January To Whom it May Concern, I am writing on behalf of my day notice to vacate the residency of *** at English VillageI have made multiple efforts and attempts to contact management: via phone calls, emails, *** call center, Solomon org contact us, and contact us on the
*** webpageThere are several breaches in my lease which have encouraged me to come to my decision to leave and terminate my lease with *** at English VIllage. The property manager has neglected to contact me upon requests with (Lease agent: Name removed), emailing (Property Manager, and communications with the Central Leasing Call Center. The negligence and denial of my requested lease break is unacceptable and I am requesting to follow said guidelines required to end terms of my lease within the next days. Please see the below points and bullets. Upon the initial presentation, you will then read the discussion and explanation of each point and key element. These terms can be found under the Apartment Lease Agreement terms: Warranty of Habitability: a."...the apartment and property are fit for human habitation and there are no conditions which are detrimental to the life, health, or safety...." As you will read below, my terms of the lease were breached with *** at English village due to my life (personal and professional at risk and potential for subjegation), health (incured respiratory infections and cough fits, potential for impairment due to marijuana smoke permeating the buildings, musking the walls, and potential to impede my cognition. In addition to second hand cigarrette smoke not withstanding the guidance of smoke free-residenciy, nor the feet from building limitation), and my personal safety (putting myself at risk for intruders due to tenants not fully closing the door and opening the door for strangers, in addition to my professional career put to risk). Objectionable Conduct: "...not limited to conduct that causes or threatens to hazardous, unsanitary, or detrimental to other tentants in the Property or conduct taht is in violation of any fire, safety, health, criminal applicable laws. ...possessional of a controlled substance as defined by applicable law. ...no smoking is permitted in the common areas of the property." My rights under this term have been breached due to the following: Marijuana impacts my personal health and tenants on the first and second floor, in addition to the background benches have smoked "joints" and the essence has permeated the halls and my walls. The residents do not comply with the no smoking inside buildings, nor do they abide the 5' restriction. Residents open their windows and blow smoke out the windows, while in their apartments. I have stepped out of my building multiple times and residents have stood on the front doorway/stoop and smoke fills the area. This is hazardous and puts me at risk for respiratory/lung issues, in addition to a family history of lung cancer and COPD. This is inexcuseable and harming my health due the negligence of tenants and *** employees. Regarding unsanitary (hazardous) premise, a resident on the third floor owns a feline. The pungent odor of ammonia-cat urine and fecal matter not only ruminate through the corridior, but meekly stay stringent when the door is open. The Department of Health and Sanitation would frown upon this and states there is risk for airborne toxins, in addition to toxoplaxmosis. The dumpsters are constantly overflowing to the point that racoons, possoms, and skunks are present on the mountainous piles of waste outside the dumpers. OSHA guidelines would restrict presence of rabenous animals to be allowed around public areas, as well as intervention of the Department of Santitation and Infectious Disease. Inability to Provide Services, Right to Perform Repairs: I have submitted several maintenance requests in the past. Upon moving into Addison, the first time opening the door, my hinges broke and the door was hanging soley from 1/of a latch. I contacted the leasing agents and they regarded this as no major concern. This took me several hours and four attempts for maintenance to finally come to the door - in addition to maintenance requesting my father to help them with the repair. This is unsound, unsafe, and inappropriate. In addition to this, there have been numerous maintenance comsteications regarding: sliding track of closet, poor performance on washer and dryer, AC Unit not working, heat panel not presenting adequate heat (even when thermostat was maxed to degrees), and other issues. Some issues were never addressed and some required a week's duration prior to any intervetion. This is negligent, inexcuseable, and unprofessional. In addition, maintenance never once called me, rather they wrote me notes and placed them outside of my front apartment door - which included remarks and comments. An "!!" is not necessary when annotating the rationale for an appliance malfunction. Fire or Casuality: a"Tenant must give landlord prompt written notice of any fire......defective condition in or affecting the apartment or the Property." Take into regard, upon entrance of the apartment, my smoke detectors were placed with faulty batteries I understand the role of management to not tend to or care to replace batteries; however, allowing a new tenant to move in and have faulty equipment impedes safety and rules and regulations under which a Fire Marshall would deem safe. An apartment on the same floor as me has had their smoke detector beeping for over a week I am seeking to break my lease and vacate the premises as of Days noticeManagement has presented negligence to respond to me, as well as the *** staffI have reach out for a week and had negligence of acknowledgement of my concernsMaintenance has failed to reach out to my concerns for approximately one weekI finally stopped in the office on 1/5/I spoke with (Lease agent: name removed), one of the staff members who has presented negligent, unprofessional role demonstrationAlthough my initial submission to remove myself and terminate my lease at *** at English Village, I am now resubmitting my terms based on the contractual terms of the lease. I am giving my days notice to vacate and terminate lease terms, as of 1/06/2018. Management has been negligent and not followed through terms of the lease. Breach one consists to the management and landlords failure to comply with Habitation and