To whom it may concern:On December 14, Ms*** contracted with us to install new concrete footings/piers, sections of new 4"x6"x14' treated beams and new 2"x8" floor joists under home for support and stabilization purposesAlso included in the contract for repairs was the removal
of the old existing stucco skirting and removal of a concrete patio and stepsAt the time of our initial inspection, she asked us to comprise a proposal for the aforementioned foundation repairs because she had another contractor there performing various other repairs to her homeIn order to accommodate Ms*** budget, we also discounted the original cost of the proposal by $1,at her requestAll the aforementioned repairs proposed were intended to supplement her existing foundation support system, not replace her support system in its entirety.At the time that the foundation repair project was to commence, it was noted that there was an exorbitant amount of water standing under her homeOur crew had to excavate a trench under the home in order to divert water away from the foundation so that our foundation repair project could commenceIt was undetermined by our crew what the source of that standing water wasMs*** was made aware of the situation and explained to our foreman that she had her contractor run a snake/ rooter through the sewer system lines due to sewage backing up in her homeOur foreman then explained to Ms*** that she could possibly have damaged / deteriorated sewer lines due to the age and condition of the existing cast iron pipe that was visible from under her homeShe explained that she would have her contractor look into that situation furtherAfter the our crew excavated the trench to divert the water away from her home, we then explained that we would have to let the soil dry out before any work could commenceWe came back to begin the foundation repair project again exactly one week later.Throughout the duration of our foundation repairs to her home, it was noted that nothing had been done by her other contractor with regards to repair / replacement of the leaking / damaged sewer line systemOur foreman noted that her sewer line system was comprised mostly of old cast iron type pipeThe cast iron pipe sewer systems are noted to have been used up until the early 1970'sThat would date her existing sewer system to at least 45-years old or olderThese cast iron systems are very rarely properly maintained and are almost always deteriorated and damaged by the time they reach this ageAll of this information was explained to Ms*** in an effort to keep her informed of the current state of her home and the potential future damages that could occur if not repairedShe explained that she was aware of the situation and would have her other contractor attend to itWe again explained to her the details of our contract with her and the terms and conditions set forth in it with regards to the foundation leveling adjustments and the possibility that there was the potential to further exacerbate her already damaged / deteriorated plumbing issues.As per the terms and conditions as set forth in our contract with Ms***, we are not responsible for any damages to plumbing or any other rigid materials in the homeMore specifically, we are not responsible for any pre existing conditions or damagesPlease refer to our contract with Ms*** section for further explanationIn a good faith effort to maintain an amicable business relationship with Ms***, we agreed to pay an invoice to *** *** of *** *** in the amount of $on her behalf for some minor plumbing repairs under her homeWe explained to her that while we do not accept responsibility for her damaged / deteriorated plumbing issues, we would accommodate her request to pay the invoice as a further discount to her contracted for price and in an effort to maintain an amicable business relationship with her.All work as detailed in our contract with Ms*** has been completed in a professional and workman like manner and to the satisfaction of Ms***We do find it somewhat suspicious that another individual or company would downgrade the work that we performedThis is common practice by non reputable individuals or companies in an effort to sell repair work to unsuspecting victimsWe will always stand behind our work and honor our guarantee as it pertains to the repairs performed by usAs detailed in our contract with Ms***, the final payment was due upon completion of the repairs, but to date she has failed to pay the entire balance due in a timely fashionSince the completion of the work, she has made calls to our office for warranty service issues pertaining to the work performedWe have gladly honored our warranty for the repairs that we have performed to her home despite the fact that we have not been paid in full and we are aware that she has not done anything to repair the damaged /deteriorated plumbing issues at her home that could very well be contributing the differential settlement / movement of her foundationWe are more than happy to continue to do so provided that Ms*** refrains from being verbally abusive to our office staff and work crew.We have made several attempts to visit her home and inspect for any warranty issues or other factors causing her issues to persist but we have been unable to do so due to her extremely abusive language and behaviorAs per the employment laws of the State of Texas, we must provide a safe work environmentWe have been unable to do so when employees are dealing with Ms*** and they are following company policies with regards to providing personal telephone numbers of management / ownersWe would like to reiterate that we stand ready willing and able to honor our warranty and provide warranty service to Ms*** as detailed in our contract and as it pertains to the repairs we have performed to her homeWe cannot provide warranty service for work that we did not perform or that she feels we should perform that is not detailed in our contract with Ms***Our warranty specifically states that it pertains solely to the work performed as it is detailed in our contractPlease refer to our contract with Ms*** in the section labeled "Limited Warranty Program". We look forward to a long lasting professional relationship with Ms***

On Feb we entered into a contract with Mr *** at *** *** *** *** to raise and stabilize a yr old story homeContract called for us to to install concrete footers and concrete piers under home for raising and stabilization purposesDuring course of conversation
with Mr *** both parties agreed that due to the age and condition of home it would not be possible to get it dead levelWe worked on the project for weeks and determined that we would have to add more concrete footer and concrete pier at NO COST to Mr ***When leveling and older home such as this our company uses a ft floor level for best possible resultMr *** brought a laser level of his choiceI explained to him a laser level was not the best method for a job of this type, Mr *** had an area he requested to raise to HIS readings, we proceeded to do just thisAt no time do I ever remember screaming at Mr ***In years of working in the foundation business I have had excellent customer relationsWhen the project was complete Mr *** paid in full which tells me he was satisfied at the timeWe did purchase a engineers certificate for this project, We have since gone back and done adjustments per the customers requestWe contacted Mr *** and let him know the dispute would be rectified if he would send us a CERTIFIED letter of dispute of fundsWe have not received any correspondence from the customer since this time.*** ***

