This client had initially sought our services on May 22nd, of He had made payment to begin his patent search on May 25th, However, after some communication difficulties that occurred following his payment, we sent him an email offering a full refund to cancel his patent search (email
sent on 5/30/2017)The client apologized, declined our offer of a refund, and asked to move forward with the process (email received on 5/30/2017).Upon completing the service, the client was sent his 82-page patent search results, including a 9-page statement from an attorney on the potential patentability of the product (email sent on 6/1/2017)The client claimed he had not received it, despite responding directly to our emails including the documentWe sent it again, and he once again claimed to have not received itThe document was sent one final time, and we also let the client know that due to the consistent communication issues we were having, that we would not be seeking any further business from him, or any future partnership (email sent on 6/8/2017)We sought to provide the best service and most thoughtful communication possible throughout this process, but ran into some communication issues that made this partnership difficult to maintain. The client's representation of how events unfolded are not accurate, but we wish him the best nevertheless, and have issued him a refund as an expression of good will.Regards,

I am rejecting this response because:No Indication of intent to provide a physical prototype was given. They insisted on a virtual prototype Instead after the initial contact and deposit was paid. All I received from them was a picture and a juvenile malconstructed versions of what they called a  "sell sheet".I wasn't satisfied, so I obtained what I desired from another company.

Mr [redacted] (“Customer”) contracted our company in March of 2015 to provide professional industrial design which involves an iterative process of ideation, computer aided design (CAD), photorealistic rendering, logo/brand and presentation development.  The deliverables provided the Customer...

were defined in Order #2014-1333 and clearly did not include a physical prototype.  However, what the Customer paid for was far more than a simple sell sheet, rather the CAD completed would form the basis for prototyping and subsequent manufacturing. Furthermore, on May 22, 2015, the Customer requested a quote for a physical prototype to be built, which our team provided, however the Customer never executed the order.  Consequently, his contention that he thought our services included a physical prototype is simply untrue. Since we typically offer our services at 50/50 terms (50% due at signing and 50% upon completion), when the initial industrial design project was completed the remaining 50% became due.  After nearly a year of no payment, our team remained in contact with the Customer and we were never made aware of any issues with the services we provided.  On the contrary, we have emails from the Customer of how happy he was with the designs.  On May 31, 2016 the Customer attempted to make a payment of the remaining balance, however his credit card was declined.  Subsequently, when it became clear that the Customer no longer was going to honor the contract he entered for the work that was completed to his satisfaction, as is common practice in business, we turned it over to collections. Mr [redacted] (Customer) reached out to us online and filled out a form to begin discussions on developing his new product concept.  Our Innovation Team reached out to him repeatedly through email, however he did not receive the emails since they were being directed to his spam folder.  When it...

became apparent he was not receiving our emails, our team sought to call him, however we were notified that his phone did not work in Honduras.  On 11/16/2016 the Customer acknowledged that the emails were in his spam, however despite our best efforts to communicate with the Customer, he elected to not continue with our company.  Inexplicably he has posted this complaint, however I am unsure as to what our company did wrong.Our company takes extreme precautions to safeguard confidentiality when working with our clients.  Although this Customer never moved forward with the development of his invention with us, paid us no money, etc., we will keep his information in confidence per the terms and conditions of the Nondisclosure/Confidentiality Agreement that was entered.
