This letter is in response to the complaint you received from one of our customers, *** *** *** *** ** *** *** *** **. To start the customer was quoted $2,for the removal of the house trap beneath the basement floor & installation of a new 6" clean out,
which included NO exterior work at all. Then the customer was quoted $3,for the removal of the house trap with a new 6" clean out if the house trap extended underneath the footing and we needed to excavate right next to the front foundation wall to expose the house trap. Then due to the sewer backing up in the basement, we called in ABC Sewer to snake out, camera and locate the break/damaged sewer lateral. It was determined from the sewer camera and locator that the break/damaged sewer lateral was located in the front yard at the top of the hill. After that determination, the customer was quoted a price of $6,to that point of the break/damaged sewer lateral and at that point the customer was hesitant and stated, "That's ridiculous I'm going to call some other contractors," & he was advised to obtain other bids from additional contractors Note the price quoted to the homeowner was given to him on Dec04, and the contract is dated Dec10, 2014, when the homeowner called and asked when we would be able to do the sewer lateral. And that price quoted, and on the contract that the customer signed, included removal and replacement of the sewer lateral from just inside the front foundation wall where the house trap was, to the point marked/spray painted by ABC Sewer, which included excavation, replacement of new sewer pipe with a new 6" clean out, gravel fill, permit, and filling the hole with on-site excavated soil. In past experience we have learned that a sewer camera and locator do NOT always get it exact, which was in this case, and which is also stated in the owner's contract. After we excavated and exposed the sewer lateral to the point marked by the locator from ABC Sewer, it was determined that the sewer lateral was damaged further out towards the street, since water still would not flow through the sewer. Once we determined this, we notified the homeowner via text along with pictures, and explained to him that we needed to excavate out further towards the street to determine how far out the sewer lateral was damaged and that we could NOT give him a price on the additional work until it was determined how far out the sewer lateral was damaged. We excavated out to the city sidewalk and exposed the sewer lateral to that point. Once it was determined where the existing sewer lateral was good to connect to, we put together a price for the additional work and phoned the homeowner. The homeowner was not happy about the additional charges but gave us the go ahead to fix it and get his sewer hooked up and working properly. Which all of the work that was completed was done properly, inspected and closed by the City of Milwaukee Plumbing Inspection. End result the homeowner has a properly working sewer lateral, which is what he contracted with us to do. We fulfilled our part of the contract and now the homeowner needs to fulfill his part of the contract and pay for the repairs to his home, including the additional work already completed correctly. As stated in the letter sent to the homeowner, via certified mail, along with a copy of the contract he signed, notice of lien rights, the final invoice, and a copy of the bill from ABC Sewer, which the homeowner received and signed for Jan08, 2015, that if he would like for us to sit down and go over the additional charges we would gladly meet with him and do that. Instead of contacting us to discuss the issue, the customer sent us several texts that did not indicate he was willing to sit down and discuss this issue at all. The customer instead bashed our company and said see you in court. With this attitude the situation will never be resolved since the customer is unwilling to discuss the situation at hand, which is the additional charges for work already completed to his home. Attached please find the original contract, final invoice (which has NOT been paid), letter sent to customer, invoice for ABC Sewer (which customer has NOT paid yet), and a copy of the certified return receipt. Review: I had [redacted] owner of Energy Saving Plus fix a sewer lateral. I should have trusted my instincts and found another plumber. The original price that I was told was $2,000.00. The first time I met [redacted] was on 12-10-14. I came home and he was outside measuring the front yard. There was a blue dot that was painted on the hill about 4 feet from the edge of the sidewalk. The distance from inside my basement to the blue dot was 31 feet. When I asked [redacted] for a rough price he came up with $10,000.00. Now imagine coming home to a contractor that raises a quote by 500%. I could not believe it. I called the General on the job. As I am telling the General I can't believe the price went up from $2000.00 to $10,000.00. [redacted] taps me on the shoulder and said he made a mistake. [redacted] said the price was now $6000.00.

Here is when I should have walked away.

