The customer agreed to a purchase price in writing and left a non-refundable deposit Delivery was scheduled for a few days later in order for the extra accessories that we included in the deal at no charge to the customer could be ordered and installed days after the deal was made,
the customer logged on to out website and falsified his identity to attempt to renegotiate the deal The pricing had changed online in error After discussing this with the customer, he then went back to the website under a different name again and tried to renegotiate the deal yet again The vehicle was sold to the customer at the friends and family price set by General Motors and given all rebates he qualified for As a kind gesture on our part, we also included over $of accessories at no cost to him.Afrer several attempts to explain our position on this matter, we have been unable to resolve the situation with the customer Serpentini will not be giving the customer any additional credits towards his purchase We strive to achieve a high level of customer satisfaction and in this instance understand that we are unable to achieve this No additional efforts will be made on our behalf The final price the customer paid was less than the online price so no bait and switch tactic was used ThanksNate G***Director of Finance

We will be sending a separate check for the sales tax. Buying a car works differently than most purchases at a retail store due to the title attached to the vehicle. Sales tax is paid to the state when the vehicle is titled. The amount collected and paid is based on the original
purchase which in your situation included a service contract. Once the vehicle is titled, we are not able to get any portion of the sales tax back from the state. This is why you were told what you were told. Again, we will be issuing you the refund via check. Please let me know if you do not receive within 7-business days. Thanks, Nate G***Director of Finance

[redacted] originally completed a credit application with a third party lead provider.  We attempted to reach out to him several times to discuss his application.  He then went to our website to complete a full credit application.  Once that application is completed, the customer...

received a conditional pre-approval based on the information he inputted.  [redacted] met the minimum income criteria required for our pre-approval program.  The conditional pre-approval is subject to bank requirements and down payments will vary.  [redacted] then set an appointment to come in to the dealership to see what we could do for him.  Once here, he informed us that he only had $100 to put down on a vehicle.  Due to his current credit situation, it was going to be very hard to get him approved with only $100 cash down.  We submitted him to multiple lenders in an attempt at getting an approval.  Due to his recent repossession and all derogatory credit since 2012, the only approval we were able to obtain was requiring him to put down a minimum of $1500 cash down.  Submitting a customers application to multiple lenders is standard operation procedure, especially when the credit file was a challenged as his.  We are not the bank and can not make the lending decision.  With the update in credit reporting and new government regulations, a consumer can not be penalized for shopping banks for the best program.  The credit inquiries to [redacted] credit file did not cause him to pay any higher rates or pricing for his vehicle.  The fact that he had over $9000 in open collection accounts along with the recent repossession is why he had to pay a higher interest rate.  We strive to achieve 100% customer satisfaction but also are aware that it is not possible to make everyone happy.  The credit inquiries that were made to [redacted] credit file can not be removed because he was trying to purchase a vehicle and the application he submitted gave us permission to attempt to obtain financing on his behalf.  I do apologize for him feeling the way he does about the situation but again, we did not create the situation.  We only tried to help him get a vehicle and exhausted every effort possible to help him.  I'm glad to hear that he was able to get a vehicle and has good reliable transportation.   Thanks, Nate G[redacted]Serpentini Auto Group

The customer completed a credit application online and gave us an address in Michigan.  As the customer stated in her complaint, she drove in from out of state.  She provided proof of residency with an electric bill with a Michigan address.  All of the paperwork was completed using...

the address provided by the customer.  Now the customer is stating that she wants an Ohio address used.  We explained that since she provided a Michigan address to us as her primary residence, we can not use an Ohio address.  That would be fraud with the banks.  If the customer would have used an Ohio address upfront, we could have used that address but she did not.  The vehicle has been titled according to the address she provided.  I tried to resolve the issue with the customer but was unsuccessful due to the rudeness of the customer.  There is nothing we can do after the fact and I explained this to the customer.  The deal has been finalized with the bank as well as title work and all sales taxes paid.  There will be no further action taken from our end on this matter.   Thanks, Nate G[redacted]Director of Finance

