Review: I feel that I am being taken advantage of my nice nature. I am being over charged for change order work that made the job even easier to help them out. and I offered extra services of my labor and got nothing for it. I have lots of pictures of the job when it was bidded and when they started to show up for work and through the whole prosses. one employe said it would take three weeks and it is now on the ninth week. I've had all sorts of down time ,which means lots $$$$ on nonused equipement rental for which I should not have to pay for. when I hired you I thought I was getting a crew to work on my house,(to me a crew is 4 to 6 people .) not two carpenters. I expected this to be done in a fashionable time frame not three months. I got four pallets of shingles and it looks like i'll be sending one whole pallet back so there is actually less shingles to put up than what the orginal quote was. so your getting more money for less work. hense don't roofers do there work by the square? and I ordered 45 squares and it looks like I might be sending 15 to 25 % of then back so in my book that means you actually did less roofing than what I am paying for.Desired Settlement: after the first change order there will be no more. and work must be completed as described in your contract before payment and you have already have received $3800 of your next payment, for which work has not been completed on that section yet.

Response:

[redacted] contacted ECS because he needed help continuing his home. He told us his contractor had been in an accident and was having trouble getting back to the job. And he did not want to wait for him any more. I met him , looked at the house and determined what was done and what still needed to be done in order to accomplish what [redacted] was asking us to do. He asked us to finish building the roof. which involved setting trusses, sheeting the trusses with plywood or OSB plywood, installing subfacia, finish facia, installing the soffit and the shingles. We came back with a quote for [redacted], and it was way more than he expected. He said he could not afford it. ECS shrugged it off and went on with other work. Sometime later, [redacted] contacted us again and said " bring a contract he will sign it and write a check on the spot. So we did, and he wrote a check for the start up. In the mean time ,[redacted] had managed to get some more of the trusses set. When I saw this I took $1000.00 off the total of the contract. ECS began work a week or two later. At no time did I give [redacted] a scheduled completion date. ECS had 2 to 3 men on the job. It is a fairly small house, but the roof is extremely steep. The attached photos are what the house looked like on our arrival. And what it looked like when we left the job because of [redacted]'s refusal to pay the invoice. ECS began to finish setting the trusses and it was quickly determined the trusses were not set correctly. We reset those trusses and finished setting the rest. I turned in an invoice with the $1000.00 added back in and [redacted] payed the invoice. Work continued, At some point [redacted] had asked the lead carpenter to do some work not included in the contract. The lead carpenter walked me through the desired items from [redacted]. I then developed the dollar amount we would need to do the additional work. I told [redacted] it would be around $4000.00. [redacted] gave the go ahead and we did the work. I gave [redacted] the next invoice which included $3800.00 for the added scope of work. [redacted] paid the full invoice. Work continued with a bunch of weather delays. The job site is in BIG SKY Montana. High in the mountains. It was about this period of time that ECS had some employee related problems to deal with. And they did affect the progress of this Job. I have agreed with [redacted] to except the cost of the equipment rental for this week in time. Even though he did use the equipment himself to move material around the job during this time . He was doing all the masonry himself. It was this next invoice that [redacted] refused to pay. He said he did not have his glasses on when he paid the last invoice and did not understand what he was paying for. He feels we overcharged him for the change orders. We did not overcharge him. He agreed to it and he paid for the change orders. Only to come back and use this as a way to not pay us at the end when we were nearly finished with the contract. And he had his roof , for all practical purposes done. ECS tried several times to negotiate with [redacted]. He refused, he would hang up on us as soon as he knew who he was talking to.
