Initiated contract on 1/15/19 with *** cash payment. Project involved removing porches from cottage and demo bath and laundry to move house. Porches and interior trim to be saved for reuse once house moved. House move not being done by ***. *** met at project with me and previous owner to go over scope of work. Demo took place week of 2/14. Demo total cost ***. On 2/19, received text from ***, office manager, that making great progress on job, and that interior work being done and I needed to send additional *** I am in Kentucky, but have eyes on project and nothing aside the demo had been done and instructed *** that no interior work was to be done until house moved, which would be weeks. I did not send additional funds. House moved on 3/6. *** present when house left ***, but did not confirm placement of house on new lot where he and I placed stakes weeks before. House place too close to two trees in back that will now have to be removed at *** plus affect aesthetics. He also did not show for meeting with foundation installer to confirm correct height of house so that porches would correctly re-attach since posts specific height. The contract includes *** in management fees. *** has been MIA and incommunicado since 4/9. Between 3/6 and 4/9, I have asked numerous times about the number of shingles removed from the detached garage on *** to replace broken shingles during move and the whereabouts of my building materials. No response was provided. ***, alleged co-owner and ***, office manager, have been in communication. They have increased the cost of the electrical work by thousands in addition to replacing all the drywall in the house to do the electrical to meet code. This has been approximated at ***. The house is 1024 sf. I contacted second company for opinion and they disagree with increased scope of work and cost. *** says it is new code as of 2017. Two inspectors dispute this and have requested they provide code and license number of "in house" electrician. *** refuses to provide the information. I contacted the city about water meter and temp electric status, and no permits had been pulled or fees paid. *** construction has done no work on my project since 3/6, when the house left *** lot. On 4/25, *** informed me that they are not in possession of my porches or other materials removed from house. They left them on the lot I do not own and made no arrangements to have them moved to the house or a warehouse. I contacted *** owner, and she went thru pictures and sent me documentation of my materials being destroyed during excavation of her lot. I have requested compensation for all the materials. *** did not have pictures of the house before demo, the plan that was provided to owner, or any of the pertinent details to evaluate replacement. He told me to provide an invoice and that it would be deducted from the total at the END of the project. I contacted 84 Lumber and Cedar Supply in Kyle, but cannot estimate replacement. This has to be measured according to the plan and pictures before demo. I have requested they go to the house with the pictures and plan and determine the replacement materials needed. They informed me they will not go unless they are working on the concrete, electrical or plumbing. That it is time and gas. They have over *** in cash of my money. In the interim, I have received numerous emails and texts bullying me to use them for the concrete, electrical, and plumbing or it would not pass inspection and that they would not do any of the work if they did not do it all. I told them the first order of business is to replace the missing shingles so the porches can be rebuilt so people can get in and out of the house, and this is needed to make me whole. They refuse to provide this remedy, and want to dictate they do the other work. I have asked them to provide me with the bank info and documentation of my funds in a designated account per Texas statute and they refuse. I have asked for a refund, and they refuse. They say they are allowed by law to finish the job. Texas statute says they are afforded opportunity to correct bad workmanship. They could not even manage the simplest demo and be responsible for my materials. They have done no work since 2/19. I cannot trust them to be forthright. They do not comply with state regulations of providing license numbers and allowing me to get subs to sign lien release who work on house. They will not provide substantial documentation that my funds are available in a designated account.

Communications were initiated with the customer in October 2018 regarding her cottage remodel. Project involved remodeling the interior and exterior as well as connecting the cottage to city utilities. The demo work, labor costs, communications via email, text, and phone since October 2018, multiple trips to and from the project sites, extensive hours spent on this cottage project in planning and meeting in person with customer, and overhead of working on customer’s project for 7 months totals ***. Customer mailed in check payment January 2019 of ***. Difference of *** is due immediately. Customer resides out of state in Kentucky.

It was explained to her at the start of project and multiple times since, that Escobar Construction LLC was not managing her project. We were responsible for our portion of work that she agreed and signed contracts to. She was given the option to let Escobar Construction LLC manage the cottage remodel from start to finish and she declined. Customer chose to try to manage the remodel from out of state unsuccessfully and has since had to pay for items of the remodel to be done twice due to lack of construction knowledge and management. Customer has been combative, abrasive and unwilling to work mutually with Escobar Construction LLC because of errors she experienced with other contractors on this cottage remodel. On April 25th customer emailed office that she did not want Escobar Construction LLC to continue work on the cottage until further notice. Prior to this email she stated that Escobar Construction LLC would possibly not be completing electrical work on cottage. Throughout the duration of working with the customer she would remove work she agreed to have Escobar Construction LLC complete because she found a cheaper bid for the work. The electrical work was a similar situation. Customer was notified that porch and shingle materials were discarded and therefore she chose to stop work on the cottage.

Escobar Construction LLC stated that the cost of replacement materials would be taken off the project balance, but she was not satisfied with this solution. The customer was asked multiple times in email since 4/25 when or if Escobar Construction LLC could continue working on the contracted work and she never responded. Customer avoided the inquiry and instead asked for licensing information or dimensions of build back items. She was notified that licensing information was public information and available on company’s Revdex.com profile. Customer requested more and more measurement information so that she could get estimates from other companies but would not tell Escobar Construction LLC if we could continue working. Regarding the electrical, plumbing and concrete work that was needed at the cottage, Escobar Construction LLC requested to provide work on all three. It was never demanded, nor was the customer being bullied to do so. There are multiple emails where Escobar office is explaining that there should not be more than one contractor working on a specific trade. It could cause potential delays and errors in inspections. Again, Escobar Construction LLC inquired about which of these trades she was allowing the company to complete and no response. Permits could not be registered and paid for with the city because it was not known which trades, she would allow Escobar Construction LLC to complete. Our licensed masters did not want to pull permits for work they would not be completing, nor did it make sense for them to be liable for work that was completed by other companies.

Escobar Construction LLC has tried to come to terms with the customer, but she is unwilling. The company is in its 12th year of business and considered an expert in its field. The customer wanted to dictate the company on how to do its job. It was a hostile working relationship with the customer and best to part ways. We wish her the best on her cottage remodel.