habitabilityI have reached out and was informed, not even two hours status post submission, my wish to terminate lease was denied and management did not even speak to me to address my concerns. See above: My personal health has been put at risk under the following circumstances: Tenants smoking marijuana on the first floor of the buildingFirst of all, smoking (of any sorts) is PROHIBITED in buildingsSecond, marijuana is not legalI cannot have my health, cognitive ability, and risk for impairment at riskMy health of myself is number one concern, followed by family and friend health. Per the World Health Organization, "Examples of key housing-related health risks include: respiratory and cardiovascular diseases from indoor air pollution; illness and deaths from temperature extremes; communicable diseases spread because of poor living conditions, and risks of home injuriesWHO estimates that nearly million people in developing countries die from indoor air pollution caused by the burning of biomass and coal in leaky and inefficient household stoves. Inadequate ventilation is also associated with a higher risk of airborne infectious disease transmission, including tuberculosis, as well as the accumulation of indoor pollutants and dampness, which are factors in the development of allergies and asthmaPoor housing quality and design also can exacerbate the health impacts from exposure to temperature extremes, which are occurring more frequently due to climate change." (WHO 2018)This breach impedes my life in the role of my profession of employmentAs a nurse, I get randomly drug testedIf a hair follicle, or any other laboratory test is performed, my career will cease to existMy life cannot have such a strain of concern and I must remove myself from this circumstance*** also stated, tenants have the right to address concern with landlords regarding health and smoke: "If you can't reach a solution with your landlord and the secondhand smoke is disrupting your life or affecting your health, then you might consider moving outDepending on the situation, you may have the right to break your lease because of the health effects of the secondhand smokingDepending on the severity of the problem, you may even want to consider bringing a lawsuit against the rental property ownerYou might be able to claim that the secondhand smoke constitutes a nuisance or disrupts your right to quiet enjoyment of the rental unitKeep in mind that these cases will likely be difficult to win without laws supporting your sideIf you want to sue for money damages only (such as for dry cleaning or medical bills related to the secondhand smoke), you could consider bringing a lawsuit in small claims courtIn Pennsylvania, you can sue for up to $12,in small claims court." This personally affects my life in matters of health and family, in addition to potential visitors to my residence. The Center of Disease Control would also site: "Secondhand Marijuana Smoke Secondhand marijuana smoke contains tetrahydrocannabinol (THC), the chemical responsible for most of marijuana’s psychological effects, and many of the same toxic compounds in smoked tobaccoTherefore, breathing it could affect the health and behavior of nonsmokers, including babies and children who are exposed.[28, 34, 35] Mental Health There is still a lot to learn about whether marijuana use may lead to mental health problems or if having a mental illness makes people more likely to use marijuanaAnd as with other drugs, factors like the age of users, how early they start, the amount of the drug they used, and their genetics all could make a difference in whether or not long-term problems develop.[42] But current research shows: Marijuana users are significantly more likely than nonusers to develop chronic mental disorders, including schizophreniaSchizophrenia is a type of mental illness where people might see or hear things that aren’t really there (hallucinations)Some marijuana users have an increased risk for psychosis (loss of reality), a serious mental disorder where people have thoughts (delusions)Marijuana use has also been linked with depression and anxiety, and with suicidal thoughts among teensHowever, it is not known whether this is a causal relationship or simply an associationMarijuana use can trigger psychosis in people with schizophrenia.[39-41]." (CDC January 2017)My safety is at riskI do no smoke or do drugsMy lung capacity and respiratory system is put to risk with inhalation of cigarette smoke and marijuana permeating the hallsThe essence seeps into the walls of my apartmentI cannot risk this for my health, life, or safetyTenants do not abide the 5’ smoking from building ruleI have walked out my front and back building door and tenants have been on the stoop smokingI have seen windows open and smoke blown out windows, as wellThis not only puts me at risk for respiratory issues, but my mother suffers from chronic obstructive pulmonary disease: she has been sent into coughing fits and near attacks from the ill-enforced rules at AddisonDoors are constantly left open and unhinged when I have entered the buildingTenants lack responsibility and left doors openAs witness to this, I had a guest enter the building via a second or first floor tenantWhat if this were an intruder? What if someone were to break into my apartment? What if I didn’t want said individual in my apartment without my permission? This puts my safety, life, and general well being at riskThe maintenance and leasing office have presented neglect behavior and snide remarks concerning my requestsUnder the lease, maintenance and said staff mustn’t disregard requestsI approached (Lease agent: name removed) about this concern, and she has provided me the same excuse, “(Different Lease agent: name removed) responded to my emails” -this is incorrect and wrongThis excuse has been used multiple times under similar circumstances where neglect was notedUpon speaking, and her one and only email response after nearly ten attempts to communicate, my major concern was not addressed and excuses were presented: marijuanaThis is unacceptable behavior and irrevocable lies. In addition to safety, I was given an apartment where smoke detector batteries were dead upon immediate move inI understand the irresponsible aspect of said notation, however providing faulty equipment upon move in impedes fire rules and regulations, in