We would like to inform you that since this response, EnviroSmart has worked with us to resolve the issues, and as of yesterday all issues have been resolved to our satisfaction. I had a telephone conversation with Richard, the owner of EnviroSmart, on Tuesday or Wednesday of last week while I was in Canada and set up a service appointment for 25 April to replace the filter they had cleaned, at no charge, and to go through with me step-by-step of how to set up the initial chemicals in the spa. The Service Manager, Bobby, arrived on schedule, and did everything that was expected. Once the spa was filled with water and turned on, it was discovered the heater had failed. Bobby replaced that item on the spot, again with no charge, and continued to adjust the chemicals. I learned more during this visit than ever before. We also discovered some errors in the quick start guide provided by EnviroSmart, which Richard had acknowledged during our phone conversation, and he told me, as did Bobby, that the instructions needed to be modified to reflect the actual steps to be taken. Very good service and attention to detail on this visit. We are pleased with the results, and informed Richard of the same. Review: I purchased a hot tub on 10/8/13 and was advised to call for a delivery date as I was having a deck addition built to my home. About a week later I called the [redacted] to advised that I no longer wanted the product. I was then told that my money could not be returned until he resells the product to another customer. I was then advised that I would be charged a restocking fee of 10%. When the purchase was made there was no mention of such a return policy. My receipt has absolutely no return policy information nor was any provided upon the purchase. My daughter went to the store to speak with the [redacted] on 11/6/13 and was advised the same. The store has no posted return policy inside of it. I feel that this is an unethical practice as the hot tub never left the facility. I am simply seeking reimbursement for a product never received or used.Desired Settlement: I am seeking a full refund as I no longer desire the product

The person making this complaint is not the customer who purchased from this company.

The purchase of a used hot tub was made on October 8, 2013 by the father of the complainant. The purchaser returned on October 16, 2013 and said that he and his wife had changed their minds. I informed him that our general policy is no cancellations or refunds, only store credit. However, in an attempt to help the customer, I agreed to refund his purchase price minus any costs incurred by the company once the spa had been resold. I told him the cancellation costs should be very minimal and we should sell the hot tub again within a few weeks. The customer agreed to this arrangement.

The customer returned about October 28, 2013 when I informed him that the hot tub had not sold, but that we did have interest and the sale should occur soon.

On October 9, 2013 the customer’s son-in-law and daughter returned and I explained the agreement between the customer and the company.

As of today, the hot tub in question is now sold again. There were minimal additional costs associated with the sale and this will be waived. A bank check for [redacted] is scheduled for arrival by November 22, 2013 made payable to the customer.

EnviroSmarte Spas and Pools

Review: I bought a spa from this business in the fall. They give you a specific time frame they will be there and they were not. They arrive placed it on my deck and told my husband once it fills, this is what you do and left. After 24 hours I get into this and smell this funny mold like smell. Thinking ok its new, but the next day I'm sick with diarrhea and 3 days later a bad bacterial kidney infection that took me to the ER. Not thinking this has anything to do with the spa at this time, I enter it again once I am well. Again, sick the next day with diarrhea. Went to the store, 37 miles form my home, and spoke with one of the maintenance/repair guys and went over the chemicals and what to do and all again to make sure I am doing it right. Did the chemicals, and sick the next day and my bathing suit ruined as the mold smell wont wash out.

So we made another appointment with them to come out and do the chemicals and go over it with it again and find out why this is smell. Appointment for "between 11-12" And it is now 1:58pm and only after a call did they tell us they got stuck somewhere else about 50 miles away and would be here at 2:15. The owner Richard as usual making excuses why they are not here and why service it bad!Desired Settlement: This was purchased because of the medical need for me to have for arthritis. And it was very expensive purchase and there is no customer service once you pay. Now looking at the Facebook page they have... I see the only positive entry is the maintenance guy and the other one is a negative like me...no customer service. I need a refund so I may purchase one from better spa business.

