Response to complaint: I did quote for Mr [redacted] We did discuss making end of driveway wider per his request and ended up needing to make it even larger than anticipated in which I met with him on a Saturday morning at a.m.; he signed a change order to compensate for the additional work needed to complete his request His additional garage sits below the grade elevation of the road he lives off of and I told him it would not be possible to make water run up hill so there would be no guarantee on drainage but that we would do what we could to help alleviate the water run towards his shop I do not remember telling him we would cut the hill down If that was something we were contracted to do it would have been on the quote he himself signed He was present during all aspects of the construction of his driveway and never said anything to our crews that would influence us to make changes He approved every step of widening the end of the driveway as we built it and completed the road base installation and paving He also hired us to crack seal and seal coat his main driveway which we did and he seemed happy with the work Time went by, approxdays or so and he hadn’t paid He then complained that he crushed the end of his driveway with his trailer and admitted it took him several times to figure out how to back his trailer in resulting in the destruction of the edges I went back out to look at damage done; he was not home I tried to meet him at one point but due to tight window of opportunity on both sides was unable to until approxdays later; he had paid at this point for the driveway but not the seal coat work completed: approx$ We had discussed getting partial payment for work completed and we would address returning to repair end of driveway for Mr [redacted] which we are not responsible for per our terms and conditions on the quote he had signed I feel we have bent over backwards for Mr [redacted] and he had not held up to his end of the contract signedTom [redacted] Estimator Sara [redacted] Erickson Asphalt Railside, LLC ###-###-#### ###-###-####

In response , The depressions that you mention are in the exact pattern of a vehicles tires stanceThis slight depression is normal We have tried numerous times to explain the characteristics of asphalt to you, that is why we suggest having an engineer come out to explain it to you We will offer to reimburse for the cost of an engineer as well as replace your driveway, if our workmanship or material are in error Once again this is a typical trait of new asphalt once the driveway has oxidized on the surface this will not happen except in excessive heat or weight conditions

I am rejecting this response because: You mention tire marksTire marks are not depressions that are 4-inches below the driveway surfaceTire marks would be the presence of a tire tread patternI understand thatI have tried numerous times to have someone come out and meet with meAll I get told is you will meet with an engineerWhy should I have to hire an engineerCome out I will show you holes in the drivewayI will show you where I set something for one hour that caused the driveway to depress down under lbs of weightYour employee Brian contacted me about coming out today in the afternoon Well the afternoon is almost over and no employeeI want this driveway fixedMy next step is the attorney generals office, then filing a civil lawsuitThank you

We understand your concerns with the tire marks on the drivewayThis is a thing that happens to all drivewaysMost of these spots with "drive in" over time with use of the drivewayTire marks will not cause your driveway to prematurely failIn when it is time for your first seal
coat, we would fix any remaining tire marks for freeAll asphalt needs time to cure, all driveways will get tire marksMostly within the first yearsWe also understand your concerns with the base, moisture and possibly deflections/wet base and yes base is a crucial element to the strength of your drivewayThe results of poor base would be alligator cracking and/or pot holes, which we do warranty for up to yearsHowever tire marks will happen regardlessIt is simply a characteristic of the productPlease refer to your driveway manual for pavement defectsWe would be happy to meet and work with any engineer or paving company at your driveway to discuss our installation process and identify any problems and make the proper correction if deemed necessaryLet us know when you would like to do this
