Review: I placed an order for a FIA Cobra kit car from ERA Replica Automobiles (ERA) around January 2006 when I was still living in [redacted]. While waiting to take delivery of the car, I moved to [redacted] for a new job in May 2007. After discussing the final details of the car, such as, having a soft top made, side curtains, etc.. [redacted], ERA General Manager, recommended that the car be shipped with the rear differential installed with two junk yard tires fitted for added stability. I took delivery of the car in November 2007. The car I ordered and took delivery of was designated ERA 2114. I have a picture of the car being delivered off the transport truck with the rear tires installed and the front dolly installed. The car was not fitted or shipped with a rear dolly. I have the ERA invoice showing a $90 charge for the tires and a $300.00 charge with the comment: "Dolly Wheels, 100% Refundable w/ Returned". I took that to mean if I returned the dolly after the project was completed I would be refunded the $300.00. I had no need for a rear dolly. The body work and paint were already completed in CT by an ERA recommended painter before delivery. Also, my workshop is the size of a two car garage so I had ample room to work on the car. I sold the car in June 2011 to [redacted] of **. I alerted [redacted] of ERA of the sale via email. I was cleaning my workshop when I discovered the dolly. I contacted [redacted] via email in May 2013 asking if ERA was still accepting the dolly. He answered in the affirmative. I shipped the dolly back to ERA via [redacted] signed for the dolly on June 17, 2013 according to [redacted] (tracking # [redacted]). Apparently, ERA believes the car was shipped with both dollies, front and back. They may also believe I am not [redacted], the original owner of ERA 2114. So they have refused to refund me the $300.00 deposit. I have sent numerous emails and placed several phone calls to ERA asking for my deposit.Desired Settlement: I request to be refunded my $300.00 deposit.

To whom it may concern,

It is our policy to send both front and rear dollys with all kits, it makes the assembly of the kit must easier with the front and rear dollys installed, in fact we do this on our cars we assemble in house to this day. Yes, we do recomment installing the rear differential in a painted kit to make it more stable in shipping and to aboud damage. We did receive several emails in the name of [redacted]. We were quite confused on who that was until he stated in an email that [redacted] was actually [redacted]. We recieved one dolly wheel, front, but it was incoplete (missing brackets) and didn't receive the rear ones, see attached email. Mr. [redacted]) stated in a phone conversation that he would send back an unused seat track in exchange for the missing part of the front dolly wheel, which we never received from him. Our policy as on the work order is a deposit of $300.00 for front and rear dollys, if we did send only one, it is our believe we would have charged only $150.00, but as it was over six years we cannot say for sure, just as over the years Mr. [redacted]) has misplaced the front dolly brackets, the rear ones could be misplaced too. We never "refused" to send him the money back, we told him we would sent $150.00 back when we received the missing front brackets or the new unused seat track o, or $300.00 when the same said parts are returned plus the rear dolly wheels.

I am rejecting this response because:

The

last communication I had with ERA was a phone conversation with Mr. [redacted] in

the afternoon of November 1, 2013 in which I stated more than once that I am

[redacted], the original owner of the car (ERA/FIA 2114). I went into great detail about the car such

as how it was delivered with the rear differential installed, it was painted Viking

Blue by one of his recommended painters in Connecticut, that Mr. [redacted]

recommended I install a [redacted] 5 speed transmission over a Top Loader and that

I should not install a large horsepower engine, how one of his

mechanics/technicians helped me over the phone with the hydraulic clutch

installation, etc… Sadly, Mr. [redacted]

remained unconvinced that I am [redacted] which prompted me to send the November

1 email stating “I am [redacted]”. At the conclusion of the conversation he

promised to call me on the following Monday, November 4, but he never did. It’s important to note that Mr. [redacted]

states in his letter, “We were quite

confused on who that was until he stated in an email that [redacted] was

actually [redacted]”. If that was the

case then why was I not contacted by him or anyone else at ERA on Monday,

November 4, or at a later date?

[redacted] states I was offered $150.00 if I sent ERA the missing brackets or the

seat track. No one at ERA offered me any

compensation for the front dolly I had already sent back nor was I offered compensation

when I suggested sending back an extra seat track, that came with the kit car, in

place of the one missing front bracket. From

my September 16 email which was sent to two ERA employees, [redacted]

<[redacted] and [redacted] at ERA <[redacted]: “Is it

possible the car came with only one such bracket? I could only find one (see

attached pic). If it came with two, can you take the unused passenger seat

rails in exchange for the missing bracket? I had a FIA car with the roll bar so

I never installed the passenger seat rails. I'm $400 plus into the dolley at

this point and it's no longer in my possession”. I did not receive a response from my

September 16 email. It’s interesting to note that Mr. [redacted]’s July 30 email

acknowledges receipt of the front dolly but does not mention compensation. See the attached email chain for more

details.

I am willing to resolve this matter, at a loss, and propose the following

options:

A $200.00 money order or bank check for the front dolly I already sent back to ERA: or
