It is the practice of this business to take our fiduciary responsibilities to our clients very serious We pride ourselves on caring for our clients from the start of a transaction through the close and even beyond that.
With that said neither the
agent of reference, designated broker, or myself received any such ***plaintIt seems to me that this would be Mr*** first step to resolve this is***This transaction closed over a year and a half ago (3/28/2013), and the agent in question did not represent the buyer *** *** but he did represent the seller The ***plaint references a date of 4/28/and Equity Realty Group nor it's agents were not a party to that transaction that took place on 4/28/ The ***plaint says that Mr*** "was going to provide a home warranty" In the contract that Mr*** signed and initialed called for him as the buyer to buy his own home warranty (see attached page of purchase contract)
Again, Equity Realty Group did not have a agent client relationship with Mr*** and made no such representation about home warranty On the contrary the purchase contract (line 263) calls for Mr*** to purchase his own home warranty Therefore it is difficult to believe that any representation about home warranty or the A/C was to be expected from Equity Realty Group's agent who represented the seller in this transactionAs far as any receipts concerning the installation of an A/C unit our agent has asked our client to produce those Our agent *** *** did not have the work done nor was he involved in choosing the contractor to do the workIt is silly to expect a receipt of the installation of an A/C unit that happen over a year and half ago The time for Mr*** to ask for the seller to produce any such receipts was during escrowFurthermore it is even more illogical that Mr*** wants a receipt since he has already sold the property for a net profit of $18'on 3/18/Providing receipts would be the responsibility of the seller during escrow not the seller's agent a year and half after the COE
I have enclosed page of the purchase contract that shows Mr*** agreed to purchase his own home warranty I also enclosed the MLS plano that shows that the transaction Equity Realty Group was a party to closed on 3/28/ I also enclosed the MLS plano that shows Mr*** closing on the this property again on 3/21/We will do what we can to track down any contracts or receipts that the seller may have in reference to work performed during the contract that closed on 3/28/ I must remind you that it has been over a year and a half since the work has been done and may prove difficult to track that paperwork down.
I'm a little confused by this ***plaint and not sure if Mr*** even has the correct party
