This customer contracted to purchase a recreational vehicle
on the terms set forth in a written purchase agreement which I have attached to
this responseOur customer's credit was approved at the disclosed terms and
there were no further conditions of our customer's performanceThereafter,
our
customer determined that he was attempt to unilaterally cancel the purchase
agreementBoat-N-RV has done nothing other than follow the procedures set
forth in the Purchase Agreement following our customer's breach of contractThe liquidated damages provision referred to in the
complaint was not only separately disclosed, but separately signed by our
customerBoat-N-RV has retained our customer's deposit as described in
Paragraph of the Purchase AgreementThere is nothing unlawful, unfair, or
deceptive about Boat-N-RV conduct in this matter

Phone response - unit dropped off 8/- everything is being fixed under warranty except the bunk ladder, which we fixed as a courtesyWe are just waiting on a couple parts to be able to finish the repairs

Our customer's cancellation refund was remitted to their lender as required by their contract documentsOur customer may obtain verification of this by contacting their lender and/or checking the payments and/or outstanding balance of their loanWe are REQUIRED to remit money to our customers'
lender if borrowed funds were used to pay for the vehicle service contractIt was so in this case

Our GM in New York has spoken with this customer frequently and reached a resolution with themWe have provided a new battery (with switch for directing power) as well as a cover for the boatIn addition, we diagnosed the electrical issue causing certain lights to flicker intermittentlyFinally,
we switched out the prop installed and fine tuned the boat's performanceI believe that the store has satisfied this customer's concerns

There was nothing illegal whatsoever about this transactionMr*** and his wife were interested in purchasing a motor home from our facility in New YorkWe received a joint credit application from them through our secure website, which we utilized to pull their creditThey ultimately did not
purchase a vehicle from this dealership

Revdex.com:I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution is satisfactory to me. Regards, *** ***
On August I picked up my cushion

Boat-N-RV spoke with Mr*** today concerning this complaintWe are scheduled to follow up with one another later this week

Unsafe Boat - Unsafe wiringThe wiring in the boat I assume due to the rush in getting the boat out (incomplete) is not safeWiring is hanging down below the captains console unprotectedSome of the wires are "protected" by a plywood platform which has nails/brads sticking out of it that
literally tear up the wiringThis has lead to the navigation lights going out twice, the bilge pump going out once, and will most probably lead to other issuesWhile we have been lucky not getting stranded yet I feel until the wiring is gone over completely its a dangerThe console platform will need to be replaced as well. Console Platform - Along with the wiring issues due to the console platform the console itself has been cut/chopped upThis has cut through or removed the fiberglass waterproof coating of the boat and exposed the plywood beneath which is already swelling and crackingThese cuts were not shown in the pictures of "our boat" that were provided by the salesman for BoatNRV. Honestly the list of issues is long and if you would like to discuss them please call at any timeI neglected to give you a daytime work phone number which is ***The number provided - *** is my cel phone but unfortunately if I am in the office at work the signal is very very spotty and sometimes cannot get through to me. Thank you for your help,*** ***

Boat-N-RV and our customer were ultimately able to agree upon a substitute unit for the ATV he had previously purchasedWe would appreciate it if you could confirm with our customer and marked the above referenced complaint as resolved

BNRV repaired the items identified in our customer's complaintWe are sorry for the inconvenience of having to return to the dealership to receive the repairs

Kim Fairclough is our corporate customer service representativeShe did not state that our customer would receive a refund of the prep fee
She stated that she would investigate the possibility of refunding the prep fee after consulting with our New York storeBoat-N-RV is willing to refund 50% of the prep fee to resolve this customer's concerns

Revdex.com:I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me.  At this point, we am willing to accept the offer of 50% reimbursement of the prep fee as long as there are no additional fees for them to repair or replace the onboard generator that they asked us to drop off for them to evaluate.

