Dear Revdex.com and others it may concern, [redacted] enrolled her son [redacted] for care on Wednesday, July 27th to Friday, Septfrom the hours of 7:00-12:noon M-FAt this time, EPIC Endeavors Preschool Academy had two teachers staffed and had been license for weeksAlthough the facility opened with a preschool focus officially starting on Sept6th, to serve our community an Academic Preschool, EPIC Endeavors Preschool Academy took in [redacted] for mornings when [redacted] came to the facility to inquire about earlier needs than SeptEPIC Endeavors Preschool Academy tuition payment document states deposit and registration fee is nonrefundable and her payment of $included the $non-refundable registration fee as well as her payment for ***'s half day month of care $EPIC Endeavors Preschool Academy provided and/or made available [redacted] care on all of these days, with the exception of Monday, August 29th which was due the need to have ***'s health form from the parents in ***'s file which is a required under state statuteIt was provided the following day to have on fileWhile [redacted] was in our care, EPIC staff requested a meeting with mom on Aug17th, to discuss our EPIC expectations and the behaviors noticed by [redacted] that were requiring on support [redacted] showed up and EPIC staff had a dialog about his lack of adhering to rules and expectationsEPIC staff also shared how staff worked to redirect and model the rules daily as well as how much on demands he was requiring from EPIC staffThis meeting was set up to start a dialog about a plan for [redacted] to assure his success as well as the success of other EPIC's other children requiring the typical state expectation of a 10-ratio adult supervisionAt this time, [redacted] and EPIC staff agreed to the decision it was best for [redacted] to come to a two day afternoon preschool rather than a day.As the month continued, EPIC staff continued to see the need for on supervision supports which were necessary to redirect noncompliant and defiance of many teacher directions and EPIC expectationsEPIC seeks to offer a safe place for ALL children to grow and learn and expects routines to be followed once modeled by all childrenOn Thursday, Sept [redacted] and I spoke regarding [redacted] and his week behavior scenariosAs Director I was thinking about the safety of all children and knowing the state recognizes a 10-ratio as a safe number of supervisionThe on staffing [redacted] was requiring from our staff was definitely offsetting a true 10-ratio feelWhile knowing this, EPIC also realized ***'s need for positive behavior modeling to follow routines and procedures as well as rulesWith this in mind, as Director I requested to have [redacted] wait to have [redacted] start for a month to assure our other preschoolers could come and begin routine building so if [redacted] required the typical additional on support we noticed he did through August we would be able offer more attention for him at this later time, if needed [redacted] agreed to wait, yet did ask if our routines were built earlier if we would entertain the idea of him starting earlierNeedless to say, we met later in Septafter [redacted] wanted [redacted] to come after two weeks, which we as EPIC staff didn't feel our other children had routines built strong enough to support the demands of his on behavior redirection need at that time.Naturally [redacted] was not happy and wanted to visit after EPIC staff shared options to help support his behavior needsAs Director, I set up a meeting with her to discuss a plan for ***On Wednesday, Sept21, [redacted] attended without her husband, but with a friendUnfortunately, she had no intentions to discuss a plan [redacted] displayed much angerWhile listening to her needs and apologizing for any breakdown in communication, I kindly said, "it sounds like we may not be a good fit for you." "I would be happy to refund you your Septdeposit and/or tuition." The meeting ended with [redacted] walking outI followed her to ask her if she wanted me to send her deposit backShe said, "I will send you an email with that information." The friend had followed me as [redacted] exitedBefore her friend left the EPIC building, I asked her friend what her name was and a numberShe stopped to give it to me in a very calm and kind mannerWhen [redacted] realized her friend was not following her, [redacted] came back in to get her friendWhen she saw her giving me her name and number, [redacted] stated, "You do not need to give her your name or phone let go."I received ***'s email requesting all tuition moniesI sent her the non-refundable $deposit back to honor what I had offered to her on Septwhich was her tuition deposit for [redacted] which was the amount [redacted] did not receive preschool care forIt was sent through classified mail Novand an email to notify her on Nov2nd to expect it in the mail along with knowing when she cashed the check she would abide by her email that stated she would discontinue all contact once she was refunded(I clarified this meant all social media contact too.) As you see, from my email response to her in Novwe are in a disagreement and I requested a resolutionObviously, it would be easy to pay her off for this to go away, but I feel we have been very fair by providing her non-refundable Septdown payment back and due to her not paying her full tuition on Sept6th like other familiesI gave her back only the down payment monies she paid which [redacted] did not receive care; even though my policy states all deposits are non-refundableI feel we as an EPIC staff have gone above and beyond to accommodate her needs for care in August and in refunding her nonrefundable depositIt would not be prudent for me to further deviate from our business tuition policies beyond what we have done for [redacted] Thank you kindly for helping both of us move forward from this eventHigh Regards, EPIC Endeavors Preschool Academy President Trista [redacted]