addition to my safety. My next regard is toward the toxic effects of cat urine and pungent odors permeating the halls of the third floorA tenant on the third floor opened her door, and the stringent odor of ammonia from cat urine musked the hallThe same door has been closed and the odor persistedI cannot have such essence putting my heath due to poor sanitation and risk of becoming pregnant put at harm due to some other tenants poor animal hygiene, or even personal hygiene which impacts my healthThe department of health and infectious disease would certainly site the facility. Aligning with sanitation, the dumpsters are unacceptableThere have been multiple issues where trash has stock-piled on the ground around the dumpsterThis has been addressed and the trash has remained for days on endThis impedes my safety and health riskNot only am I disappointed, I’m sure the department of satiation and department of health would also be unsatisfiedI have sent many emails, left several messages, spoke with Sarah and Erica at the central leasing office to pass along my concerns: no replyThis is ignorance and negligenceI emailed the Solomon organization and property manager and no retort or explanation. I have expressed financial difficulties and concernsI cannot continue to live in a residence which is so malfunctioningAfter reading reviews, I have noted similar concerns stated by previous residenceI am resubmitting my day noticed to revoke my lease from *** at English VillageI am requesting to find out what fees are incurred and what steps to get me out of my current apartment (**-**). My habitatality has been put to risk in regards to health, life, and safetyThe sanitation and DOH guidelines would be frowned upon in the stateMy safety and concern of intruders puts me at riskThe speeding residence who nearly hit me as I walk to my car put me in fear of walking to my carThe negligence of staff is unacceptableThe rude disregard of maintenance and lack of verbal communication and correspondence is inexcusableIf I do not receive notification, I am filing with small claims courtThe transcendent behavior and lack of compliance is unacceptableI have also included other concerns which are only ignored or answered with excusesIn addition, I believe the Revdex.com may need involvement upon reviewing resident reviews, which I wish I had seen prior to guaranteeing leasing at *** at English Village. I wish to terminate my lease NO LATER than March of I will follow termination fees and incitementI am on several requests to speak to property management and leasing agentIn event I am denied my request, again, I will see you small claims courtI wish to handle this situation without requiring legal action or police involvement (regarding the marijuana). I look forward to speaking to you and addressing my request to remove myself from *** at English villageI will comply with terms to end my lease. Please see my additional concerns once againDocumented below for specifications and interim terms of description. Thank you and kind regards, Concerns: 1-My first day moving in, the front door broke off the hinge and took several phone calls and hours to be fixedThe response from maintenance, “this always happens.” 2-My washer and dryer unit, which I am paying extra for: the dryer does not dry my clothing-even on high, over two and a half to three hours and he clothes are not even wetI submitted a request again to maintenance and was given the washer and dryer manual and a note along the lines: “you have to max dry clothes and these were new as of August 2017”-well, my clothes are small loads, lightly damp and it takes sometimes three or more hoursI have never had such timing to perform such task3-My mail is often returned to the deliver or whomever sent the itemI contacted the leasing office and I was told to contact post officeI’ve had friends living at *** and they expressed the same complaint to meOr I am not notified if something is shipped to the main clubhouse4-The air conditioner (my first week moving in when it was degrees) did not work and needed to be replacedThis took several days5-I previously requested maintenance to check my heat-I turn the system up to 80++ degrees and it will be on for over two hoursMy living room remains frigid and no heat blowingMaintenance’s response was “turn the unit up all the way to turn on”-I haveNow, I submitted another request this past week 12/or and no one has been out to check my heatIt’s below freezing outside and my apartment is not producing heatIt is not right that I am paying for the electric which isn’t even efficiently producing heatAnd to the point, this has been approximately five days and no one has been out to check6-The no smoking did not qualify to other tenants in my buildingThey would smoke right in front of the building and the smoke would come into my apartmentThis was later addressed-but still did not prevent people from smoking near7-When I walk into my building, you can smell marijuana permeate the halls and wallsI do not do drugs nor do I agree with them doneI am appalled at this and sickenedThis not only impacts my career but also impacts my profession and I can be penalized8-Although there is supposed ample parking, there are vehicles with expired registrations and tags in spotsThere are vehicles which have never been livedThere is a trailer parked which is not utilized for transportatinever moves and is taking a front spotThis is not appropriate especially given this is not a dot authorized vehicle9-Upon assessment of walls and such, there were puncture holes and marks in the three roomsI do not want to be penalized for this10-The sliding closet in the den area has been off its tracks since I moved inThe paneling is uneven and did not close appropriately11-You can hear through the walls and it is very disturbingYou also hear the apartments below, thus becoming distracting12-I was never informed about a storage unit or offeredI was never told the duration of my leaseMy lease took me contactingThe office several times and weeks to receive a copy13-I was told conflicting information upon each call and individual I spoke to14-The smoke detector batteries have died multiple times and at the point they died-they were in a very short time15-The surrounding apartments to mine wreak of something of cat urine and death decayAt times I gag from the horrible hallway odor
