We are sorry to hear that you feel that TJM Realty Group has not responded as you wish to your family’s situation and to your concerns about the rental home in BurnetI can assure you that all of us here at TJM Realty Group do sympathize with your situation and with problems with your family’s
healthWe all know that not feeling well and not knowing why can be very frustrating. We also know that you would like TJM to take responsibility for your family’s situation, but we cannot do that as the facts simply do not support your claimAs your professionally administered air quality test clearly stated, all readings taken were within levels(1) The airborne fungal spores within the home were within levels(2) The aspergillus fungal spore levels were within levels(3) No elevated moisture was found in the homeBut we do understand that you are firmly convinced that the rental home is contributing to your family’s problems and that you wish to prematurely terminate your lease and move your family to a different residence, without it being considered “breaking your lease.”As you know, your current lease agreement runs thru July 31, and cannot normally be prematurely terminated prior to that date without triggering future rents and releasing feesEven though we are under no obligation to do so, TJM Realty Group has offered to allow you to prematurely terminate your lease with our firm and has generously offered to waive your responsibility toward both the June and July rents of $1100.00/each and to waive the $releasing fee clearly outlined in your leaseThese concessions alone total $3,135.00. Dear Sir:We are sorry to hear that you feel that you were treatedunfairly by our companyI can assure you that no one is giving you “the runaround” when it comes to your security deposit settlement statement. As we told you before, your security depositsettlement statement and check were
produced and mailed out of our businessoffice on Friday, April 29th, This was within the requiredtime period that is required by Texas State StatuteThe problem is that yourefused to give us a forwarding address, as is required in your TAA LeasedocumentAs per Page 6, Section of your legally binding lease, “You mustgive us and the US Postal Service, in writing, each resident’s forwardingaddress.” Our office asked you multiple times for your forwarding address, andyou refusedIn a case such as this we have no choice but to mail your securitydeposit settlement statement and check to your current rental address(Theresidence you had just moved out of.) We clearly posted on the face of theenvelope “Please Forward” and we highlighted it in yellow. According to the USPost Office the forwarded mail can take days or more to reach the recipient,if they properly submitted a forwarding address to the local post office. I am rejecting this response because: TJM, being obtuse to this situation is ridiculous to say the least, either one of two things are happening here, either ignorance is on your side and or you are being deceptive and conveniently leaving out the most important details --- being this MOLD is growing in the home, I have pictures of this and a MOLD ASSESMENT SURVEY WITH THE conclusion paragraph " Using these measurements as our basis, the indoor air quality within the home as measured during our investigation on April 13, 2015, is consistent with a minor source of CONTAMINATION ( Aspergillus/Penicillium ) fungal spores with in the A/C SYSTEM " We are being specific here, it is not the indoor air quality , it indeed is specific to the mold in the a/c unit that was making me extremely ill, as well as the mold growing in the corners, along the baseboards all thru out the house , that my wife and I have been cleaning for the last months on a daily basis, I have pictures I sent to you on May with the letter ( in which you still have not returned a letter in days now and you still have not met or even discussed with me my maintenance request put in nearly months ago, February 25-while in Lima Peru via email maintenance request on your website, explaining that youll needed to come seal the space between the cement floor and baseboards because there is a serious air draft allowing mold to come out here and seal the gaps in this home, therefore mold growing inside the home and outside allergy air flowing inside where I should be safe, comfortable and a living quarters free of polluted, contaminated air making not only myself but my child and wife all sick in unusual, over the top symptomsFACT NO1 - MOLD GROWS INSIDE THE HOME ALONG THE BASEBOARDS AND CORNERS OF THE HOMEI AM ALLERGIC TO MOLDMOLD GROWS IN THE WINDOW SEALS, AS SEEN IN PHOTO I SENT YOU MAY THAT YOU STILL HAVE NOT AKNOWLEDGED JUST LIKE THE MAINTENANCE REQUEST FEB25-WHILE IN LIMA. FACT - THE MOLD ASSESMENT SURVEY IS NOT A AIR QUALITY TEST, ITS WHAT IS SAYS, MOLD ASSESMENT , EVEN IF IT WERE A AIR QUALITY TEST, IT WOULD BE IRRELEVANT TO THE CASE, THE WINDOWS AND DOORS WERE OPEN APON THE INSPECTORS ARRIVAL AND HE SAID THE TEST OF THE AIR WOULD BE LESS THAN OPTIMAL, this is taken straight from the report itself, your claim of not knowing what is causing my families health problems and allergies is false, your claim of the rented home we lease from you has nothing to do with my allergies problems and you know this for " CERTAINTY", IS MORE THAN IT IS A LIE -- you know there is mold growing indoors, you know you have failed to come and seal up the home in nearly months, I am paying to live in a home intruded by mold therefore making me sicker, unhealthy and uncomfortable in the home period.! you know you have and did not service , maintain and clean the A/C unit in who knows how long, completely black inside , dirty and filthy when your a/c guy cut into it to clean it, the MOLD ASSESMENT SURVEY WHICH CLEARLY STATES " THE ASPERGILLUS/PENICILIIUM FUNGAL SPORE LEVELS WERE lower IN THE RETURN AIR PLENUM OF THE A/C SYSTEM THAN THE OUTLET!!! LAYMENS TERM MEANING MORE MOLD WAS COMING OUT OF A/C OUTLET THAN THE INTAKE, PERIOD.! , LETS GO ON " THE INCREASE IN THE ASPERGILLUS/PENICILIUM LEVELS IN THE OUTLET OF THE A/C IS AN INDICATION THAT THERE IS A SOURCE FOR THIS VARIETY OF MOLD WITHIN THE A/C SYSTEM, PERIOD.! CATCHING MY DRIFT HERE TJM?? AS I REQUESTED BEFORE I WANT MY MOLD ASSESMENT fee returned with my deposit in a timely matter, I will not tolerate you ignorance to this situationFACT --- I AM ALLERGIC TO MOLD, MEDICAL RECORDS I HAVE AND CAN PRODUCE APON DEMANDFACT PHOTOS OF THE ACTUAL MOLD GROWING ON THE FLOOR, WINDOW SEALS. FACT YOU ARE RESPONSIBLE AND LIABLE FOR THE MOLD GROWING INDOORS BY FAILING TO SEAL UP THE HOME, FACT --- YOU ARE LIABLE AND RESPONSIBLE FOR NOT CLEANING THE A/C UNIT, NOR SERVICING NOR MAINTAINING IT TO PUT OUT HEALTHY , CLEAN AIR TO THE HOME. FACT --- YOU HAVE FAILED TO RESPOND TO MY MAINTENANCE REQUEST ABOUT SEALING UP HOME, THERE FOR ALLOWING CONTINUAL MOLD GROWTH INSIDE THE HOME AND ALLERGIES FROM THE OUTSIDE BLOWING TO THE INSIDE WHERE I SHOULD BE SAFE. FACT YOU WILL BE LUCKY IF A DO NOT FILE A CLAIM WITH THE ATTORNEY GENERAL OF TEXAS, CONTACT *** *** AND HIRE AN ATTORNEY ON premises liability! Im not sure if you get it yet but iI believe that you can come to only conclusion here, your home at *** *** *** *** *** is indeed being intruded apon with mold and before you cleaned the A/C unit that it was contaminated with mold as well, do the right thing TJM, Im actually busy working to get moved and are very busy, I no longer have time for your games, I will take appropriate action very soon, I hope I have made myself clear as to why I have been feeling extremely ill inside this home and only getting worse because there is still mold in the home!
