Company list deposits on the website for renting properties but re words it as a "holding fee" on the app and states nonrefundable in small print. I submitted an application for one of their rental properties on 10/20/2014. I was under the impression due to the website listing the money to put down on the property as a deposit and it did not indicate it was non refundable that I could get my money back. I changed my mind about moving to the property on 11/2/2014 which was 13 days I was told my so called deposit was actually a non refundable holding fee and because I changed my mind I would not get my money back. When I asked where was that listed I was told my deposit is not a deposit but a holding fee for the property. This is a very misleading practice and they should be forced to verbally reveal the nature of the deposit. I should be allowed to change my mind and not be penalized. Desired SettlementI am seeking to have my full deposit of $300 refunded due to misrepresentation of the requirements. They list the money to hold the property as a 'deposit' on the website and never state that it is non refundable but they call it a 'holding fee' on the application and put in the fine print that it is non refundable. This is deceptive practices and they should not only indicate that the deposit is a nonrefundable holding fee both on the site and verbally before taking an application.

My name is [redacted] . On August 1, 2014 I entered into a lease agreement with [redacted] to lease a duplex property they owned at [redacted] XXXXX. I started the rental process the first week in July in which I paid a $35 application fee in the middle of the month I paid $400 for the property deposit and $300 for my pet deposit. They ask me what date I wanted to move in, I stated July 31, 2014. I went to their location in [redacted] on July 31, 2014 to sign the lease and get the keys to the property. When I arrived at [redacted] nothing had been done. The unit was not cleaned nor did I have the appliances (stove & refrigerator) they promised to replace. It took me 2 days just to clean the unit. The toilet was inoperable so was the bathtub & shower. They gave me the wrong key to the front wrought iron door in which I had my moving truck at the door on August 2, 2014 ready to move in. I had to wait until the lady next door at [redacted] son came home to get the key to open the door because she is handicapped and couldnt come to the door to give it to me. After finally getting everything fixed by their maintenance guy who did all the work on August 1, 2014 I still wasnt able to take a bath or use my stove. I had to wait until the following Tuesday for the plumber to repair shower & bathtub and to turn the gas on for the stove and hot water heater. In November we had a few cold days in which I needed to turn on the heat. The heater was broken. I called 6 times starting on November 1` to get their maintenance man to come and check out my heater. They finally sent someone on the November 6, 2014 the maintenance man stated the heater wasnt even hooked up. They had to replace the entire heating unit which was located in the attic. They had to come through my living room and kitchen hauling big pieces of this heating unit disturbing me from conducting my business. After moving from my previous location at [redacted] I had a $303 credit from [redacted] I received 2 zero bills in September & October 2014 however in November 2014 my bill was $ 551 and at the end of the month received another bill for $ 861 I called [redacted] to find out why my bill was so high they stated the meter reader estimated my bill for the 2 previous months which caused this high bill. I called [redacted] to let them know that I need additional time to pay my December rent due to this unexpected bill from [redacted] I was involved in automobile accident on December 23, 2014 in which I was injured which required me to go to doctor for treatment for my back, left arm, and neck injuries. On January 12, 2015 while going to the doctor I was involved in another car accident some hit me head on causing me to be hospitalized at [redacted] for a broken right leg, fractured ribs & sternum, and aneurysm in my head. I was in ICU for two weeks when I received a call from [redacted] at [redacted] stating that my neighbor was complaining about water running on her side. I told my fiance he went to my residence and turn the water off until he could find out what was going on because he was concerned more about what was going on with me since I came out of surgery. [redacted] called and stated that the neighbors water was turned off as well. My fiance stated he only turned my water meter off. I had a water pipe to burst on my side of the duplex which ran over to their side at [redacted] because no one was there and Im in the hospital my neighbor turned the water back on and let the bill accumulate until my fiance was finally able to meet someone over there to fix the broken water pipe. That when I found out there was only one waterline on the property and I was paying the water bill for both units. I had been talking to Ms. [redacted] at [redacted] about this problem while I when in [redacted] physical therapy rehab unit and they had notified [redacted] which they choose to ignore. I was released from the hospital Feb. 7, 2014 I couldnt return to my home because of the stairs. Im disabled and must use a walker and a wheelchair so I now reside with my mother at [redacted] who is caring for me. I have physical therapy twice a week at [redacted] outpatient rehab clinic and additional ortho doctors appointments until Im able to walk again. My mother took me to their office in [redacted] so I could give them the water bill adjustments Ms. [redacted] at [redacted] sent me. I spoke with [redacted] who is the owner of the business he made copies and added up the amount hes owes me in reimbursements for the water bills & sewage charges. Ive been waiting a month and still have not received my money. They sent me a statement stating that I still owe them $1680 for the remainder of the lease at [redacted] however that lease was voided due to them not disclosing to me that I would be paying my neighbors water bill. I told [redacted] I wanted my deposit back as well because they never cleaned the unit to begin with. These are the most unprofessional people Ive ever had to deal with. No one seems to know what the other one is doing in regards to settling disputes or fixing any maintenance issues. I feel I shouldnt have to pay the water bill & sewer charges at all. I agreed to pay half but now I want the return of my $400 deposit and the entire water bill and sewer charges because since January 12, 2015 I never returned back to that property. In addition I think they have electrical issues as well which caused my electric bill to be high as well. My fiance moved my stuff out in March and I gave them the keys back. Ms. [redacted] at [redacted] (XXX-XXXX) can verify everything I just stated. She also told [redacted] he couldnt least that unit at [redacted] without running a separate water line to [redacted] They owe me $731.99 for water & sewer bill charges plus my $400 deposit.Desired Settlement$731.99 for water & sewage charges$400 depositNo negative credit rating for myself & my son [redacted]Business Response We took over management of this property right before Ms. [redacted] moved in. We were unaware of the issue with the water meter. We have since been in touch with [redacted] and have all the information we need in regards to the water meter issue. When Ms. [redacted] moved into the property she did have some issues that needed to be resolved and they were done so through our maintenance department. None of the issues were considered to be essential living needs. Her appliances were delivered to her the day after she moved in. The unit was cleaned before her move in date but it was not acceptable to her when she moved in. A cleaning and maintenance crew was sent back over to the property the next day to clean the property again and handle any issues she had. While we are aware that maintenance issues are inconvenience to a tenant we make sure that all are handled in a timely manor. There are some issues that cannot be discovered until someone is actually living in a property. As for the water and sewage bills we are crediting 1/2 of those costs to her account. Ms. [redacted] moved out of the property the last of March. At the time she owed $1035 in back rent. Her $400 security deposit was credited toward the balance she owed. We are also crediting back to her $348.79 for 1/2 of the water and sewage bill costs. The new amount that Ms. [redacted] owes is $286.21.
