I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my dispute.
Please enter your reason(s) for rejecting the business response below.I completely disagree with Endless Discoveries response to
my complaints mentioned with one exception: signing a form agreeing to give a
30 day notice prior to my son’s withdrawal from their care.  Due to the instances addressed in my original
complaint message, there was absolutely no way that I was going to allow them
to care for my son any longer.  I
honestly do not know of a parent that would leave their child in the care of an
individual, daycare facility, or other knowing that there is potential harm being
done.  Endless Discoveries failed to
provide the care promised to my son and failed to provide notice upon injuries
(2) occurring in their care, which are both adequate reasons for not providing a 30
day removal notice. They were contracted
to provide notice upon injuries in written form, as well as provide the
supervision needed to ensure his safety and well-being while in their care.  It is evident that they failed to do any of
the above. In response to Endless Discoveries’ statement regarding my
complaints:Concerns were addressed directly to my son’s
morning teacher regarding supervision and his well-being on (4) occasions.  In addition, I spoke with the afternoon
manager at the front desk on several occasions regarding his supervision.  Additionally, I called the evening of my son
injuring his forehead while in their care to figure out what happened.  He was extremely fussy, to the point of not
being able to console, and it frightened me. 
While on the phone explaining my concerns, I was transferred (3) times
between teachers and management.  The
final conversation with his morning teacher addressed that they were sorry
about what happened, that he fell and hit his head on the plastic kitchen set
in the room, and that they assured me that an incident report would accompany
any future injuries.  Additionally, the
conversation included that the teachers were being talked to regarding how
important it is to notify parents of any injury.  Endless Discoveries never mentioned the
incident again.  Therefore, their
response regarding an “investigation” is invalid.  They “investigated” the incident while on the
telephone with me, which included discussing with the teachers what had happened
and relaying that information to me while on the telephone, which is stated
above.   No future investigation was
performed on their behalf, nor was anything else communicated after the fact.  There was no mention of reviewing camera
footage.  The teachers over his care
explained what happened while on the phone.The second incident that occurred with my son regarding
a bruised area under his eye was addressed with his morning teacher, once
again.  She spoke with the other teacher
in my presence and neither of them knew what had happened.  They assumed that it was a similar incident,
but they could not give me a definite response. 
This truly concerned me, once again, because my son is in your care and
you cannot tell me what happened to his eye? 
Nothing else was mentioned of this incident by Endless Discoveries
staff.Concerns were addressed regarding cleanliness in
the presence of my son’s afternoon teachers. 
I made comments regarding how filthy he is, how snotty his face is, etc.
nearly every afternoon.  In addition, my
husband tried communicating with the afternoon teachers, but their personal
ability was nearly non-existent.  They
did not acknowledge that he was there to pick him up from their care with the
exception of handing him his sippy cup. 
Nearly every afternoon, no words were exchanged.  It is difficult to communicate with others
when they don’t speak back or respond to your concerns. With
regards to soap in the sippy cup, it may be state regulation and Endless
Discoveries policy to not wash any type of cups or bottles, but soap suds were
not in his sippy cup with water when dropping him off and an extreme amount were
when we got home from daycare.  Something
happened with the rinsing process of his sippy cup transitioning from water to
milk, from milk to water, the beverages served, as stated on his daily toddler
sheet, throughout the day while in their care.No additional concerns or complaints were
mentioned at the time of giving a week notice from pulling my son, because I
did not want him to be treated any worse during that last week.  This is justifiably spoken by the incidents
that had occurred as previously stated. 
It is evident that Endless Discoveries failed to provide the
care that was contracted.  It is also
evident that Endless Discoveries failed on (2) occasions to provide in written
form an account of any incident that occurred to my son while in their care.
For the reasons stated above, I request that Endless
Discoveries waive the $690.00 balance on my account to a remaining balance of
$0.00.  If Endless Discoveries does not
waive this balance, I may choose to involve the state of Texas Department of
Family and Protective Services or seek any other legal action necessary to
resolve this matter.
