Dear Revdex.com Consultant, Equity Management Inc., received notification of your complaint ID # [redacted] on April 7, That was the first notification that came to our email of [email protected] We did not receive the first notification The customer information provided is [redacted] Great Falls, MT It would have been helpful for him to have given the cause number or his wife's first name in his statement We were able to locate a file in our system for a [redacted] with the same address I am assuming that is the correct party mentioned in Mr [redacted] complaint Equity Management was retained by Collection Bureau Services as a disinterested third party levying office to handle a writ of execution issued by the Cascade County Justice Court on cause # [redacted] Under statute, Equity's levying officer(s) activated the writ of execution (see attachment): Montana Code 25-3- Delivery of papers to officer(1) (a) It is the duty of a party in any civil action pending in a district court or the party's agent or attorney to forward by mail any process, summons, or other papers required in the cause (b) It is the duty of the sheriff, registered process server, or other officer to whom the process, summons, or papers described in subsection (1)(a) may be directed to receive the process, summons, or papers at the place where the documents are directed (2) If the papers are delivered for service away from the county seat, all necessary copies must be furnished for service (3) If a sheriff, registered process server, or other officer refuses to receive a summons or other process at the point where it was directed or refuses to serve the summons or process, the sheriff, registered process server, or other officer is guilty of a misdemeanor and upon conviction shall be fined a sum not exceeding $ Equity Management was directed by the plaintiff as to where the writ of execution was to be served First Liberty Credit Union determines what funds should be attached in connection with the writ of execution and remitted two checks, one for $and one for $in connection with the notification of levy Again, under statute, Equity Management Incposted the funds on April 4th, 2016, deposited them in a trust account and provided the consumer, [redacted] , with a written, mailed notification of seized property and the instructions about how to file for an exemption claim As a third party levying office, Equity Management is not privy to what type of bills/debt were included in the judgment that court awarded to Collection Bureau Services on February 2, Equity Management does not have access to any correspondence or conversations that occurred between the plaintiff and the defendantEquity Management does not have any authority to release a levy or refund any portion of levied funds without being directed by the plaintiff or the court On April 8th, Equity Management received a written directive from the plaintiff to write a refund check to the defendant, [redacted] for $ The refund check has been issued from the Equity Management Trust Account and will be mailed tonight to the address mentioned in this letter The information called out in the "Customer's State of the Problem" would need to be addressed with Collection Bureau Services I have attached pertinent documents to this response regarding Equity Management's involvement and role in this process Please contact [email protected] if any additional is required in connection with this complaint Sincerely, Jackie L***/Manager Equity Management Inc PO Box [redacted] Missoula, MT 406-721-ext [redacted] State Registration: [redacted]

information provided is [redacted] Great Falls, MT  59404.  It would have been helpful for him to have given the cause number or his wife's first name in his statement.  We were able to locate a file in our system for a [redacted] with the same address.  I am assuming that is the correct party mentioned in Mr. [redacted] complaint.     
Equity Management was retained by Collection Bureau Services as a disinterested third party levying office to handle a writ of execution issued by the Cascade County Justice Court on cause #[redacted]   Under statute, Equity's levying officer(s) activated the writ of execution (see attachment): 
        Montana Code 25-3-201.  Delivery of papers to officer. Equity Management was directed by the plaintiff as to where the writ of execution was to be served.  First Liberty Credit Union determines what funds should be attached in connection with the writ of execution and remitted two checks, one for $954.39 and one for $725.46 in connection with the notification of levy.  Again, under statute, Equity Management Inc. posted the funds on April 4th, 2016, deposited them in a trust account and provided the consumer, [redacted], with a written, mailed notification of seized property and the instructions about how to file for an exemption claim.  As a third party levying office, Equity Management is not privy to what type of bills/debt were included in the judgment that court awarded to Collection Bureau Services on February 2, 2016.  Equity Management does not have access to any correspondence or conversations that occurred between the plaintiff and the defendant. Equity Management does not have any authority to release a levy or refund any portion of levied funds without being directed by the plaintiff or the court.  
On April 8th, Equity Management received a written directive from the plaintiff to write a refund check to the defendant, [redacted] for $1370.61.  The refund check has been issued from the Equity Management Trust Account and will be mailed tonight to the address mentioned in this letter.
The information called out in the "Customer's State of the Problem" would need to be addressed with Collection Bureau Services.  I have attached pertinent documents to this response regarding Equity Management's involvement and role in this process.  Please contact [email protected] if any additional is required in connection with this complaint.
