Ms*** did indeed contract this Company to perform an addition to her home on 5/19/with her deposit made a week later commencing said contract Within our contract there is no completion date for we could not guarantee the completion date of projects ahead of hers Ms
*** requested a particular crew leader to perform her work and she as informed that as soon as he completed the Project he was currently on he would be assigned to hers That Project experienced some delays in completion and she was informed of such as it is not in our habit to abandon a customer if a Project does not go as expected Once we realized that these delays could be an issue, we started the excavation and prep work while the requested Crew Leader finished his current projectThe requested Crew Leader reported to Ms***s project and informed her that he would be there until the completion, and she expressed satisfaction with that The Project was turned over and work continued.Last week Ms*** contacted our office stated she did not like that the Crew was not on site every day and demanded a solution Our immediate solution was to set aside her requested Project Leader and assign the Owner of the business to take over She was assured that double crews would be on site 8/1/with a completion date of 8/19/ In addition, concessions were being made to her in compensation for the unavoidable delay After Ms*** accepted this solution and the Company completely rearranged its schedule and made allowances for mobilizing a large Crew on her Project Once this was done and arrangements changed and made, Ms***, at the last minute, informed us that after speaking with another Contractor she wished to terminate her contract so she could hire them We understand the emotion that goes into a large home project, and we also understand that delays can happen even with the best laid plans We kept Ms*** informed or our schedule while stating that we would not abandon the customer before her as we would not abandon her When she expressed dissatisfaction with the Project Leader she requested, we conceded to her every demand and up heaved our schedule to accommodate her We believe this complaint has more to do with another Contractors attempt to undermine this Contract, of which we find this type of behavior distasteful and unprofessional At the time of this response we stand ready to complete the Contract or allow Ms*** to Breach our Contract in which an accounting will be done along with any and all relief granted under NYS Contract Law We sincerely hope that it does not come to that but with another Contractor guiding Ms*** we must protect our own interest
