Matrix Fitness and Spa (now doing business as Eon Well) ceased all contact during the shutdown, making it impossible to take the steps to cancel my gym membership. I tried to call 6 times to initiate the process on the following dates:
- April 8, 9:58 am
- April 24, 10:37 am
- May 4, 9:11 am
- May 18, 10:09 am
- May 21, 5:30 pm
- May 27, 8:58 am
I was not answered until May 28th when I delivered a letter stating my intent to cease paying membership fees and dispute the reinstated monthly dues for May, which were reinstated without warning on May 18th. Matrix refused my request for a refund and stated that under no circumstances were they making any refunds. To me, Matrix made it impossible to cancel my recurring membership with their gym, and refused to refund me. I don't have very much power as a consumer, but I am filing this complaint trying to stand up for myself and recoup the money that I went to great lengths to not pay for a service that I made clear that I did not want.

I do not fault Matrix for shutting down, and understand their predicament, but I believe that by ignoring my messages declaring my intent to cancel my membership, they made it impossible to opt out of my contract. By refusing my request for a refund, they acted in bad faith and their ceasing of all communications with their members began to seem like an attempt to prevent attrition from their income source, and I am filing this complaint to try to get back the money that I went to great lengths to not have to give to them.

Two issues: while I was a member of the gym, they excavated black mold from the men's locker room and failed to notify any memebrs of the event. Withholding this information put me at serious health risk. My inquiry and concerns about this were neglected and downplayed.

Additionally, I was intimidated and threatened with legal action (by email) to remove a fair and honest review on Google. I believe that this is unethical and potentially illegal.

Dear Sir or Madame:

Thank you for providing us the opportunity to respond the complaint brought forth by our former member, Mr. ***.

Matrix Fitness and Spa has never nor would it hazard our members in any way. We take everyone’s health and well being seriously. Mr. has elected to take on this crusade for reasons that we can only speculate and only after he departed the Club. His initial concerns, which in no way resembled this current matter, were taken seriously and addressed when initially brought forth, as detailed in these attached files: *** EXHIBIT 1 and *** EXHIBIT 2. My own speculation is his meeting with our owner was frosty (further evidenced by his refusal to shake our owner’s hand when they met several months later) and has decided to make this matter personal despite the Club’s efforts to satisfy Mr.’s concerns.

Based on the correspondence detailed in *** EXHIBIT 1, we take our claim that he solicited professional services to be just as valid as his complaint again us. Further, to attempt to shield oneself behind the label of a ‘private citizen’ is interesting; to state factually inaccurate and disingenuous claims, regardless of your perceived stature, comes with consequences. To enlist others in support of your review (please see the attached documentation regarding post by ***) further substantiates our reasoning that this case is one of pure vindictiveness for reasons that only Mr. can explain.

To conclude, we feel our response is justifiable but will consider its removal should Mr. choose to do the same. In addition, Mr. requests no further contact by the business; we are more than happy to comply and demand the same.

We feel that our A+ rating with your organization in 15 years of business speaks for itself, however, we will not rest on our laurels. As mentioned before, we take the interests and well-being of our members and guests seriously and would not hazard them in any way.

When Mr. references, “…The owner, ***, insisted to my face that I was sent notification about the discovery and removal of black mold during summer of 2018.” He continues, “Given that Matrix ownership verbally confirmed the black mold issue to me in person…” When Mr. brings up the matter, he was referencing the situation that occurred within the façade of the building more than a decade ago, not recent times.

Should you require a heftier response, we are happy provide it. However, we too are amenable to the resolve the issue based on mutual agreement that the parties agree not to contact one another again.
