Here is my rebuttal and thoughts after reading what *** *** told the Revdex.com of the Northwest. #MESSAGE FROM BUSINESS: (Allegedly; *** ***) Greetings, This message is in response to the complaint filed received by EVELO on 1/30/On 12/14/17, claimant asked for a copy of the warranty on his bikeNote that his original month warranty was soon to expire, but due to some claims of performance issues we extended claimants warranty to years from the date of the original purchase as an act of good faithWhile we provided this information via e-mail, claimant asked it to be sent in writingThe full text of the e-mail communication is as follows: (My Rebuttal to the Revdex.com on 1-31-18) Why has MrO'Donnell attempted to change the facts here? He specifically told me before I accepted the EVELO DELTA MODEL he sent me YouTube videos of, that he was going to transfer the existing warranty that I had on my ARIES, over to the DELTA. So; since even the website boasts a warranty of Years (not months) or 20,miles (whichever comes first); so Why does he state here that "his (My) original warranty was soon to expire" ? ? ? It's obvious he's attempting to do a little slight of hand and attempt to bring some doubt where solid fact stands firm. They will be completely rid of me; After I send the DELTA back to them! ----------------------- I have begun my initial contacts with one of the Country Clubs and the Police DeptAlong with personally placing a formidable lining between new inner tubes and the flimsy walls of these tires"Oh yes; along with locating the appropriate size tubes with schrader valve stems." (Unfortunate prior conditions.) I've woven a loop from Paracord onto the upper brace in front of the seat for the hook on my electric wench lift to attach too. So far; the distance I'm obtaining on this DELTA, is comparable to that of the ARIES; which I paid an additional GRAND for an additional miles. What a Con. The old slight of hand, on a playing field where the players weren't yet familiar with the medium. Cute!!! #1) Warranty in writing ***(Mailed to Me) (My Rebuttal to the Revdex.com on 1-31-18) I have emailed *** *** since early December of 2017, because I have repeatedly asked him for a copy of Our Sales Transaction on the EVELO ARIES I purchased in March of 2016. (I guarantee if the Internal Revenue asked him for a sales receipt that he would produce one pretty fast.) So the fact is; Yes; I have repeatedly requested a receipt showing the sales transaction on my credit card, the exact date of purchase, but he continually changes the subject, changes direction; and reverts back too; "I've already sent you the Warranty information." Still no sales receipt!" Did he lose the receipt, or is he addicted to practicing avoidance and deceit??? #2) Written agreement on the going rate of $EVELO will pay to me; as a result of each bike ordered/purchased. I am a year old retired Ranch Remodeling Contractor. I don't plan on working very hard at this; but feel the DELTA will work overtime Note: I'm finally getting the necessary attention, to accelerate my ambition. Now I need one player on the Other End (Primarily *** ***), to work with me. Further dealings with Eric will not exist. "Congratulations to his new Baby." "I anticipate great things here from Showings and Demonstrations; for this DELTA." (*** *** wrote this) Confirmation of our referal program, and a copy of the written warranty was mailed, and claimed not to be receivedA second copy of the warranty was mailed via USPS Priority Mail (delivered in 1/23/18): (My Rebuttal to the Revdex.com on 1-31-18) It is sad to say the least, that a man who seems to be so astute and knowledgeable, would resort to turning things around; from my request of a sales receipt to making it appear as though I am repeatedly asking for the warranty. See; I can get the warranty at any time from their website; I just can't get them to send me a sales receipt for March of 2016. Beings that a copy of this rebuttal letter will be posted for the citizens of the United States to freely look at; does anyone out there not understand my use of the English Language, when I refer to a sales receipt??? "Maybe I should take this to Judge Judy!!!" This information was also sent to the customer repeatedly via e-mail as well, multiple times, including but not limited to January 17th, The customer refused to open the attachment with the included warranty information (My Rebuttal to the Revdex.com on 1-31-18) MrO'Donnell boldly re-highlights January 17thof and MrO'Donnell continues to sing the same chorus of requested Warranty Information. However; around December 13thOf 2017, I've been asking for a copy of the Receipt for the EVELO ARIES I purchased in March of "I can lay odds that He knows the difference between a Receipt and a Warranty Please note that replacing a two-year-old bike with 2,miles on it is not a standard practice(My Rebuttal to the Revdex.com on 1-31-18) So then; change the warranty to less than 2,miles! The ARIES began crackling and rattling like gravel had been poured into the motor or transmission. In an effort to meet claimants expectations, we replaced the original Aries (purchase price $3,399) with an Open Boxed EVELO Delta (retail cost of $3,899), at no cost to the customer(My