This customer purchased a hot tub from our business on 8/12/15 and it was delivered on 9/8/15. The sales order signed by the customer clearly states there are no refunds. When the hot tub was delivered on 9/8/15 the proper operation and maintenance was explained to the customer. Owner's manuals and guides were left with the customer. The only other visit to the customer occurred on 4/16/16. The water condition was found to be very bad due to improper customer maintenance. Our service technician assisted in draining the hot tub and again explaining operation and maintenance. The service technician also removed and cleaned the water treatment chamber that completely clogged due to improper water maintenance. The services and service call were performed at no charge to the customer.

Review: I was searching online for an OEM replacement radio for my [redacted] hot tub. I came across [redacted] and called [redacted] to discuss my needs. I informed him of the model number and he said he had an OEM replacement radio. I said great. He informed me that this radio was OEM. It was not. It was simply an after market radio that would not fit my hot tub with out major modifications and new wiring. I informed him of the problem and he said too bad no return. I was very upset. Then to top it off I was charged over $266.00 for a radio that I could have purchased on Amazon for $122.00 . Thats more than twice the cost for the same radio that wouldn't work.Desired Settlement: I want to return the radio and receive a full refund. This is not an OEM part as he advertises.

To address this complaint, it must be broken into two parts:

1. Customer dissatisfied with price of part purchased.

2. Customer claims that the part shipped was not an OEM (Original Equipment Manufacturer) part.

Here as a sequence of events relating to this customer:

· This customer contacted our company by email on November 8, 2013 requesting contact regarding his need for a stereo unit for his older [redacted]. I personally called the customer and discussed his need. He told me he could not find his stereo unit on our [redacted] Parts website store [redacted]. I informed him that at the time his spa was manufactured, [redacted]s was using a stereo unit made by [redacted]. Since then that unit is no longer supplied by [redacted] and was replaced with a stereo unit made by [redacted]. As I informed the customer, as a dealer, this is the [redacted] part we would use to replace the unit for a local [redacted]. Also, as the manufacturer, [redacted]s does change the specifications for components based on many reasons at their sole discretion. However, as an authorized [redacted] dealer, we only sell parts from [redacted]s and everything is shipped directly from the factory.

· On November 9, 2013, the customer placed an online order for the [redacted] stereo unit, part number [redacted] The list price for the part was $354.98. The customer took advantage of Free Shipping (order over $100) and a 25% Discount, paying $266.23 by credit card. In order to complete checkout, the [redacted] MUST be agreed to and the checkbox MUST be actually checked by the customer. The order was processed and shipped, directly from the [redacted]s factory, by [redacted] Ground. The customer received the shipment on November 20, 2013.

· The customer called our company early on November 20, 2013 expressing his concern about the price paid for the part. As I explained to him, I did not know what he was comparing to and asked that he send me a website link so that I could research this situation.

· After not receiving anything from the customer, I initiated an email to him late on November 20, 2013 requesting the information.

· On November 21, 2013 the customer responded with a website link to the stereo unit he said was cheaper. This initiated a series of emails between the customer and myself. The following summarizes this interaction:

o Explained to customer that based on the information supplied to me from [redacted]s as a dealer and the information supplied by the “competitive” non-[redacted] dealer site, I cannot say that the unit supplied from the other site is the same as the one supplied from [redacted]. [redacted] does make adaptations and modifications to “off-the-shelf” parts and as a dealer that ALWAYS uses genuine [redacted] parts, there is no reasonable expectation for me to have this knowledge as it would be considered a trade secret by [redacted]s.

o Explained to customer that the Terms and Conditions that he agreed to precludes any return.

o Since the customer’s issue was price, I offered a free product (pillow or filter) with free shipping as a good will gesture.

o Customer responded with the following:

§ Threats

§ Abusive Language

§ Bullying Behavior

· On December 25, 2013 the customer sent two emails. I did not respond to either email, since before I could respond after the Christmas vacation, the Revdex.com complaint was received on December 27, 2013.

Based on the above circumstances, the customer is NOT entitled to any refund. The emails are [redacted] as documentation. In summary:

· The customer placed the order for the agreed price, agreeing to the Terms and Conditions.

· The order was shipped in a timely manner DIRECTLY from [redacted]s (the Original Equipment Manufacturer or OEM)

· The order was received, exactly as placed by the customer, in good condition by the customer.

We would kindly request that this complaint be found completely baseless. If you have any questions, please let me know.
