April 28, 2016To Whom It May Concern:I am writing in response to complaint # *** *** is the issuer of this complaint against my companyEvergreen ChimneyOn 6/27/my company representative arrived at *** ***'s to house in response to her callShe was concerned about her
chimneyWe graciously fixed her chimney and satisfied her needsWe installed a chimney lining system for her after she signed the paperwork to do soShe has never had any other issues with her chimneyIt's in perfect working condition and drafts beautifullyShe was charged $for said workAttached is a copy of her invoice.She stated that she needed the work but that the money was coming in a month later and did not want to worry about the chimney not properly drafting as it is hazardous*** *** asked if she could pay $at the time of service and $at the end of the monthWe graciously extended to her the OK to do soShe did not seem like the type of person that did not pay her debtsHowever, we were wrongWhen the money was due I reached out to *** *** for payment promisedI called once a day she never answered the phoneAfter leaving several messages, *** *** texted the technician's cell phone saying, "I'm in Canada and will be for some timeI will pay when I get home and I will let you know that is." Two months later I asked him to text her again and she stated that she was still in Canada but would be home by the end of the month.Come December of we still had not heard from her, despite several letters and phone callsI managed to get her by text message once in that time and she confirmed that she was home and that she will make some sort of paymentI asked her what type of arrangement was good for her but she never answered me on the subjectI was fine with her making payments but we never received anything from herNo payments were made, no phone calls were made to explainShe also went ahead and blocked our phone numbers from going through to herThat was when I ran the balance on her credit/debit cardI have a signed invoice with stored card info and was within my right to do so.She charged back the payment that same week citing, "they never finished the work." A blatant lie used by someone trying to get something for nothing.We stopped making any type of phone calls at that point and sent a letter once a monthWe never heard from her onceAs of March we let *** *** know that we were preparing to sue her for the monies owedWe sent her an invoice registered mail to evoke payment once more in lieu of going to court*** *** finally called and stated that she had every intention of paying so we let her know that we would wait till the end of the month but after such time we would have no choice but to go to court.*** *** has never made any pertinent complaintsShe had made several complaints stating that we are threatening herWe have only "threatened" her with going to small claims courtWe have NEVER made a threat of any kind towards *** ***She has made complaints to the Revdex.com and the Attorney General only just recently in an attempt to better her chances in courtShe has not phone messages or letters making any threats of any kindShe has never had any problem with any of our work to her chimneyShe even had the work inspected and it's in tip, top shapeShe only now has complaints, (two years later) when the word, "court," was usedI'm sure you will see the lack of value in her complaint and trust that you will make a fair determination of this issue.Sincerely,Stacy R.President
