Date: Mon, Jun 13, at 4:PMSubject: Response to ID [redacted] To: [redacted] @cleveland.Revdex.com.org To: Revdex.com From: Estadt Landscaping 352- Attn: [redacted] June 13, This response is in regard to your letter of June 7, about customer complaint (ID [redacted] ) You requested that we give an explanation to the complaint filed in order to try and resolve the issue This is per that request Due to customer expectation levels, the customer stated that following mulch application he was ending use of Estadt Landscaping services To avoid any chance of confrontation we felt that it would be prudent to just return his uncashed checks in the amounts of $and $and end our relationship This would free up the customer to find a different landscape company with whom he may be satisfied Clint returned calls times on June 6, to separate phones First was to his home and a woman answered who Clint stated he had a hard time understanding The second was to a cell phone but there was no answer Regarding breach of contract, I consulted with legal counsel who advised that there was no breach of contract, no damages and no consideration (no actual physical monies changed hands nor were monies deposited) The customer has the right to end the agreement at any time The agreement also provides that Estadt Landscaping also reserves the right to end the relationship at any time as well I called the customer on Sunday June 12, in an attempt to make the customer happy Clint offered to come over on Monday June 13, and do the mulch job I even asked if we could resolve this issue if Clint did the job at no charge He stated that he did not want Estadt Landscaping on his property and that he hired someone else He also stated that he was looking for monetary damages The customer owes for three lawn cuttings totaling $+ tax We offer to allow the customer to keep the $for the three lawn mowing he has already received The delay he complained about was partly unavoidable on our part Estadt Landscaping Please call if you have any questions

Estadt Landscaping has indicated the terms of the contract became null and void June 12, when the checks were returned to the consumerThe consumer requested something in writing however , let this response serve as soThe company no longer wants to communicate with the consumer and therefore will forfeit the $the consumers owed for the three lawn cuts

This response is in regard to your letter of June 7, 2016 about customer complaint (ID [redacted]).
You requested that we give an explanation to the complaint filed in order to try and resolve the issue.  This is per that request.
Due to customer expectation levels, the customer stated that following mulch application he was ending use of Estadt Landscaping services.  To avoid any chance of confrontation we felt that it would be prudent to just return his uncashed checks in the amounts of $240.00 and $20.00 and end our relationship.
This would free up the customer to find a different landscape company with whom he may be satisfied.  Clint returned calls 2 times on June 6, 2016 to 2 separate phones.  First was to his home and a woman answered who Clint stated he had a hard time understanding.  The second was to a cell phone but there was no answer.
Regarding breach of contract, I consulted with legal counsel who advised that there was no breach of contract, no damages and no consideration (no actual physical monies changed hands nor were monies deposited).  The customer has the right to end the agreement at any time.  The agreement also provides that Estadt Landscaping also reserves the right to end the relationship at any time as well.
I called the customer on Sunday June 12, 2016 in an attempt to make the customer happy.  Clint offered to come over on Monday June 13, 2016 and do the mulch job.  I even asked if we could resolve this issue if Clint did the job at no charge.  He stated that he did not want Estadt Landscaping on his property and that he hired someone else.  He also stated that he was looking for monetary damages.
The customer owes for three lawn cuttings totaling $90.00 + tax.  We offer to allow the customer to keep the $90.00 for the three lawn mowing he has already received.  The delay he complained about was partly unavoidable on our part.
