms*** ***, which was e-mailed to EMSI’s subcontractor, Arizona MedEx Paramedical, Inc(“MedEx”), in Gilmer, AZFor convenience, a copy of the complaint is attached
hereto as Exhibit APlease be further advised that Ms*** also contacted my office on Thursday, 4/13/2017, to voice similar concerns relative to the specimen collection conducted by MedEx for her pre-employment drug test for EMSI’s customer.I have reviewed the matter, I can confidently say that EMSI and MedEx have acted in accordance with all applicable laws in this matter, and that in no instance did EMSI or MedEx observe or record Ms*** during her specimen collectionMoreover, after speaking with Ms*** personally, I believe Ms*** is satisfied with the review conducted and assurances given, and that this matter is otherwise resolved.Specifically, MedEx is subcontracted by EMSI to perform specimen collection services for preemployment and Department of Transpiration (“DOT”) drug tests for EMSI’s customersUnder DOT requirements, certain specimen collections are required by federal law to be observed or monitored by a collector who is present in the room with specimen donorIn this case, Ms*** confirmed to me that no one was in the room with her, and MedEx confirmed that there are no recording devices used in the bathroom or the collection processIt appears from my discussions with Ms.*** that she had assumed that she had been observed during her collection based on certain signage posted in the office area that warns donors not to cheat during drug tests.I contacted Ms*** on Friday, 4/and Monday, 4/17, to advise her that my review of her complaint was underwayUpon completion of my review, I called Ms*** on Tuesday,4/18/at 3:CDT, and reviewed my findings with herSpecifically, we discussed the following: - I advised Ms*** that her particular collection was not a DOT collection, and as such was not an observed or recorded collection in any manner.? I explained that DOT collections are federally regulated and may be required to be monitored or observed in certain situations.? I advised that in the event of any DOT collection performed by MedEx, a collector would be physically present in the restroom with the donor per Dot regulations, and that no recording devices would be used in the process- I asked Ms*** if anyone was in the restroom with her and she confirmed that there were not any other individuals present in with her- I advised Ms***, that since she did not have a DOT collection, and no collector was in the restroom, that she did not have an observed or monitored collection.- I advised Ms*** that the poster she may have seen in the office area was a DOT poster,and that EMSI and MedEx display such posters for compliance purposes.- Ms*** indicated it was not a poster that concerned her but a picture with a bottle taped below it and the picture stated, “We are watching you”.- I confirmed with MedEx that the picture referenced by Ms*** actually states “Don’t cheat, we will catch you,” and the bottle is an example of how some donors have attemptedto use hand warmers and synthetic urine to attempt to pass their drug screenI advised Ms.*** of these facts- I then asked Ms*** if she would like the phone number of EMSI’s customer who ordered the drug screen for Ms***’s employmentMs*** declined.- Ms*** thanked me for my daily outreach to her.- I advised that I was glad I could ease her mind.Because Ms*** was not recorded, observed or monitored, and in light of steps EMSI and MedEx have taken to assure Ms*** that her collection was not recorded, observed or monitored as she alleged, we respectfully request that you dismiss Ms***’s complaint with respect to EMSI and MedExShould you have any additional questions, please contact me directly at *** between the hours of 8:and 4:Central time