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below. This excessive running of credit report 17 times put 17 inquiries on my account. I was under initial impression that if all for the same reason, that only 1 inquiry would be put on my credit report. Due to this amount of inquiries, my business made with [redacted] required a $1500 downpayment as opposed to the $200 that they initially said I would be needing to put down to be approved. I knew of my circumstances prior to contacting Serpentini and informed them of everything up front.they did not inform me that they would be running my credit report 17 times.  1 or 2 I could understand. These inquiries stay on credit report for what I believe is 2 years unless I am mistaken and now for next 2 years I am in a situation that my credit report shows something that should never have happened to be honest. I understand they only want to get a sale regardless what they have to do but again, 17 times is a bit excessive and something I’ve never heard of before

[To assist us in bringing this matter to a close, we would like to know your view on the matter.]I would like the BB to assist with the deceptive practices at Serpentini Strongsville according to the Consumer Sales Practices Act (CSPA).  Review of the said consumer issue that I am sure many others that have purchase from Serpentini of Strongsville have had issues with.  1. I though I was getting friends and Family discount and then when I returned two days later it was supplier.  I had asked why the online Sales price was $1,175 cheaper the then so called supplier price on the day I arrived to sign paper work and finance. 2. My wife used her real name when she was speaking to the online person that day who said only "rebates everyone gets are included" which meant the National $750 rebate.  After adding that into the sale price the car was still $1,175 cheaper then what the Supplier price was.  I said I wanted the cheaper sales price and not supplier since it was a better deal.  Was told it was a mistake on the online sale, that they had included $1,500 in rebate from the name plate and that had to be added back and therefore I had the better deal.  Since it was a mistake and the sales person was a friend of the family I did not want to get anyone in trouble and took there word it was a mistake.  Which I thought meant they would fix the advertised sales price.  The day after the sale I did go online, still saw the sales price was not changed and thought since it was a mistake I would ask the online person.  It was the same person so I used a fake name to ask about the sale price and received the same response as the day before.  Nothing was change and I determined that I had been a victim of bait and switch with rebates.  3. I paid $1,000 to cover the fabric and exterior protections, and parts to be installed.  Received a receipt for the $1,000 but did not receive a cash selling price with all the incentives and rebates.  Only a receipt for $1,000 bucks.  Nor did I receive a timeframe to exercise any options.  4. Two days after the sale after the Finance Manager Nate called me and told me I was a terrible person, I was crazy and did not know how things worked and that I was bothering his employees I decided to look at another dealer to see how they operated.   I went to Serpentini in Orville Ohio whom had a similar vehicle with the same Online sales prices that Strongsville store had.  I spoke with the online chat person who had the same replay as the others from Strongsville.  "we only post rebates that anyone can get"  When I arrive the sales person ran through the deal with the me and gave me the sales price as advertised, add the tax and then discounted me the $2,500 for the Nameplate/Conquest rebate.  I said I would return with my wife the next day and he spoke with his Sales mgr. who said the price was going to be $1,00 more because they include $1,000 of the nameplate rebate in the online sales price since 98% of people as least have a car.  This is not what was represented by the Chat person whom said, "we only post rebates that anyone can get"  Bait and switch.  Sales price is not something anyone can get because they add money back just like Strongsville store which added $1,500.  Seems that add back whatever they want.  I was not happy, told sales person my wife and I would have to consider and left.  10 minutes later the sales person called back and said the $1,000 rebate thing was not fair and he understand that rebates that everyone gets is not the same as taking $1,000 off a sales price because 98% of people have a car.  He saw it as an unfair tactic and said his GM would honor the sales price that was online and I would still qualify for the $2,500 Nameplate rebate.  Fair and right thing to do.  I would like the BB to assist with the deceptive practices at Serpentini Strongsville according to the Consumer Sales Practices Act (CSPA). The cornerstone of Ohio consumer law is the Consumer Sales Practices Act (CSPA), which protects individual consumers from unfair, deceptive, and unconscionable sales practices in connection with consumer transactions. The CSPA and its substantive rules can be found in the Ohio Revised Code (R.C.) starting at 1345.01 and in the Ohio Administrative Code (O.A.C.) starting at 109:4-3-01. Both codes are available at http://codes.ohio.gov. What is a consumer transaction? A consumer transaction is the purchase, solicitation for purchase, or award by chance, of a product or service that is intended for home, family, or personal use. Examples of consumer transactions include:    A motor vehicle dealer selling a used or new vehicle to a consumer. The CSPA requires sellers (or “suppliers”) to:  Not use bait-and-switch tactics to trick consumers into paying higher prices.
