Our former resident ("Resident") misstates the facts. In October 2015, Resident reported that in one instance another tenant (who was a minor) was repeatedly yelling from an upstairs window at his partner a derogatory name regarding his sexual...

orientation. In addition, it was reported that an individual from that same apartment invited Resident to smoke marijuana which Resident declined. Resident also reported the theft of a license plate and the smell of marijuana. Resident was advised to contact local police to report the theft of the license plate. In addition, the minor resident was served with a notice regarding the instance of harassment. Other than on October 13, 2015, no other instances of harassment or problems were reported.
On January 16, 2016, when Resident was trying to terminate his lease early, he stated that they have experienced the following problems:
- They had witnessed smoking of marijuana next their carport in the months of October and December.
- They stated that there had been air let out of the tires on their vehicle in November.
- They stated that there had been some noise disturbances from their neighbors living above them in unit #368 in the months of October, November and December.
None of the problems were ever brought to the attention of management. Management was never given an opportunity to address the problems. The only problem that was brought to management's attention was dealt with and no other issues resulted from it. I am submitting the email chain from Resident to Management that evidences this. Resident's lease did permit a negotiated early buy-out, which Resident elected to use--there is no "termination fee." Further, the property was not managed in a manner that made the property unsafe and uninhabitable.