Rebuttal to the Revdex.com on 1-31-18) I had no idea what an Open Box meant. He said it had been returned from an year old man, who couldn't ride it. So Open Box I later learned meant used. *** *** later stated that the he had recalibrated the DELTAWhile this is definitely over and above what any company would be expected to do, our commitment to customer service is unwaveringWe paid for freight on the return of his original bicycle, as well as freight on his new bicyclesWe also customized his replacement bicycle, upgrading the handlebars and tires per the claimants request. In the recent month, claimant has been increasingly belligerent (If repeatedly asking for a copy of the original sales receipt is belligerent; because they've refused for months now to send it too me.), threatening the staff members, myself included. (I believe that accusation deserves some documented record of my threats to the staff and to Mr*** ***. After all; the Public deserves access in order to formulate an opinion for themselves; whether or not they can substantially call my words threatening them or not.) As we do not want to spend any more time dealing with an unhappy customer, we offered to provide a full refund if the bike is sent back to us, freight to be paid for by the customer. Now they're claiming that "any shipping damage (which logically would be the responsibility of FedEx, USPS, UPS; i.ethe Shipper) or damage to the bicycle (which I'll personally take pictures and video the boxing of the DELTA before I call for a pick up; should ensure any mistreatment isn't falsely accredited to me.) was to be deducted from the refund amount, which is our standard practice with all returnsAny shipping damage or damage to the bicycle was to be deducted from the refund amount, which is our standard practice with all returnsA refund would then be issued within hours of receipt of the bicycleWhile returning a second bike, which has demonstrated no mechanical issues, is again outside of our standard business practice and certainly over and above what is required, this seemed to be the best way short of a restraining order to avoid continued harassment by claimant. "If only they could/would have sent a copy of back when I used my credit card and purchased the EVELO ARIES." Would that have been too simple? As this point, our offer is to agree to the warranty conditions as outlined in the attached document and as seen on our website, or to offer a refund under the following conditions: • original purchase price of $3,will be refunding, minus any damage to the current bicycle; value of damage to be determined by usWe will document the unboxing of the bicycle after receipt via video recording • bicycle to be delivered to our office at • bicycle much be received by 2/14/• refund will be sent via certified mail within business hours of the receipt of the returned bicycle The only thing I'm seeking is the full refund of the EVELO ARIES; and I will pay the Shipping, Insurance; and I will send you the Tracking Information; as Y'all kindly did unto Me. "Of course I'm not asking for $3,899; just the original $3.399.00" The bike is in phenomenal condition, continually stored inside my apartment (out of the weather) when not in use solely by me. I will ship the DELTA to your office at 34th Ave, Seattle, WA 98122. *** *** stated he extended the warranty on this bicycle which their website claims a Year Warranty on. He distinctly told me before I agreed to receiving the EVELO DELTA model; that he would be transferring the warranty from my EVELO ARIES model over to the EVELO DELTA model. So why is he playing hard ball with me now? Guess he wants to insure that this nearly year old man with COPD fails ! ! ! So much love

The complainant seems to be willing to send his EVELO Delta bike back for a refund of $3.399.00, which is what we had proposedAs soon as the bike is received, the refund will be issued on his original form of payment.As for the other comments, there is nothing else for us to addThe original EVELO Aries bike was purchased on January 22, 2016, almost a year before the new 4-year/20,000-mile warranty was introduced, as clearly stated on our websiteThe warranty at the time of purchase was months plus an additional months extension, which was part of the promotion Mr*** received.More importantly, we offer a 10-day, at-home trial, during which time a bike can be returned for free for a full refundBeyond that point, our bikes are serviced per our warranty at the time of purchase.With Mr***, we have gone well beyond what is our standard operating procedureThe original bike was replaced for free for a newer model after the complainant put 2,miles on itWe have provided proof of emailing and physically mailing requested receipts and warranty information in our response, including a tracking numberIt was also attached in our original response to this complaint.As stated previously, we are willing to once again go well beyond what’s required and issue a full refund to put this unproductive situation behind usAll we ask is for the bike to be returned to us at the address providedThe refund will be issued and the confirmation provided.If there is anything else Revdex.com needs from us in this matter, we will be happy to provide
