The purpose of this correspondence is to outline the position of Evans Landscaping, Inc. (“Evans') as it relates the credit-card dispute submitted by [redacted] and [redacted] (“Mr. [redacted]') in connection with the fieldstone provided by Evans as requested by [redacted]. For the...

reasons outlined below, Evan is unquestionably owed $345.61.On September 27, 2016, an agent of [redacted] Co. ([redacted], to the best of Evans's knowledge based on his signature) purchased certain “fieldstone thin veneer flats and corners' from Evans. That same day, he paid Evans for the product using a credit card (Capital One Bank; card-number ending in 0159). Mr. [redacted] received the goods for which he paid, and left Evans with them. To finalize the transaction, he both printed and signed his name on the Evans's invoice, which immediately above his signature, reads:I hereby acknowledge and accept the price, the quality, and quantity of my order to be consistent with our order. See [redacted] Co. Invoice, attached hereto.Directly adjacent to Mr. [redacted]'s signature - conspicuously in bold, ALL-CAPS fontthe invoices states that “ALL SALES FINAL!” See id. Despite signing this invoice loudly informing Mr. [redacted] that the sale was final, he apparently disputed this claim - for reasons unknown to Evans.To the best of Evans's knowledge, Mr. [redacted] still possesses the material at issue; and even if he so desired Evans would reject any return of the product. (Because as Evans's policy provides, all sale are final). There is certainly no acknowledgement from Evans or other proof that any product was returned. Regardless, this would not change the outcome.It cannot be reasonably disputed that Mr. [redacted] is responsible for the invoice in dispute. He ordered a product that Evans provided, and for which he paid and for which he signed an invoice telling him that the sale was final. Evans respectfully demands that payment be made.To the extent that Capital One is concerned, if it elects to recover from Evans $345.61, Evans will file suit against your customer, Mr. [redacted], to recover the sums properly owed to Evans.Evans Landscaping, Inc.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
[To assist us in bringing this matter to a close, we would like to know your view on the matter.], I only received the hand written order and that does not display anything about all sales final . Evans did in fact take the materials back , we went to the office first before taking the stone to the storage yard , they instructed my installer where to go and when I called  Monday I spoke to the man at the counter that took the return . They are fully aware that the stone was returned and just are flat out lying about it . I spoke to the supervisor as well and even though he acknowledged the stone was returned he kept referring to their policy , he even said he may consider charging a restocking fee . They possess the material and the money , they are out nothing by refunding the money .
