I have once again reviewed the response made by the business in reference to complaint ID [redacted]. Mr. W[redacted] has been telling me since 11/16 that this would be published and then that I'd be refunded. I would hope he keeps his end up and finally refunds me my money.  I've been waiting since April 3, 2017 for it. On Monday, April 3, 2017 12:47 PM,[redacted] Hello [redacted]I have acted in good faith in working with you and [redacted] and we will publish a magazine In April for them. However since you are unhappy with the project I will refund your investment of $1,000.00.  Please respond to the following offer:  I will refund $100.00 this week ans an additional $250.00 by the end of April '17,   $400.00 in May, and 250 by the end on June. I would like to refund sooner if cash flow allows. Please confirm if this offer is acceptable to you.

Review: I am the owner of a non-medical Senior Home Care agency and was approached by Mr. [redacted] to buy advertising in a magazine he claimed he was producing for an Assisted Living Facility in Seattle that would be provided to all the residence of that facility and other avenues so I could promote my business in this facility and elsewhere. I met with Mr. [redacted] on 9/27/2013 and signed an agreement to purchase the one page ad. He charged our credit card for the full amount of the ad on 9/27/2013 and then suddenly charged our account again for the full amount on 10/12/13. When I contacted Mr. [redacted] he said he had a new bookkeeper and it was a mistake and he would put through a credit. On 12/12/13 there is another charge for the same amount made again and not as as a credit. When my bookkeeper called Mr. [redacted] he was extremely rude to her. I then called Mr. [redacted] again around 12/23/13 and he once again said that he would put through a credit for both the additional charges and it should appear on my account by the end of the week. To date he has done nothing. And the worst thing is that the magazine he claimed would have the ad in it was never produced. I have still not heard from Mr. [redacted] and had no communication from him whatsoever on the status of the magazine. He is a rip off artist and I want everyone to know not to do business with him as he has no integrity whatsoever. He has done nothing but lie to me, avoid communicating with me. I have filed a dispute with the credit card company and hopefully I will recover the 3200.00 her charged my account and I am going to file a small claims court case to recover the original 1600.00 for something he never produced.Desired Settlement: I wouldn't trust that Mr. [redacted]'s checks would be good and so I would like him to repay my 1600.00 for the original cost of the ad which he never produced. I will let [redacted] deal with getting the 3200 that he overcharged me back in my account. I would also hope that he would have the common decency to apologize for his actions and his lack of communication and honesty.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.

Mr. [redacted]'s response that he will be publishing this magazine in February is false according the the community that agreed to have him create this magazine. They have not heard from him nor have the other advertisers that he took money from. So his claim that this agreement cannot be canceled is not true as he has not completed his agreement to publish this magazine, the facility and company that he was supposed to do that for now is taking action against him and so I am canceling this agreement as the agreement was never kept on Equity Publishings part.

Also, I have never once received an email or update from Mr. [redacted] stating what any possible delays might have been. My only communications with Mr. [redacted] have been when I have placed a call to him and then he did not do any of the things he stated he would do in any of those phone calls. When I talked with the Marketing Director at the facility that Mr. [redacted] was supposedly going to do this magazine for I heard that they have never heard from either.

The bank has returned the 3200.00 to my account and I am now going to work with [redacted] to return the original charge of 1600.00 as the product has never been completed and I consider that fraudulent since I never got what I paid for.

As a business owner myself I am shocked at how Mr. [redacted] has conducted his business and himself.

I see that Mr. [redacted] states that the magazine will be published but from what I understand from the Maple Leaf I am not sure this is true. Even if it is I will not accept having my ad if it ever gets published as I do not wish to do business with Mr. [redacted] or his company.

The bank has resolved all issues regarding the charges Mr. [redacted] made to my account so I have received all my funds back and so this part of the issue has been resolved.