I am rejecting this response because:
The business owner has tried to deceitfully distract from the breach of contract by misrepresenting my 3 year old son’s behavior, and trying to coerce my compliance by saying that if I cashed the partial refund, that I would be agreeing to stop discussing matters or rating on social media. In addition, the owner is picking and choosing, at her pleasure, which guidelines stated in her contracts to follow. My son never has had “behavior” complaints from any school of any size prior to or since this. That is just absurd and fictitious, and she began using this as an excuse to legitimize her rejection of us after breaching contract,  because she thought I would go quietly since I had submitted to her previous requests multiple times to change our schedule to fit her demands. There are 2 year waiting lists for daycares in Rochester, allowing elitists like Trista to pick and choose which clients they want. I toured this school and made a verbal agreement 2 weeks before they opened in July. After July 27th, I had already signed up for college classes and made commitments, so losing services would hurt me academically and financially for a long time to come, so I agreed to each and every one of her requests, and did not complain to her or question her until she finally excluded [redacted] from her preschool program a few days before he was supposed to start in September. If she felt the way she says she did in her response, she did not make it clear to us, and had ample time to do that. Most of our discussions took place casually as I picked up or dropped off [redacted]. At the meeting she mentioned, which took place when [redacted] was suffering from an ear infection and tubes that had been sitting on his eardrums, I was there to bring in paperwork and meet his teacher to discuss a “plan” not for [redacted]’s “behavior”, but for the services of daycare and preschool she had signed a contract to provide.  My contract says she agreed to provide care Monday through Friday 7am to 3:30 pm Monday through Friday, then 1 to 3:30 Mon Wed Fri for the school year starting Sept 6th to May. It was signed on July 27th. After this she kept pressuring me to reduce the hours she had to care for him. I agreed to half days on a temporary basis, to appease her as she wanted me to continue to nap him, she had stated verbally. Then on August 17th at this meeting she asked to reduce him from 5 days a week to 3 days a week for preschool, to suit her curriculum. I again let her steer me toward what she wanted, but became skeptical at this point. Her behavior was very indecisive and dismissive of what our needs were and our contract stated. This is when things were clearly beginning to look pretentious, and that she was trying to get rid of us as clients. [redacted]’s teacher was not nice to him either, as around this time he started telling me he didn’t want to go back, and told his grandma the teachers were “bad”. We attended preschool information day on August 29th with all of the other parents, and the schedule for September was already made and had [redacted]’s name on it. We bought supplies and he got his backpack ready. On September 1st, Trista told me [redacted] would not be allowed to start preschool with the other kids because she had to get her fulltime students used to their schedules, and thought we could delay a week or 2 and [redacted] could also get used to his schedule at his morning daycare. She also changed the days from Monday Wed Fri, to Tues and Thurs to fit her curriculum and the other student’s needs. It was clear at this point that we were being treated with pretentiousness based on our value to her and/or the elitist program she was trying to form. I said ok then I will call you soon, and called the first week to say we be expecting [redacted] to start the 2nd week. When I tried to call during week 2, no one would return my calls. I left a couple of messages before receiving an email, which stated [redacted] would not be able to come to the preschool program at all, and she wanted us to instead put him in night and weekend care for behavior training. I believe she saw me as an easy target to get start-up funds from when she opened and filled his spot with a more profitable client. [redacted] of course does not need behavior training, and I do not need evening care, so her offer was a gross misjudgment of how far I am willing to be manipulated. I set up a meeting with Trista who kept dismissing me at this point and trying to avoid me and make me talk to the teacher. I requested Trista be present at this meeting. Trista had an agenda for this meeting that was different than mine. I attended with a witness, [redacted], who is a successful business manager from Rochester. My husband couldn’t come because she set it up during work hours and that was the only time Trista was available. I had printed off the contractual guidebook and