After [redacted] stormed out because I had the audacity to question a jump in the price from $2000.00 to $6000.00. I called the general contractor and he was shocked by how much [redacted] raised the price. He felt horrible about the situation and gave me a discount of $2,700.00 on the basement floors. With the Generals discount, I agreed to have [redacted] and Energy Savings Plus Home Improvents Inc. replace my sewer lateral. When [redacted] came by to have me sign the contract I still felt uneasy with him. I felt couldn't trust a thing he was saying. Feeling very skeptical and uneasy I asked [redacted] how confident he was that he would be able to fix the sewer lateral for $6000.00. I told him I had no more money and couldn't afford any extra cost. [redacted] said he was 99.99% sure that he could fix the sewer lateral. When I asked him why he was so sure? [redacted] said, "Because ABC scoped it and we saw where the break was. Wanting to get it fixed I signed the contract and gave [redacted] owner of Energy Saving Plus Home Improvements Inc. a check for 50% or $3,000.00. The only other price that we discussed was excavating all the way into the middle of the street. I asked [redacted] what would that cost if we had to go the middle of the street. [redacted] gave me a price of $20,000.00 to $25,000.00. Which is just crazy. It would cost about $15,000.00. That is another insane add on of $5,000.00 to $10,000.00. He shows no awareness of the customers wellbeing when he puts these insane numbers out there.

On December 12, 2014 [redacted] started the job at approximately 9:00am. Around 5:00pm [redacted] called me and said they couldn't get it snaked and they would have to come back Monday. [redacted] then handed his phone over to his wife. I asked her if it would cost anymore than the $6000.00. She said she could not say. After she could not give me a price. I told her I would be home Monday and we would talk then. They stopped working and went home till Monday.

When I arrived at home Monday. It was more doom and gloom from [redacted]. He told me how ABCs machine broke and it was the worst sewer lateral he had ever seen in his life. I told [redacted] we needed to get ABC back and try and snake the lateral again since I was out of money. I told him I had nothing more than the $6,000.00 we agreed to. [redacted] said ABC would be back with a bigger machine soon. After starting to engage in small talk with [redacted] he had found out what my job was and asked if I could get him some tickets for a game. My response was,"Are you going to get this lateral snaked out?" Without hesitation [redacted] replied, "Oh, I'll get it."

Now mind you up until this point he is swearing up and down that is worst case scenario. Remember [redacted] told my worst case scenario is $20,000.00 to $25,000.00. He had me so worried Fri., through this point Monday morning that I may owe $20,000.00 to $25,000.00. Suddenly when he thinks he can get tickets for a game. He is positive ABC will be able to snake the lateral. I told [redacted] that would be great if ABC could get it cleaned out. I said, "If they get it snaked, just get fixed and I'll cut you a check for the last $3,000.00. Everyone will be happy." [redacted] said, " Yep!" I told [redacted] to call me when ABC was done.

I walked upstairs and tried to take a nap. There was so much noise from the snake that I couldn't really sleep. After about an hour the noise from the snake stopped. I looked out the window and saw ABC pulling the snake out of the hole. I walked downstairs wanting to know my fate. Did they snake the lateral out or was I going to have to tell [redacted] to leave and have another plumber give me advice. I was not going to continue if he tried to add some crazy price on again. I walked right up to the guy from ABC and said, "Did you get it?" He said, "Of course. My other machine just broke Friday." Gesturing towards [redacted] that I shouldn't listen to what [redacted] says.

I was very excited as you could expect. I told [redacted] to come inside when he was done and I would write him a check for the other $3,000.00. I went upstairs and slept for a bit. After about 4 hours I heard someone come into the house and say. "You can use your bathroom again. " I got up to go downstairs and the door was shut and Energy Savings Plus Home Improvements Inc. and [redacted] was loaded up driving away.

I tried to call [redacted] 3 days later with no response. A week after the job was finished [redacted] called and asked if he could stop by and pick up the check. I told [redacted], "Sure stop by I'll write you a check for the $3,000.00 I still owe. [redacted] replied," Its going to be a lot more that that. We had to go past the blue dot. That was an extra $3,000.00. But I tell you what. I"ll cut it in half we"ll call it $1,500.00. $328.00 for ABC having to come back. Plus the $3,000.00. You owe me $4,800.00." I said,"No way! You never told me anything about the $1,500.00." He said, "If you don't pay, I'l put a lien on your house."

Never once was I told about the $1,500.00. The first time I heard about it was a week after the job was done. When I question the $1,500,00 that was never disclosed by [redacted]. [redacted] owner of Energy Saving Plus Home Improvements Inc. immediately threatened to put a lien on my house.

I told him if he wanted to do that I would be more than willing to discuss this matter with an arbitrator or judge. I am no longer willing to discuss anything with [redacted] on a one on one basis. He has proven to be completely untrustworthy and unreasonable.

[redacted] wrote a new contract that I never signed or read and put a lien on my house. Now I am exploring any and all options on how to get the lien removed on my house. Also what legal action I can take against [redacted] and Energy Saving Plus Home Improvements for filling a invalid lien plus damages.Desired Settlement: Take the lien off of my house. Drop $1,500.00 charge. Apologize.
