We feel that we have been more than fair with the offer to replace the boiler and hot water tank at material cost with no labor but the consumer declined that offer This offer was out of good faith because we were told by the manufacturer specifically that they are not doing anything about their unit We pride ourselves on taking care of our customers and we feel this is more than fair because their unit is completely out of parts & labor warranty All Weather is still willing to replace the boiler and hot water tank at material cost with no labor charges even though the customer previously declined our offer

All Weather Response to Revdex.com Complaint # [redacted] ***’s List Case # [redacted] and [redacted] Complaint # [redacted] We have provided multiple informational documents to go over the details of this claimWe have provided the following: Attachment 1: 1- Original proposal2- Sales brochure for the [redacted] Combo Boiler3- [redacted] product information4- Load calculation that was performed by our sales associate5- Expansion Tank information6- Picture of the install7- [redacted] ’s Recommended piping layoutAttachment 2: 1- Summary of Invoices with hand written notes2- Copy of Original Invoices3- Copy of our Quickbooks invoicesAttachment 3: 1- Email conversation from 4-23-through 5-12-2- Hand Written notes on email conversations3- Proposal that was attached to 5-7-email with additional information backing my word where I told [redacted] that I would do the hot water heater proposed at cost with no labor4- Printed copy of the water heater link in which [redacted] providedAttachment 4: 1- Proposal from Stack Heating with All Weather’s Response2- Proposal from Herbs Plumbing with All Weather’s Response3- Proposal from Lakewood Furnace with All Weather’s ResponseTo All Involved: My name is Ray SP [redacted] , President of All Weather Enterprises, Incd.b.aAll Weather Heating & CoolingAll Weather prides ourselves with doing every job to the manufacturer specificationsWe have been in business for over years with an impeccable record in customer service, integrity and handling any situation with the highest level of empathy and understanding to resolve the situation at handWe are very disappointed that this had to come to these multiple levels of complaints from [redacted] and [redacted] because as you will see we tried to handle this in a professional manner when we really had no obligation to do so, as we were out of both manufacturer and labor warranties We installed this system in November of There were 3-calls in the first year for problems that were not related to the actual [redacted] Combo Boiler where we adhered to our obligation of our contract with no labor or material cost to the [redacted] sTwo years after the installation on 11-26-we were called out for maintenance on the system which was completed and at that point the [redacted] s told us about some issues they were having in which we looked at and made some adjustments and all was working properlyFrom that point we had no communication until 1-7-where the [redacted] s called about some potential issuesWe addressed issues and noted our findings on invoice # where we made some adjustments and recommendationsTwo years and three months later 4-12-when the unit is now out of warranty we receive a call about the unit leaking waterUpon arrival we noted our findings on invoice # where parts were requiredWe called the manufacturer who was not very cooperative and did not help out with the leak situation in a speedy mannerAfter multiple hours of phone conversation and transfers we were finally able to order the part from an out of state vendorAt some time during the call 4-12- [redacted] told us about the recall of a part on the unit that could cause fire which was not related to the current problemThe [redacted] s were never notified and was unaware of the RecallAll Weather was not notified by the manufacturer of the recall as well but some of our other customers who have these installed were notified by the manufacturer directly and were scheduled directly with the customer to do the recall repair with an outside of [redacted] contractorAll Weather had no knowledge of whose unit was under recall because we are not the manufacturer and they contacted the consumer directly I contacted [redacted] within the next couple days and we discussed the current situation and she expressed her concerns with her systemI told her that I will contact [redacted] to see what I can do and if they are willing to do anything for her as we have several other customers with the same unit that are have multiple other issues as well [redacted] said they are not going to do anything and that we are on our ownI contacted [redacted] again and let her know what was going on and explain to her what [redacted] saidI told that once we find the parts needed, we will get them ordered and installed so we can get their unit up and running which at that point we can see where we stand with the [redacted] s that I have contacted to see what can be done with [redacted] [redacted] was so appreciative of all that I was doing for her and her family and I would do the best that I can and make it right for their familyFinally we received the part and went back to install on 4-22-where our technicians were having a very difficult time getting the parts installed without leakingAfter multiple installations and removal of the part we finally got the unit not to leakUnit was working and not leaking at the end of our visit I’m not sure exactly if it was that night or the next day but shortly after we received a call for [redacted] telling us that it is leaking againWe sent one of our technicians out on a Sunday to look over the unit to see if it was the same part or something else where he confirmed that is was the same part leakingNo charge for the Sunday callAt this point [redacted] told our technician that she wanted to speak with meI contacted [redacted] by both phone and email every time we told her I was going to call to keep [redacted] informed on what was happening with their [redacted] systemI made a visit to evaluate what we could do and that I can provide them with a quote for the agreed solution of installing a new water heater with a power vented gallon unit located in the previous location at material cost with no labor in which we did in fact provideOn April we received an email which is all listed within this response, with all of the history of this unit and what she has been dealing withThe email was informational and somewhat demanding in some areasWe called and scheduled an appointment for me to do a site visitOn May 2nd I went house to get information and to give them some options on how we are going to proceedAt the end of our conversation we both agreed that a Power Vented Hot Water heater that vents in PVC out the side of the house is the best way to go [redacted] did not want to go with a Standard Hot Water Tank because of how it would have to use the existing chimney and we would have to install a chimney liner for it to operate properly Saturday Morning May 7th at 7:am I sent an email to [redacted] with the proposal for the Power Vented Hot Water Tank with full detail of what we were going to do with location of the venting and details of the hot water tankI was not working in or around the office this day and [redacted] replied Saturday 12:pm the following: ” Is this the hot water tank you