highlighted all of the areas which pertained to [redacted]’s and our situation. Why hadn’t said behavior been documented? What did she do to work with him? How come we never got any written warnings to sign? Who were the teachers supposedly involved? Why didn’t she follow her behavior plan in the book? Could I see the records she does have? Why does it say my spot is guaranteed by the non-refundable down payment, yet she cancelled services? What could [redacted] possibly have done that would be bad enough to cause her to exclude him but let’s in 33mo and above children? Why didn’t her teachers follow the plan and send any signed sheets home if this behavior allegedly occurred? This made Trista visibly stunned because I had been very compliant with all of her requests previously. She tried to come up with some stories about anything he did, although she only had 1 story. She told me he was in a small class with teacher’s who had children there as well, and allegedly [redacted] “pushed a fence at her child” and the mother(or teacher) of the other child wrote the alleged report, which I asked for. She did not get it for me, so I don’t even know if it exists. She saw no way out of this except to try to domineer the conversation and interrupt me saying this was not a good fit, that she has the right to do what she wants, and had a hard time letting me proceed with the questions I had prepared. I knew exactly what I came there to ask, and I was not there to prove anything to her, or to do anything for her, or to make any plans with her. I was there to find out what rules she broke in our contractual handbook and to gain evidence of these supposed incidents. She has not supplied any evidence of any written warning or behavior incidents, nor any other proof of her story. She ended saying several times “[redacted] I will give you ALL of your money back, ALL of it”…(I am supposing she meant if I didn’t complain about anything because she is changing that now to my deposit for the preschool, since I have made complaints about her business and gave her a 1 star rating on Facebook which she tried to get me to remove) I took her statement as being a refund of ALL my tuition since she was breaching several contractual agreements and had treated me so poorly. I told her I would respond in writing that I was not making any more verbal agreements with her. My witness will verify that this is in fact what she said if you would like. I talked to my husband and we agreed thinking that we did not plan to sue for our tuition or salary compensation, as that would be very complicated etc, so I emailed her to accept the offer. I received a check in the mail the day after I filed the report with the Revdex.com after 30 days, and I cashed it. I then received an email stating a fictitious version of our conversation and verbal agreement, and stating and I quote “Upon cashing EPIC Endeavors Academy's check I will expect the dropping of contact with us to include all social media connections or comments to the preschools social media venues in addition to other communications about EPIC in any form or media outlet.” I have a hard time with this believing this is legal in any way, so I wrote a terse response to make sure she knew I did not receive the email before I had cashed the check and that none of her requests were justifiable, and that I would not comply with them. Since then I have received an email asking what I want from her, which is exactly what she said at our meeting which I responded to,, a refund for ALL services, and ALL deposits, stated non-refundable or not, because she cannot pick and choose which parts of a contract to comply with at will, and because this is exactly what she said in front of my reliable and experienced witness.  I hope that Revdex.com agrees with my request. I am not planning to sue her for costs related to my academic hardships caused by the breach of contract, or for all the money it cost me in hours spent to respond to all of her unfulfilled obligations. [redacted] was and is thriving at large academically focused preschools. He was in an strongly academically focused preschool class of 24-2 for over a year before this.  He is in a large class now as well at the Y tots preschool and at Bamber Valley preschool for hard of hearing. Her slander of his character is fictitious, and absurd. He is now 4 years old, has many friends at his school, and his teachers rave about how wonderful he is.  I look forward to not having to listen to a supposed child professional slander my 3 year old in the future.

weeks. Although the facility opened with a preschool focus officially starting on Sept. 6th, 2016 to serve our community an Academic Preschool, EPIC Endeavors Preschool Academy took in [redacted] for mornings when [redacted] came to the facility to inquire about earlier needs than Sept. 6. EPIC Endeavors Preschool Academy tuition payment document states deposit and registration fee is nonrefundable and her payment of $529.00 included the $65.00 non-refundable registration fee as well as her payment for [redacted]'s half day month of care $460.00. EPIC Endeavors Preschool Academy provided and/or made available [redacted] care on all of these days, with the exception of Monday, August 29th which was due the need to have [redacted]'s health form from the parents in [redacted]'s file which is a required under state statute. It was provided the following day to have on file.