I am rejecting this response because:
This situation has gone on too long The house has not been inspected , nor leveled properly I appreciate Mr*** response, but to date nothing has been done - no inspection, no correction of the leveling problems No phone calls to me for an appointment to fix anything I cannot drop this complaint until I see some action, an inspection with my contractor present, and if my complaints regarding the leveling are upholded

As previously stated, we will happily honor our guarantee for the work performed as it is detailed and in accordance with the terms and conditions in our contract with Ms*** No further information or rebuttal is necessary with regards to this matter We feel as though these back and forth comments are not helpful to this matter. I am rejecting this response because: Initially, I did ask for the steps outside the third bedoom to be removed so Mr*** workers could access under the house for it to be leveled Please note, all the workers, except the foreman, spoke only Spanish, and since I speak Spanish, the workers told me they were undocumented The water under the structure was caused by recent rains at the time Mr*** did not provide a pump for extraction of this water However, when it was sufficiently dried, his workers dug the customary trenches under the house in order for it to be leveled Mr*** did not call for the necessary pipes to be marked I contacted them, and they said he never called Also, he did not obtain the necessary city permits at the time for the work to be doneWhen the water dried under the house, the crew began the leveling, and crushed the outlet to the sewer system, which was PVC pipeI contacted another contractor immediately to replace it, *** ***, and he did replace the whole sewer system Mr*** is willing to give a statement that Mr*** crew crushed the outgoing sewer line from the house and that all plumbing issues have been resovled The only pipes that were cast iron were the gas pipes The sewer lines, which were replaced were PVC pipes The pipes are still here, as Mr*** did not haul them off, and none of them are cast iron This house is totally electric, no gas is utilized hereWhile the sewer system outlet pipes were crushed, Mr***, with Mr*** little pump, cleaned the the sewage from under the house I felt it was Mr*** responsibility to do soHowever, he stated to Mr*** he would not send any of his crew to clean out under the house Mr*** offered to pay Mr*** to payment for the sewage remvoval and his crew had crushed the outgoing sewage lines Mr***, after admitting his crew had crushed the lines, refused to pay Mr*** for two months for doing the work When I contacted him regarding this matter, he called me a foul name and hung up on me I have never used foul language with anyone in Mr*** company, though, everytime I call him to complain, he uses foul language and hangs up on me There was a concrete slab in the living room area, which Mr*** removed After doing so, he found the joist runners were not connectedOn the outside, they appeared they were I contacted Mr*** regarding this, and he sent his brother, Mr ***, to assess the situation After doing do, Mr*** related to me, Mr***, *** ***, that this job was not done well So, he brought a crew and "fixed" the leveling Never did Mr*** address the cast iron pipes for the plumbing to me, he is not a plumber, and they were PVCThese were replaced by Mr*** anywayRegarding Mr*** statement in his reply, his business is called AAA Foundation and RepairAs such, his contract stated his company would level my house to the best of their ability with professional work Obviously, it was not done This house has settled now, according to Mr*** estimate, granted verbally, but it is not level I am now trying to complete the remodeling, and there continue to be cracks in the structure as it still is not level, and there is no water under the houseAnother brother called me, at one time, and wanted an appointment to come inspect the house When I tried to called him back to schedule an appointment, I was told by Mr*** assistant that the inspector was unavailable He has never called me again His name is on the copy of the contract I sent to Revdex.com I have proof that I paid Mr*** in full for the leveling of my house Any additional work was under the warranty, therefore, I do not owe any money, as Mr*** stated to me Should I receive a bill from him, and to date, I have not, I would pay it, unless it is prohibited by his contract During this recent work on my home, in August, 2016, there were some rotten boards on the west wall of my living room, which were removed This wall is a weight bearing wall for the kitchen, a bath and a bedroom There was not a new beam under this area and no joist beamsOn the exterior of the house there are boards indicating the beam was installedIcontacted Mr*** once again, and spoke with him and his assistantThey were both very rude to me, and I did tell his assitant I paid her salary for at least one month for what Mr*** charged me for an inferior jobMr*** was once again verbally abusive to me calling me foul names There is no licensing entity for house leveling companies I never asked Mr*** if he has insurance to cover below standard work However, Mr***, as a contractor has insurance as does Mr***The only substandard work on my home has been done by Mr***, his crews, and according to his guarantee, no inspection has been done on my home He is in breach of contract for substandard work, and not not honoring the terms of that contract I have NEVER used abusive language to Mr*** or his employees, and have I witnesses to that No further attempts have been made to inspect the work done here I did ask for his brother's, the licensed inspector, for his phone number to set up another appointment time Understandable, Mr***"s assistant refused to provide it to me However, I did ask for the inspector to call me at his convenience No call has been receivedAs Mr*** stated in his reply that repeated efforts have been made to inspect the work, no one has been here to inspect my house, my phone has no record of any such callsI am handicapped and retired, so am unable to leave my home without assistance I guess I have to hire my own inspector, and bill Mr*** company As per the laws of the State of Texas regarding calling 811, a free service provided by the State, the laws of the City of Seadrift to obtain permits for leveling, and the State and Federal laws prohibiting the hiring of illegal immigrants to be employed by a company, Mr*** is in violation the laws of our country, state, and city laws To my knowledge, I have not violated any laws, nor have I have been verbally abusive to any of Mr*** employees, save the comment I made to his assistant I provided his crews with water when they were here, visited with them, and would have provided them food should they wanted it.I do not appreciate the slanderous remarks Mr*** has made in his response In no way has Mr*** treated his job here or me in a professional way Should you need pictures of the work substandard work performed, they are available upon request.
