On July 28th 2013, We did repossess the 1998 Plymouth Neon from Mr. and Mrs.[redacted] for the following reasons: 1. Repeated failure to meet their payment obligation on the above named vehicle. Theirpayment plan was $200.00 a month for twelve months starting on October 15th 2012.Itwas to expire on October 15th 2013. By July 28rh 2OI3 the [redacted] had only paid$1,180.00 instead of $2,000.00. Meaning that they were behind by $820.00. Somemonths like March, May and July they did not make a single payment and other monthslike January and June they only paid $100.00, respectively. 2. The residential address that they gave us was not correct and the telephone number(###-###-####) that they gave us was never answered. 3. According to the credit terms that Mr. and Mrs. [redacted] agreed to and signed. "If yourpayment is not received 5 days after the due date and we do not hear from you, we shallpromptly move in for repossession at your own risk. We will not call you to remind youabout your due payment at any time" They were aware of their violation of thisagreement but chose to do nothing about it. During the repossession Mr. and Mrs. [redacted] refused to hand over the vehicle. Theyforcefully open the hood and began unbolting the starter from the engine. TimbervillePolice were called to the scene at which point they were forced to reinstall the starter orface arrest. They complied with the order and the vehicle was towed back to our location. On July 31st 2013, which was a Wednesday Mrs. [redacted] called me to see how much sheowed. I was not in the office and explain to her that I would call her during our postedhours of business.(Thursday & Friday 10:30am to 6:00pm and Saturday 9:30am to4:00pm). She stated that they have all the receipts and proof and that they were notbehind on their payments. I then told her to come to the office with all her receipts so wecould compare them with our records. To date neither Mrs. nor Mr, [redacted] has come toour office with any receipts or copies of checks from their bank statements. I did not see why I should call her back telling her how much she owed since she wasconvinced that she did not owe any past due payments. I was expecting her to come toour office with her proof of payments. Once again on August the 7th around 3:30pm Mr. [redacted] called me asking what he cando in order to get the vehicle back. I told him that, they would have to pay off theremaining balance in full. There will be no financing from Evans Auto Sales. He went onto state that they did not owe any money on the vehicle, they have all their receipts andother proof of payments and if I do not let them have the vehicle back, they will take meto court and put me out of business. He also stated that he had spoken to a lot of people,who told him that I had done them wrong too. At that point, I told Mr. [redacted] to take meto court and let the court settle this matter. Kindly understand that we have been extremely patient with the [redacted] interms ofmissed and late payments. But at this point we cannot deal with them anymore. They arenot honest in how they present this matter and it is impossible to sit down and reasonwith them. People like them are actually killing our business and we cannot afford onemore day of this. We try our best to make sure that the vehicles are solidly reliable andfinancing is available and affordable to all our customers. We do our part and we expectall our customers to do their part.
