A $2000 deposit was made for a puppy. When I went to pick the puppy I up I did not have enough money with me. They would not accept an e transfer at that time. So I said I would come back. However after reading their contract and realizing I was going to have to pay more if I didn't show up by Oct 2. I decided I didn't want to pay more for the puppy. Their contract states " it is agreed that if for any reason the dog cannot be delivered to the purchaser, the deposit will be refunded in full and there are no further obligations of the seller to the purchaser"
When I called to tell her that I wanted to cancel our agreement, she said to me "yes I feel the same we will keep the puppy"
They have not issued me a refund as of yet, I are now telling me they will keep my $2000 deposit until the find another home for the dog. And I'm assuming will be charging me the $25/day.

The company has already refunded me all but $65 which they claim are for boarding fees. Since the contract was mutually ended I feel this is there responsibility to cover their fees not mine. Please refund the remaining balance.

Desired Outcome

Refund I would like a full refund of the deposit made. The breeder didn't want to give me the dog any more than I wanted to give them more money. The desire to end the contract was mutual and a full refund should be issued

This woman, we believe, has no morals, ethics or respect for other people or business. On Aug. 11, 2017 this woman chose a puppy, paid a deposit to hold this puppy for her, she was given a receipt showing amount paid and balance due, as well as expected delivery date. The delivery date was later verified, both day and time, which was on Sunday, Sept. 30th at 4:00 p.m.
After 4 o'clock on that day she called and said she would be late by 1 hr. because her kids didn't want to leave their play time (this was very strange - kids didn't want to go to get their puppy?). Total time late when she arrived was 1hr 30 min. We have to admit she didn't make a good impression on us at that time. Already then we had feeling she might have a puppy mill or being just not a dog friendly person - our dogs didn't want to come to her, she didn't show any interest in the puppy, which was playing around and her kids even didn't come to the house to see the puppy.... Also, when she came, she did not have enough money with her to pay the balance due. We only accept cash or e-mail transfer if arranged, so the money is here when the puppy is picked up. She offered to transfer the money, but because it was a Sunday and so late in the day, from past experience we know it can take 2 to 4 hrs for the e-transfer to be complete. This was not acceptable to us, as we had other plans for the evening and we were already late. She also admitted that she had not read the contract before she came and didn't know then the balance due. She told us she would come another day to pay and pick up the puppy, but on the next day she called and said she wanted to cancel the deal without giving us any reason.
We do not have a return or cancelation policy. As part of our written contract for sale there is a charge of $25.00 per day for extra days past delivery day. After she told us she wanted to cancel, we placed the puppy on an advertisement, started to take calls from potential customers and sending e-mails to people on our waiting list. After we found a new buyer, this woman has been given a full refund of her money less $65.00 for 3 extra days of boarding. Actually we made a mistake in her favor; the cost should have been $75.00 plus additional cost for our effort to sell this puppy.
Yes, our contract states that a full refund will be given if the puppy cannot be delivered, but the puppy was here ready for her to take, provided that she had the money to pay for it. It was not a situation that the puppy could not be delivered to her, but her failure to complete the transaction.
We hope this woman will never call us again to get another puppy in the future from our kennel.

I do NOT accept this response as it is full of lies.
The date I was to pick the puppy up was Oct 1. Not sept 30.
I had said I would be there between 4 and 4:30. Coming from 3 hours away and knowing I was taking my kids to Niagara Falls I would never have commited to an exact time. When I made those arrangements they gave no indication to me that it was not a good time for them or that they had other plans. When I realized we were behind schedule I called AT 4:00 and said I would be another hour. Their annoyance was unmistakable over the phone. I arrived at 4:50. NOT 1 1/2 hours late, but 20-50 minutes late. In regards to me not showing interest in the dogs or my kids not coming in. They had made it quite obvious over the phone they were angry with me for being late, and I was trying to quicken the process. As for not reading the contract before I came I had been busy puppy proofing my home. Who pays taxes on a dog anyway?? I will be investigating the registration of their business to ensure they are legitimately charging taxes.

I called to cancel, because I would not be able to get there for a few more days. As well, I was no longer comfortable conducting business with people who had been so co descending towards me for making human errors. When I called, this woman's exact words to me were
"Yes, we feel the same. We are going to keep her". In saying this to me, she made the contract null and void. However she proceeded to bill ME for boarding HER dog.
She has no need to worry about me calling them ever again for a puppy. Nor will I ever reccomend her to anyone to get a puppy.
After sharing her response, it was suggested that I sue for slander.

This woman needs to grow up and realize that she had an obligation to the business and it’s owners. A transaction had taken place and a contract was signed. She felt her need to gallivant around southern Ontario overrode the contract. Not so, madam. The owners had other obligations that did not include you and they have every right to a private life. Clearly having a puppy was not a priority for you.. But a puppy is like an infant child. It needs consistency ,and attention and love. If she could not be bothered to pick it up on time, how will she manage to get it trained? Madam, you are not a good puppy parent and the kennel clearly saw that and exerted their right to deny you . Good for them.