Our customer came to the store on Saturday June 25, 2016 concerning the issues with his boat. At that time, we requested that our customer obtain a quote from a local canvas shop for the missing cushion b/c the factory may not be able to provide an exact match. Our customer identified a few other...

issues with his boat during the visit on 6/25; however, those issues do not impact the boat's performance, and the parties agreed that the best course of action was for our customer to enjoy his boat for the remainder of the boating season and that Boat-N-RV would examine the problems after the season. If our customer would provide me with the invoice for the welding he had performed on this trailer, I would be happy to reimburse our customer pursuant to the manufacturer's warranty.

Initial Business Response /* (4001, 17, 2015/06/30) */
Our facility request final counts 1 week before the event date and that is the count we charge for, it really is not our fault that their invited confirm guest did not show up the day off the party neither are we obligated to give the food...

home , but with our kindness because we felt bad that so many people did not show up we told them that we would give the meals home, by mistake the meals that were left at the end of the night were given to our staff which works hard the whole night and we always give them meals when they are finished working. And we told the customer that we would make them fresh meals to pick up next weekend or other day that works best for them (which again we did not have to do that). Never heard from the customer after the event. We would be happy to provide the meals if contacted by them. But before providing the meals customer needs to take off the negative review .

I have reviewed the response made by the business in reference to...

complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below. This issue has been on going since may 2017- not by my choice by the business, boat n rv, lack of customer service and follow up. Right there shows you that all they care about is the sale and nothing further. Once you leave their business with whatever item you have purchased they don't care. There needs to be further compensation then the minimal fixing of my trailer. The business has had my trailer for almost a full three weeks and I have made all the follow up calls. They have not. So I have not had a fully functioning trailer since May which I paid 20,000 for and you want me to be satisfied with, oh we are now fixing your trailer , after I have been calling and trying to get it fixed since may??!! I don't care if it's a credit to the boat n rv store, or you reimburse me three months of my trailer payment but something else needs to be done.

Boat-N-RV Warehouse is picking up a cushion for this customer's vessel from the boat manufacturer in Georgia this weekend when it picks up new inventory. Our customer should be able to pick up the missing cushion at our store next week. Store representatives will contact our customer to let him know that the cushion has arrived.

This customer contracted to purchase a boat in May, but it did not deliver until June The payoff on this customer's unit was made by Boat-N-RV's check number [redacted] dated June 19, 2015, and which cleared our bank on July 1, 2015. The payoff was made in a timely manner. I have attached a redacted copy...

of our payoff check to this message.

Our customer purchased a 2014 [redacted] camper in January. However, the vehicle was not scheduled for delivery until late March. Also, Boat-N-RV did not receive the trade vehicle until after delivery. The payoff on the trade vehicle was made by our Check No. [redacted] in the amount of $17,299.76,...

inclusive of per diem on the loan, following receipt of the trade vehicle. Concerning the service work, we are happy to service this vehicle which comes with a manufacturer's warranty, but we cannot make service calls to our customer's campground. We simply do not have the man power and our insurance generally does not permit it. The parties agreed that the vehicle service contract on the trade vehicle would remain in effect until it was delivered to Boat-N-RV in connection with the delivery of the new vehicle (so that, in the event a repair was needed on the trade vehicle, it would be covered by the service contract). The vehicle service contract has been cancelled. Upon receipt of the proceeds from the Service Contract Vendor, Boat-N-RV will tender the balance to our customer.

Revdex.com spoke to [redacted] and the following was relayed:I went and met with Jeff [redacted]. I was told that there was a new machine with upgrades to trade in for. When I got there, it was someone else's trade in and not new. I asked if there was a warranty if I accepted it, he would offer nothing except to take it for a weekend. This is all after being told to find a machine I would be willing to trade for, I had done that and they had refused that. I am willing to accept a buyout for $5,000 or I am willing to accept the other machine but request a 12 month warranty as good faith that the machine is a good machine.
