In the email you sent to my corporate office wherein you conveyed your frustrations with the length of time it took for you to receive information only furthered my belief that our dealings were finished. However, in response to the comments you submitted to the Revdex.com, I now understand that you are in need of further explanation on the topic of your Mom's file.
We are still under the same ownership now that we were in 2009. Also, we honor all preneed contracts that have been written for Evans Brown Mortuary that are in good standing. We have not lost any record of payments, because we never receive payments for preneed contracts. The payments are received by insurance companies or trusts, depending upon how the preneed contract is set-up. Our commitment is that we honor the contract as long as the purchaser upholds their end of the agreement and the funding through the insurance or trust is available at the time arrangements are provided.
Your Mom set-up her preneed contract in a very unusual way, which is why it took me the time it did to get you the information you requested. Basically, she had set-up the trust contract by making one payment of $15.00. She wanted her contract to total $998.00. In order to cover the trust balance of $983.00, she supplied an unrelated insurance policy that had a face amount of $1000.00 with instructions for us to claim it upon her death to cover the balance of the trust. She left a copy of the insurance policy with us, and it shows she had purchased it in 1960 with Prudential. However, she cashed that policy out on 2/10/1999, cancelling the funding for her preneed contract.
In 2009, you inquired about transferring your Mom's preneed contract to another funeral home. Funeral Director [redacted] did respond to your inquiry via email. As for the email correspondence you received from [redacted] it has become obvious to me that he looked at your Mom's file and based upon the paperwork in it assumed that the funding was still in place. No inquiries were made with the insurance company in 2009, so it was not discovered by us at that time that your mom had cancelled the insurance policy. [redacted] retired 3 years ago, so I can only apologize that he didn't do the research at that time that I have now done.
When your Mother cancelled the insurance policy in 1999, it voided her contract with us. Per the original contract dated 1995, we are not obligated to provide any services after funding is cancelled. Therefore, your complaint that Evans Brown Mortuary "Failed to honor a preneed funeral service trust contract" is inaccurate. You are welcome to contact the trust company and make a claim on the only payment that your mother made of $15.00. According to the trust company, the death benefit with interest is $38.52. I feel the way I was made to wait for an answer, after I contacted Evan's Brown back in 2008 was un excusable.

I just remember my mother always telling me not to worry about funeral expenses. She made arrangements with Evan's Brown in Perris Calif. I felt that after receiving the e-mail from Tom Bennett in 2008 that when it was time to make funeral arrangements, all I had to do was call Evan's Brown. Boy was I wrong.
