Complaint: 10354847I am rejecting this response because: In the initial call (of which I have a recording) the sales representative took steps to purposely deceive Janice in to think this was a previously submitted order which it was notThe information that he referenced as having "received" in the alleged previous phone call was all outdated by quite a few years and prior to our acquisition by the University of Virginia Health SystemIt is impossible that information was given to him by any of our employees and is further evidence that the "previous conversation" John references did not actually take placeThis complaint and our actions has nothing to do with the small amount of money involved and everything to do with ensuring this company does not profit through a scamWe have since been contatced by other who also received calls from E&S using outdated information which leads us to believe that they received everything somehow from a prior vendor I have submitted all recordings of continued interaction between John Carlino (E&S Office Supplies) and our staff to our legal counsel and have worked with the Federal Trade Commission who agrees that the means in which this interaction took place violates their Telemarketing Sales Rule In the last few weeks [redacted] has threatened: He is taking us to collections 2, He has wrecked Janice's personal credit with this unpaid bill Has taken legal action against UVA That I have "Fked Up" (his words, not mine) and he has gone way above my head and I would be fired over this He has not moved forward on any of the above (or additional threats), and these clearly are not actions of a legitimate businessI have been in constant communication with our legal counsel (originally our lawyer who specializes in procurement issues, but most recently UVA's General Council after he threatened a lawsuit) and all actions I have taken or not taken have been on their advice Regards, [redacted]

Review: Was contacted by E&S Office Supplies by phone and was told that their price for the toner for our copier was going to go up and was quoted prices as to the old price and what the new price would be, the person said that he could send out toner at the old price and ask if we need toner. I replied that we did and they processed the order. I am new to the office and did not that this was not our supplier. A fax was sent and I signed and returned. After the Trustee that handle our bills informed me the this was not our supplier, I called our supplier and inquired if this company was affiliate with them and was informed that they were not and that many of their clients had had the same experience. She said that the company was under investigation and that I should send the toner back, which I did. E&s office supplies call me upon receipt of the toner, saying that I had not contacted them to return the merchandise and that the box was damaged and unsellable. They return the toner back to the church. The box was not damage in any way.Desired Settlement: To return the merchandise and not be charged.

Review: This company reached out to our Office Manager and started the conversation by stating that they "just want to verify our address on the packing slip for an already placed order", gets down our information then switched the conversation to placing an order. The call was made in a purposely deceitful fashion that confused our office manager into thinking this was a order that was already placed rather than a new order. Prior to this phone call, we have never worked with or contacted E&S. We were told by our typical vendor, that several other have gotten these calls and that it is a scam and they are not sure how they got everyone's information. Further, the information that they called to verify was extremely outdated and had to come from a source other than our own staff which supports that the initiation of this call was not legitimate. Since then, we received an invoice for toner that is 4x retail cost (along with $50 for shipping a 2lb item) and we have received several threatening phone calls (including threatening our office manager through our secretary), while the company has refused to put any communication in writing to me to back up the legitimacy of their claim. The voice note that they sent me specifically outlines the intention of "just verifying your address for the packing slip" which per a conversation and a case that I have open with the Federal Trade Commission, shows the call is in violation of their Telemarketing Sales Rule, and we would like them to cease communication and harassment of my employees.I have a copy of the initiating call, and would be happy to email it to you.Desired Settlement: I would like for them to cease all communication and for their company to be investigated for fraudulent business activities.