intend to install ( [redacted] White Power Vent gallon 40,BTU), see link below, as reference, listed for sale as $1, [redacted] Per our discussions, we have been appreciative for your kind understanding to make this situation right for our family We were pleased with your proposal to cover labor costs for the repair of the current boiler and installation of the water tank Would it be fair to ask of you, at this time, for us to cover just the cost of the new hot water tank? We ask as we continue to be concerned about the fate of the current [redacted] boiler and the costs we will have incur to repair and keep it working ongoing We are not certain how much ongoing maintenance and repair the current [redacted] boiler will require to keep in service (and not leaking) As the lawsuit against [redacted] is still undetermined, we are not certain of our continued obligations of costs ongoing or eventually to replace the boiler entirely We want to be fair due to the current circumstances with you and your Company.” Please keep in mind this was on Saturday afternoon and I was not working or sitting around waiting for a response to my email as I gave [redacted] my cell in the email Sunday Morning May 8th at 9:am [redacted] sent another email with UPDATE in Subject line and replied the following: “After having sent the e-mail below and further worry / digestion of facing a bill of $1,200, we consulted a dear friend who is a fellow business owner and ***'s List A rated contractor After reviewing our latest invoice, our friend advised us that essentially we are being "too nice" We have been advised it would be fair to pay nothing further and to pursue our concerns with the full weight of the [redacted] , Revdex.com and call to consult with ***'s List directly We should have another ***'s List HVAC contractor out to our home to document the current state of our [redacted] boiler / hot water tank In our friend's opinion, the $1,will most likely cover most of your costs in fixing the current situation and only temporarily with the boiler problem still not addressed for us We paid $6,for a working boiler / hot water tank and have yet to receive satisfactory delivery of that service As our boiler was newer on the market, it could have even have been a demo with little cost to you from your distributor initiallyYou have given us your verbal word that you would make this right for our family in an April 15th conversation and in a follow up conversation on April 27th stated you would fix / replace the boiler / hot water tank to our satisfaction with no labor charges and costs kept low / to no costs based on your need to correct past mistakes made by a former salesman, who in your words, did not meet the long term needs of your customers and was just in it for the money We have yet to receive these promises or commitment in writing Our frustration and worry levels are wearing thin as our boiler drips water all over our basement floor, continues to run hot/cold, and struggles to heat our home over nightThis is a drastic switch after our e-mail below; however we feel our concerns need to be met and perhaps made a mistake in giving your business the benefit of the doubt Please advise by Wednesday, May 11th, or our further communications with you will be thru the [redacted] 's office / Business Bureau / ***'s List.” You can finish reading the email correspondence in our provided email documentationI logged on to our system Sunday night May 8th to set the schedule for the next day is when I saw ***’s UPDATE reply and was actually somewhat confusedI’m not sure they received the best advice from their dear friend who is not a HVAC contractor and it is obvious that they do not know anything about HVAC with the basic comparison of a power vented water heater to a standard water heater, when the fact of the matter is that, [redacted] , the Manufacturer of their system is not willing to do anything for any of their vendors, installing contractors or end consumersSo how is that All Weather’s responsibility to endure all of the cost of a system that was installed per manufacture specifications? All Weather was going to install products at cost with no labor as a “Good Faith Gesture” when All Weather did not have any responsibility to do soThe [redacted] unit is years old, has no parts or labor warranty left on the system and now all we are claiming that all weather should be responsible for replacing the entire system when the Manufacturer is the focus where all the compensation and reimbursements should come fromAll Weather offered what most companies would never offer FREE LABOR with materials at COST, they would have walked away, where All Weather did notWe can compare this to the auto industry where if you owned a car for months or years and your car starts having problems or you find out about a recall, what do you do? You would not go after the salesperson or the dealership that sold the car; you would go after the Manufacturer of the carWhat would they do, nothing! They would not offer to repair your car for parts only with no labor chargesThey would not give you a new carQuite frankly, the car manufacturer would do absolutely nothing and you would sell your car to someone and give them your problem car and move on without any compensation what so ever from the manufacture, dealership or salesmanThe difference between the mega profit car manufacturer and a penny profit small business like All Weather is that we actually care about all of our plus clients, which is why we offered free labor and materials at COSTAnother comparison in the Auto industry, for example, is if you had an issue with your transmission on your car and you take it to a repair shop where they perform Diagnostics and they made some adjustments and everything seems to be fineWhat do you do with that when you take it home and a day or week later you still have the same issue? Do you keep driving it for another years or do you take it back to the transmission repair shop that worked on your transmission? You take it back to the repair shopThis is another example of how is All Weather supposed to know that after we made adjustments that everything wasn't working fineWaiting almost years on several different occasions to call and say we are having the same issue; and expect that we are supposed to know differently is not fairAll Weather feels that we offered a solution to a problem that the manufacturer decided to not handle and we are the ones getting scrutinizedAll Weather believes we offered a fair and reasonable compromiseWe have visited over 45,homes and businesses over the last years and when an issue happens, we have managed it, which shows in our minuscule history of complaintsWe hope this clarifies the issues at hand with the Revdex.com, ***’s List and [redacted] All Weather has contacted several [redacted] s about the lawsuit against [redacted] where we are still waiting an answer if one of them is interested in taking on the caseAlso, if you search [redacted] boilers, every link that is on the web that I found has security issues and or not foundIt is quite obvious that [redacted] does not want to help out any of their vendors, installers or end usersIn our opinion, this is a matter we would suggest the [redacted] should look into with the manufacturer of the [redacted] productsBest Regards, Ray SP [redacted] , President All Weather Enterprises, Incdba All Weather Heating & Cooling
