Review: Tenant [redacted] who is a single mother of a 4 month old child resides at home with the minor child represented by Alpha Omega Real Estate located at Roanoke. On 7/3/13 the basement flooded and she lost allot of possessions after the flood there was raw sewage as well as black mold in the basement, she has no rental insurance. The agency was closed until Monday 7/8/13 she was able to reach the home owner and someone came and pumped the water out of the basement. On Saturday 7/6 the fire department was called due to sparking electrical wires noticed during taking pictures of the damaged items that she lost and they informed the owner who was present to turn off breaker. On 7/10 the basement flooded again. [redacted] paid July's rent in full for $700 on 7/3/13. [redacted] and her child are homeless as of 7/3/13 the condition of the property since 7/3 has made it uninhabitable. The real estate co has not offered her another place to live, has not offered any assistance, and advised her they are waiting on the insurance. Insurance waiting is understandable but having a homeless tenant with child and charging them rent for the house while it is uninhabitable is unjustifiable and needs to be addressed and rectified immediately.There is no electricity on and the upstairs smells like mold as well as items upstairs and is very dangerous to her health and her sons.Desired Settlement: Some type of assistance from the real estate company is requested, a new residence that is habitable, assistance with moving. Most important a refund of the prorated rent to [redacted] since the date of 7/3/13 when the home became uninhabitable, also a date of possible completed repairs.

Response:

In reply to your letter of 7/29/2013 that we received by fax in regard to one of our rental tenants who is leasing the property located at Roanoke, and who supposedly filed a complaint against us on 7/12/2013 by the tenant, [redacted]. We have spoken with Ms. [redacted] and she has stated that she did not file this complaint. She is working with us in regard to the recent flooding to her home. We have been managing the rental of the property for the owner of the property and the owner does have flood insurance and we have been having the property cleaned up and repairs are being made to bring the property back to a better condition then it was before. The flood insurance does not cover any personal property that is lost or damaged, the tenants personal property should be covered by renters insurance of which the tenant does not have. This is not our responsibility, nor or we liable for any act of God. We did offer another house for the tenant to move to and she did not want to move to another house. She is staying with friends and relatives until her house is ready to be occupied, she has paid the rent for this month but she will not be charged any rent for the next month after she moves back into the property. We do consider the handling of this situation to be fair and reasonable and we believe that the tenant is satifised with the arrangements. Douglas W. McDaniel, Sr. President Broker
