search of a motor vehicle. They agreed on purchasing a 2001 BMW 325CI with only $500 down payment. Upon waiting approval on the financing bank WestLake, the clients were allowed to drive away with the vehicle. While waiting for WestLake, my client [redacted] allowed me to know he was experiencing problems with the vehicle and asked if it could be looked at by my mechanic, which I myself also agree upon. Within a couple of hours after me and [redacted] spoke, my mechanic contacted me saying he has test drove the vehicle and does not see the problem which [redacted] spoke of, I myself test drove the vehicle with [redacted] accompanying me, and we both agreed that whatever he said the vehicle had did in the past was no longer existing. After another week of having the vehicle [redacted] called me and said he was still experiencing the same issue, and he would like to switch vehicles to a 2010 Chevy Cobalt which at the time was not running and also by this time WestLake had declined the purchase deal due to [redacted]'s driver's license expiring. So I allowed him to use one of my other vehicles for the time being, which I had to collect back two days later to sell to a different client, and since we were still waiting on the Cobalt to be completed I now allowed [redacted] to use a 2003 BMW 530i and in the meanwhile [redacted] was to renew her driver's license. I told [redacted] to try out the 2003 BMW that I believe he would like it a lot better than Cobalt and also the 325Ci he previously purchased.
Within a week [redacted] called me excitingly that he liked the 2003 BMW 530i, and would like to purchase the vehicle, so we agreed to meet after the weekend to start the paperwork. On the morning of our meeting, [redacted] now contacted me complaining that the vehicle was overheating and that he can see a crack on the overflow tank. I asked him to get the car to my mechanic so it can be fixed. After 3 hours passed, my mechanic called me stating that [redacted] dropped off the key to the BMW but left the BMW parked somewhere on the 210 freeway, which at that point I had to go in search of the vehicle in fear that it has not been towed away due to parking violation. I found the vehicle on the left hand side of the 210 freeway, and after attempting to start it a couple of time it was evident that it would have to be towed back to my mechanic's shop, and after a day of waiting we come to find out the heads on the BMW has been blown. At this point [redacted] and [redacted] are now asking for the $500 dollar deposit from our first deal to be returned to them. I explained to them that it is not possible, not only did the bank not approve them due to [redacted]'s license being expired, but also they have had the car in their possession and have driven it for about two weeks and that nobody rents out cars for free. So there was no way they would be receiving a deposit back.
After another day or two had passed, [redacted] called me and asked if they could still try to purchase the 2010 Chevy Cobalt, which again I agreed to, with $700 more down. I would apply the $500 from our previous deal as well to make it a total of $1200 down and also with [redacted]'s driver's license being renewed. But this time they would not be able to drive away with the car until WestLake responded with an approval. I gave them the reason of why I didn't want to release the car, not only was it in their best interest but also in mine. If WestLake declined the deal they would be able to receive their down payment of $700 back.
On October 2nd 2015, I invited [redacted] and [redacted] to my home to sign the documents for the new deal. While signing the documents, I noticed [redacted] pointing out to [redacted] something on the paper, and immediately [redacted] left the room to step outside. So I asked [redacted] to insure that everything on the paperwork was correct, and he agreed that everything was fine.
I sent out the paperwork to WestLake awaiting an approval from them, and in the meantime, [redacted] reached out to me stating that she does not see it fair that they had to put money down to buy a vehicle and I didn't allow them to drive away with it. She stated that she found it difficult to get back and forth to work and also getting her two kids to school. So once again I allowed them to drive away with another vehicle. So for about 4 days everything was fine, we were simply waiting on the approval from the bank, and finally when the bank did contact me, the deal once again was declined due to suspension on both [redacted] and [redacted]'s driver's license.
So I'm thinking to myself it's about time to let these clients go, because they wouldn't be approved for a car anytime soon, and that even though they have had the car for about 4 days, I should still go ahead and give them back the full $700 deposit. I checked my bank account to see how much I had reflecting and noticed a check that was cashed for $200, which caught me by surprise. I viewed an imaged of the check and realized it was written to [redacted], in his hand writing.
I will be going to court with [redacted] and [redacted] on December 22, 2015. They have decided to take me to court because I refused to refund clients that I've tried my best to help out, but that would steal from me in the process. I will present my case to the judge, and I believe the judge would view this case in the manner that it should be viewed as. If needed, I will also attach a copy of the check that was stolen and cashed.
