Complaint: [redacted] I am rejecting this response because:Monica is not telling the Truth here If she was, she would state that I left her a voice message that Friday about how upset I was about the roof that was going on my house It was the wrong color and there was debris all over the place Including on my Air Conditioner unit outside When she didn't call me back, I went straight to her office I spoke with her telling her that I was upset with the roof and told her to tell Carrillo Roofing to stop until we came to a conclusion to this NEVER did I say that [redacted] called me I didn't have his phone number [redacted] called me (Monica gave him my number) because Monica wasn't returning his call to get a deposit So I made the deposit to get this leaking roof fixed! When I spoke to Monica a couple of days later, I told her that I was going with her guy because she trusted him and did good work When I asked about the difference of the 30/year warranty pricing, she said they were the same price I said I wanted the year warranty then Monica called me another time asking about the color Since I was NEVER shown any options, I told her, and I Quote " The SAME COLOR that is on the roof now"She asked me to email her confirming that we were going with [redacted] and I did Back to the Friday in her office I told her I wasn't happy with the color I told her I didn't really want to have [redacted] to rip off the roofing that he had already had installed If he could offer a cash discount that was acceptable, then we could go on with the roof If not? Then I wanted the color I told Monica [redacted] called hours after this and NEVER said he would remove the roofing material He said he would fix the fence he gave me a $dollar bid for I told him that wasn't acceptable as my neighbor was going to have to pay half and this would only be a $discount [redacted] went on to say that his distributor didn't have the same color and that Monica's office told him to come close These were NOT MY WORDS! I told him to contact Monica, as I told her that either a major discount was offered or remove the roofing material and put on the color of my choice I told him to contact Monica as she was the Property Manager that he got the instructions from and she knew what I wanted[redacted] told me that Monica told him to continue I NEVER said this and was more upset than ever! Monica R***-ESR [redacted] ***October 27, [redacted] ID# [redacted] Dispute Resolution Specialist Revdex.com Jefferson StNE SteA Albuquerque, NM Dear [redacted] ID# [redacted] : Mr [redacted] had contacted me to manage his home on [redacted] **in July of (See attached #1) When we first tried to show the home his previous property manager was there, also showing the home to someoneWhen we tried to enter the home the gentleman that was there showing locked us out and we were not able to show the home to our prospective tenantWhen I informed Mr [redacted] of this, he apologized and said they found a tenant and that he was going to stay with the current management companyOn July 28, Mr [redacted] called me that he was not happy with his current management company and would like us to manage his propertyWhen I agreed he informed me that he was in town and wanted to sign the management agreement that dayWe drafted the management agreement and he was at my office within an hour and half, signed the management agreement, wrote a check for the stafee and owner escrowThis all happened so fastThis home had on going issues with the roof leaking and had several repairs/patchesMr [redacted] asked if I knew any roofersI told him we have used Carrillo's Roofing often and have never had any problemsWe also had Enchantment Roofing go out to give an estimateThey went out to the home for an estimate but didn't get a quote back to usMr [redacted] emailed me a quote from another roofing company dated 03/02/(attached#2) This quote was for $10,to remove and replace with a yrlaminated shingleI am also including an email to Mr [redacted] letting him know that we would ask Carrillo's Roofing if they could lower their quoteCarrillo's Roofing did not lower their quote but agreed to include a new roof on the casita to matchThis is a separate building(Attached #3, 4, 5) Mr [redacted] contracted Carrillo's Roofing directlyHe spoke to them about replacing the existing roof, set a start & end date and paid $7,downAfter this Mr [redacted] called me to let me know the roof was scheduled to startI asked him which company he chose and he replied the one I referred to himOn September 16, I was renewing the rental agreement with the tenants when a few questions regarding smoking at the home came up and I needed his written approval before we could move forward with the renewalI called Mr_ [redacted] to discuss, it was during this conversation that I asked him about the colorHis reply was to "match the existing color as close as possible." This was conveyed to the roofer from my office*(see attached #6) Mr [redacted] had received the quote spoke to the roofer and approved the work in writingStating that he wanted "tan color composition roofing material but did not mention anything about the 30/manufactures warrantyWhich is on the quoteMr [redacted] and the tenants were upset that some of the old broken shingles were on the ground around the home while the old roof was being removedThe contactor explained to me when asked about it that it had been windy and the first layer of shingles was dry, brittle and breaking into piecesThe contractor cleaned everything up once the work was completeMr [redacted] came to my office to let me know that he was not happy with the colorHe said that Carrillo's Roofing had offered to remove the new shingles and replace them with another color of his choiceMr [redacted] said he felt bad and didn't want to make them remove the roof and that he would figure something outHe made no mention of a discount at this timeSavannah Swas also present during this conversationMr [redacted] was kind and calm while in my officeThe roofer told me he was so grateful to Mr [redacted] for deciding to allow them to continue work with the existing new shingles that he offered to repair the fence he had previously quoted for free(Fence quote attached #7) The roofer said, Mr [redacted] declined, saying he (the roofer) didn't understand that this would not benefit Mr [redacted] because the neighbor should pay for half of the fence repairMr [redacted] told me the sameMr [redacted] kindly said to me, I don't think he understands, that doesn't really benefit me because the neighbor should pay for half of the fence to be repairedI just listenedMr [redacted] was in direct contact with the roofing company throughout the jobHe never told me to have them stop workHe did tell me that he told them to stop workingWhen I responded, "You told them to stop work?" He replied that he had the tenants go out and tell the roofers to stop workingI'm not sure why Mr [redacted] , who hired the roofing company, coordinated a start date and submitted a $7,deposit to the roofer, would tell them to stop work until they spoke to the management companyAs he was in town, at the home and saw the roof prior to completionMr [redacted] initially asked for a $discount then said he was taking that off of the table and ask that I request a $discount from the contractorPhone calls were made and stories were changingSo, I emailed Mr [redacted] and let him know that I would be corresponding via email, he agreed(Attached #two pages) In concluding Mr [redacted] called the contractor, hired him, scheduled a start and stop date and paid a $deposit directly to Carrillo's Roofing without my involvementHe was in town and saw the roof in person at about 25% completion and took photos but did not stop the workIn this complaint to the Revdex.com he states "I told her that I didn't necessarily want the roof completly removed and a discount should be made." Then later in this complaint he states, "I expect either removal of said roof or for him to discount the balance." ($6109.44) With regard to these statements the only consistent verbiage is that he wants a discount1st request $1500.00, 2nd $3000.00, 3rd $& now $13,199.44) I was not a party in initiating hire, scheduling or making payments to the contractorI was advised by counsel that this was a transaction between the home owner and the contractor and should be settled between them(Attached page 5-of our signed management agreement Hold Harmless Clause) Sincerely, Monica R***-ESR Enclosure

She asked me to email her confirming that we were going with [redacted] and I did.  Back to the Friday in her office.  I told her I wasn't happy with the color.  I told her I didn't really want to have [redacted] to rip off the roofing that he had already had installed.  If he could offer a cash discount that was acceptable, then we could go on with the roof.  If not?  Then I wanted the color I told Monica. [redacted] called 2 hours after this and NEVER said he would remove the roofing material.  He said he would fix the fence he gave me a $600 dollar bid for.  I told him that wasn't acceptable as my neighbor was going to have to pay half and this would only be a $300 discount.  [redacted] went on to say that his distributor didn't have the same color and that Monica's office told him to come close.  These were NOT MY WORDS!  I told him to contact Monica, as I told her that either a major discount was offered or remove the roofing material and put on the color of my choice.  I told him to contact Monica as she was the Property Manager that he got the instructions from and she knew what I wanted.[redacted] told me that Monica told him to continue.  I NEVER said this and was more upset than ever!  After all of this, Monica started back tracking and saying that her attorney told her to back out of this.

When I informed Mr. [redacted] of this, he apologized and said they found a tenant and that he was going to stay with the current management company. On July 28, 2017 Mr. [redacted] called me that he was not happy with his current management company and would like us to manage his property. When I agreed he informed me that he was in town and wanted to sign the management agreement that day. We drafted the management agreement and he was at my office within an hour and half, signed the management agreement, wrote a check for the start-up fee and owner escrow. This all happened so fast.
