[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the responseIf no reason is received your complaint will be closed Administratively Resolved] Complaint: [redacted] I am rejecting this response because: As I told MrEsh multiple times and again when he called a couple days ago that simply there were no leaks for the years this house has been standing until he re-roofed the house and consequently removed the original chimney copper flashing and installed new flashing in a manner that allows water to enterRegardless of where the water is coming from and its NOT coming from leaking mortar joints, the chimney flashing is supposed to be installed in a fashion that stops water from entering the houseI have asked him to reinstall new flashing that matched how the original flashing was installed because in that way it is assured to work properlyAs an aside the original flashing could have remained and been reused and not be removed, it was NOT my prerogative to remove it was his worker that did and hence created this problemUnfortunately to make this reinstallation proper will take the help of a mason and a roofer now in order to get the metal flashing into the joints and re-mortar the brickIn discussion with MrEsh he does not want to take the time to get a Mason to help him he expects me to do that and he offered to redo the roofing portion at that timeI am supposed to coordinate all thisOf course then there is the question who pays the mason, which he expects me to do and maybe he'll help with, but nothing specificI have no idea why I would have to do that, I did not create the problem, it was created by him, and I see no reason why a Contractor should not be responsible for a problem he createdIn my original complaint statement I said I expected him to hire a mason and a rooferThe reason I said that is since the roof has been completed he has been back here three timesThe first time he asked me to have the chimney brick coated with water repellant and fix any open joints, before he would do anythingI did that and as I said, even though with the original metal flashing there were no leaks and no water repellant was ever neededThe leaking continued after regardless and he came back and redid the flashing BUT basically in the same manner not as needed to stop it from leakingHe came back one more time and added some more caulk and such and basically said, he has no idea what to do beyond that if it still leaksWell it still leaks and I see no real good reason to engage MrEsh at this time and accept what he proposes because frankly I have lost faith in his ability to fix this and do not feel I should have to look for and hire a mason and not himI realize to do that will take effort on his part not just showing up one day to work on thisAs I said I think its his responsibility to do what it takes to fix this and its not reasonable to expect the customer to do as he suggestsAt this time I can't accept his offer as proposedAt present I am trying to find someone who may be able to fix this and any cost associated with the flashing replacement I would have to seek reimbursementI may reconsider if MrEsh can assure me he can do what is required and engage a mason to help him perform the workI would pay anything considered an "improvement" beyond the actual fixing of the leak Regards, [redacted]

I have goen out after job was completed approx or timesI tried very hard to take care of this issue It appears to be a combination problem Leaking masonry morter joints and flashing problem However, I contacted

I am rejecting this response because: Since it was indicated to respond within 10 days to either accept or reject the resolution I am responding accordingly.Mr Esh called and indicated he would be coming out with mason to go over the repair. When we spoke I gave him 3 days last week that I would be home. He never called back and he has not called this week either. So if he plans on coming or not or when I do not know and currently nothing has been done to resolve the issue other than talking about doing it. So since I can not accept no action, I am rejecting it for now.

Regardless of where the water is coming from and its NOT coming from leaking mortar joints, the chimney flashing is supposed to be installed in a fashion that stops water from entering the house.
