Dear Ms. [redacted], I am responding to complaint number [redacted] from [redacted]. ·       [redacted] members who visited the John Frieda page were offered an opportunity to click a URL to request one of 7,000 free $5.00 [redacted] gift cards (while supplies...

lasted). ·       A website was designed by a vendor, [redacted] (“[redacted]”), to enable consumers to request one of the gift cards by entering their First and Last names together with their email address and then press submit in order to receive the gift card. The first 7,000 requests were to receive a unique URL which directed them to a printable gift card. ·       When the inventory of cards was depleted, the site was designed to stop allowing a consumer to enter their information and submitting the request. ·       Soon after the promotion launched on April 20, 2015, however, [redacted] received an unexpectedly large surge of requests to the website.  This surge of traffic caused [redacted]’s servers to dramatically slow down, preventing [redacted] from correctly servicing individual requests.  As a result, many consumers received emails indicating that they would receive the gift card but which did not include the URL.  ·       After working with [redacted] to understand the technical problem, the digital team posted the reason for the incomplete emails on the John Frieda [redacted] page: “John Frieda Hair Care would like to thank all our fans who participated in our $5 [redacted] gift card giveaway. Due to the offer being shared on various deal and coupon sites, overwhelming demand depleted our supply of 7,000 gift cards very quickly and a technical error occurred, causing confirmation emails to continue being sent long after the supply of 7,000 gift cards had been claimed. Therefore, if you received an email with no redemption link in it, we apologize that we are unable to offer you a gift card at this time. We deeply regret any misunderstanding or inconvenience to our loyal fans and customers.”The post provided to [redacted] was to address any misunderstanding about the offer in question. Further, pursuant to paragraph 6 of the rules for the giveaway (attached), Kao specifically disclaims liability for such technical malfunctions: “Sponsor, and its parent companies, subsidiaries, affiliates, partners and promotion and advertising agencies are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, Web site, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one's ability to enter the Giveaway, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participating in this Giveaway or downloading any materials in this Giveaway.” I hope that this successfully addresses the Bureau’s concerns.  If you have additional questions, please contact me according to the below listed information Sincerely, [redacted]Kao USA Inc. Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.   I am not invalidating the truth of their response, we have been in communication and I have completed and sent in all of the paperwork and photographic evidence of the incident. With that said, this seems like it is going to take far more time to come to a resolution than I feel I deserve to wait. I do not want to seek legal aid in this manner and hope it will not come to that. No offer of any kind has yet been relayed to me nor does one seem to be coming anytime soon. I have been quite patient in waiting but it is wearing thin. I understand the work that must be put into these types of cases but I also understand that the longer I wait to seek legal aid, the less likely it will be that any lawyer will take on my case.
Regards,
[redacted]
