Eva Concrete

I have uploaded the contracts I signed with Eva Concrete. *** the owner and contractor has not owned up to his end of the contracts. The first contract states he will install a new porch with stamping and coloringRemove and stamp the walk way, remove and pour a new 40'
driveway as well as make a curb on the driveway to impede my neighbor from using it. The contract also states he will extend the back patio and pour a new walk way in the backyard. I signed the contract with *** on 4.17.2017. *** verbally told me the job would take weeks with weather permitting he also stated and wrote on the contract this job would take cement pours due to the vastness of the space. From 4.19.2017 until 4.22.2017, no workers showed and all of these days were nice days without any rain. During the week of *** and his crew only worked days. Then he and his crew went missing except for one homeless man that was helping him that began sleeping in my back yard because the fencing was removed. There was no barrier put there to keep other animals or people from coming in and this caused my dog to get out and be hit by a car and my dog died on May 12th. My concrete was broken up and left very dangerously for weeks before *** and his crew came back. My husband and I had to call *** several times to ask him what is going on. On May 5th my husband and I tried to fire *** but he insisted he wanted to finish the job. It took more weeks before my husband and I saw anymore work. *** came to the house alone to do all the framing on May 8th and yard was left that way with no workers showing up until May 19th. However before he was willing to do the first pour of concrete, *** demanded more money, he wanted $2800. We argued with *** and did not want to pay him because that was not the nature of the first contract. We were not supposed to pay more money until the job was complete. You will see on the first contract my husband and I paid him $with a cashiers check and *** told us the rest would be due when he was finished with the work. On the second contract, *** stated he would give us a 20% discount on the total price of $11,500. My husband and I figured after we paid him the initial $for the "concrete" (which is what *** said he needed it for)we figured we only owed him $more. When we told *** this he said no that is not what we agreed to. My husband was confused because that is what *** had said on the phone and that is what was written on the contract. Then *** changes his mind to say that he only stamped the back patio to compensate for the 20% discount for breaching the contracts. During the time *** was removing the concrete, he completely broke my swamp cooler and failed to mention it to us. When *** began showing us what a terrible business person he was we demanded he replace the broken unit. He bought it and stated to my husband and I over the phone on May 25th, he was at out house installing it, he lied because when we got home, the new swamp cooler was just sitting in the garage still in the packaging. Needless to say, *** is not done. The second contract said that he would be completely finished with the pouring, stamping and coloring by may 18th. He will try to say he could not finish because of the weather but we have had temps at and 80. *** has left a mess of my backyard. He still has all of his tools there, he has not disposed of the old materials and he has not cleaned up the excess of concrete still in my lawn. Not only that but he put his personal lock on my garage door and began using my tools from my tool box. I had to remind him that those things are not his and he should not be touching my stuff. Please help my husband and I and never let this person do concrete again! My fear is that he will not get out in a timely manner. Please help us!!!
