For your reference, details of the offer I reviewed appear below. The response to my complaint from Private Properties is not based in fact.Since I already have a lawyer working on this, I filed a BBB complaint because my lawyer's phone calls and letters were not being returned. Let me review the sequence of events based on the documentation I have:May 1 2014 - I mailed Private Properties my nonrefundable deposit of $5,000. It cleared my bank on May 4 2014.The "Escape Contract" provided to me was dated 7/26/2014. After I received it, I continued to communicate by email to resolve several questions.August 13, 2014 - I mailed to Private Properties a signed copy of the "Escape Contract" which has no contractual language but rather is an itemized breakdown of the unit's construction and costs, along with my check for $130,020. Note that the contract says that the unit would be delivered "9/1/14 or after." (copy attached)August 27, 2014 - I phoned to say that I wanted to put the project on hold.August 29, 2014 - My check cleared my bank.The Escape webpage says that "We will notify you that we are starting construction at which time 50% of the total amount owed is due and payable." I was never notified that construction had started.I would like to know:What date was construction started?Why have they not provided an accounting of monies spent?Why did Mr. [redacted] cash the check after my call to put the project on hold?Why have they not returned unspent monies?Details about the $130,020 payment.I was offered a discount for paying 100% up front for unit, which is why I wrote a check for $130,020 instead of the quoted amount of $134,400.We both agreed that $130,020 was in error and failed to take into account my $5,000 deposit from May. I was mailed a check for that overage ($5,000) which I never cashed.Dan George told me that the unit would take 90 days to build. Assuming my check was received on August 18th or thereabouts for a unit requiring 90 days of construction, one wonders whether the 9 days from Aug. 18th to Aug. 27th when I put the project on hold allowed very much construction at all . . or did they take the risk of beginning ahead of the contract and check? We received your correspondence dated March 12, providing a copy of the customer
complaint # *** submitted to you by *** *** The complaint made by Ms*** is
invalid, and the narrative “statement of the problem” is inaccurate. In April 2014, Ms*** contacted Private
Properties, LLC requesting to purchase a custom made
Escape Park Model RV home (the “Escape”)Throughout the spring and early summer of
2014, Ms*** submitted specifications for unique and customized floor plans and features she
desired in the EscapeIn approximately July 2014, Ms*** entered into a contract for the
purchase of her customized Escape for a total price of $134,040.00, and tendered a $5,
down paymentShortly after entering into the purchase contract, Ms*** tendered payment of
$130,Upon receiving payment, Private Properties, LLC began construction of the fully
customized Escape per the specifications of Ms*** and as outlined in the purchase contract
The purchase contract entered into by Ms*** provided for a completion date of
approximately September 1, 2014. Several weeks after construction of the custom Escape was underway, and a mere days before
the estimated completion date set forth in the purchase contract, Ms*** contacted us,
expressing for the first time, a desire to “put the project on hold.” Soon after, we were contacted
by an attorney representing Ms***, demanding a full refund of the purchase priceClearly,
by the time Ms*** changed her mind about purchasing the Escape, Private Properties had
already invested considerable time and expense into the construction of her custom orderThe
Escape Ms*** ordered, pursuant to the purchase contract, was made especially to her tailored
requests, and is not a standard Escape modelIn fact, the custom Escape ordered by Ms***
differs so greatly from the standard Escape model, that nearly every aspect of it is unique and
different. Private Properties, through our own counsel, mutually agreed with Ms***, through her
attorney, to engage in efforts to resell the unfinished custom Escape Ms*** orderedBecause
of the very unusual customizations Ms*** ordered, it has proven difficult to resell
Nevertheless, we have continued, at Ms***’s behest, to attempt to resell her custom ordered
EscapeOur attorney remains in contact with Ms***’s attorney so that an amicable
resolution of Ms***’s late cancelled custom order can be reached

We received your correspondence on April 17, 2015 providing a copy of the customer’s reply to complaint # 10529418 submitted to you by [redacted]. To reiterate our April 3, 2015 response,
the complaint made by Ms. [redacted] is invalid, and the narrative description and sequence of events is inaccurate. A complete and accurate recitation of the timeline of events is laid out in our April
3, 2015 response. We continue to work in good faith to resolve this dispute through our counsel, who is in contact with Ms. [redacted]’s counsel.

When I gave my account of the sequence of events, I referred to emails with Private Properties, bank records, and so forth. The documentation doesn't lie. Nor does the fact that Private Properties has both all of my money and the alleged nearly finished unit. I have neither.

contacted Private Properties, LLC requesting to purchase a custom made

desired in the Escape. In approximately July 2014, Ms. [redacted] entered into a contract for the
purchase of her customized Escape for a total price of $134,040.00, and tendered a $5,000.00
down payment. Shortly after entering into the purchase contract, Ms. [redacted] tendered payment of
$130,020.00. Upon receiving payment, Private Properties, LLC began construction of the fully
customized Escape per the specifications of Ms. [redacted] and as outlined in the purchase contract.

requests, and is not a standard Escape model. In fact, the custom Escape ordered by Ms. [redacted]
differs so greatly from the standard Escape model, that nearly every aspect of it is unique and
different. 
Private Properties, through our own counsel, mutually agreed with Ms. [redacted], through her
attorney, to engage in efforts to resell the unfinished custom Escape Ms. [redacted] ordered. Because
of the very unusual customizations Ms. [redacted] ordered, it has proven difficult to resell.
Nevertheless, we have continued, at Ms. [redacted]’s behest, to attempt to resell her custom ordered
Escape. Our attorney remains in contact with Ms. [redacted]’s attorney so that an amicable
resolution of Ms. [redacted]’s late cancelled custom order can be reached.
