Review: After a short test drive, put money down and committed to purchasing a used 2003 Toyota Tacoma truck from Eric Von Schledorn at around closing time on June 1st, 2015. We came back the next day to pay cash for the vehicle and sign the papers. So picked up the truck on June 2nd, and on the drive home, within 2 miles of the dealership, the check engine light went on. The next morning, I texted Rob the salesman, and told him what had happened.

The check engine error code was a P0446 code which indicates an emissions system malfunction.

Rob told me to bring the truck in. Service told me that the charcoal filter canister assembly needed to be replaced.

That the dealer would charge me 50% of the repair as per their policy, and that I bought the car "as is".

I ended up reluctantly paying $248 for the repair, and it was done.

I have communicated to the dealer through Rob, that I did not feel that I should have to pay for this repair as it was a pre-existing condition, was not indicated on the window sticker defect disclosure list, and was probably known to the dealer before the sale. Therefore I feel that I have been ripped off by this dealer.

And I would like a refund for the $248 repair, to restore my satisfaction with the transaction, and the dealer.Desired Settlement: Would like a refund of $248, for the emissions repair that I should not have been charged.

In response to Complaint ID #[redacted]

We reviewed the complaint from Mr. [redacted] requesting

money back for repairs needed shortly after the purchase of his vehicle.

Even though the vehicle was purchased “as is”, we decided

to refund Mr. [redacted] the customer portion of the repair due to the low number

of miles driven between purchase and the time the “check engine” light came on.

Our sales manager has contacted Mr. [redacted] and sent a

check to him today. We believe that this

complaint has been resolved.

Review: We purchased this vehicle with the understanding that damage done by the accident it was involved in was repaired. I took it to an auto body shop for another issue and was told both the brackets holding the left headlight in place were broken. I contacted the salesperson who assured me he would get back to me. I called twice and never got a call back.Desired Settlement: I would like this fixed.

Review: I took my car in to get inspected only to find out it needed $1630 in repairs. Because I need a car, I panicked and took out a cash advance for half of that amount. It turns out my car didn't really need the work they told me it did. So now because I'm stuck with almost $400 a month in payments for that advance, I have to claim bankruptcy. I hvae never ever been so dissasitifyed in my life!Desired Settlement: I would apprecaite a refund of the cost to take out the cash advance.

Response:

Mr. [redacted]'s contention is that our dealership is in some way obligated to reimburse him for monies that he recieved from the proceeds of a cash advance.

Mr. [redacted] did in fact bring his vehicle to our dealership to diagnose a no-start issue he was experiencing. Our technician diagnosed the problem as being a bad starter. Upon further inspection it was noted that the faulty starter had also caused damage to the vehicle's flywheel. While performing the diagnositic our technician also discovered that the vehicle had a significant coolant leak. Mr. [redacted] was presented with pricing to fix all 3 problems that our technician discovered with his vehicle. Mr. [redacted] was informed that replacing the flywheel was not required to make his vehicle operable, but that the damage caused by the faulty starter to the flywheel would only result in premature failure of the starter that was to be replaced. As a result it was our recommendation that the flywheel be replaced along with the starter. In order to stop the coolant leak the vehicle's coolant tubes would need to be replaced.

Mr. [redacted] obviously acknowledged that his vehicle needed a new starter, as he took our diagnosis to another independent repair facility to have the work performed. Mr. [redacted] opted not to replace the flywheel on his vehicle, and that was his perogative. Mr. [redacted] informed me that his solution for the coolant leak was a can of stop leak. This course of action was not one recommended by our service department.

I personally met with Mr. [redacted] on September 4, 2013 at our dealership to dicuss his concerns. My understanding is that Mr. [redacted] took a "cash advance" to cover the cost of the repairs we quoted to correctly repair his vehicle. Mr. [redacted] did not spend any of this advance at our dealership, as he has admitted. When I asked Mr. [redacted] why he doesn't simply go back to wherever he received the advance and pay back the money, he replied that he had already paid other bills with the money. I have attached correspondence received by our dealership through our web site from Mr. [redacted] on September 5, 2013, as well as my emailed response to his submission.

There is simply nothing for our dealership to refund to Mr. [redacted]. He admits in his complaint and correspondence with our dealership that he did not spend any money at our dealership to perform any of the repairs that we recommended his vehicle needed. We cannot be held responsible if Mr. [redacted] made the decision to spend the proceeds of his cash advance on something other than to make the necessary repairs to his vehicle. Had Mr. [redacted] presented the source of his cash advance with an actual estimate of the repairs he inteded to make, then perhaps he wouldn't have been in a position of having excess funds to repay.

Please let me know if you need any additional information or documentation to further substantiate our position.
