Evergreen State Builders has been accommodating in offering solutions toward fixing the [redacted] issues with their driveway Our warranty program through 2-HBW states that Evergreen State Builders is not responsible for fixing any damages or defects to driveways The drainage issue is also not within the guidelines of the warranty coverage that require the builder to be responsible Even in their year Home Inspection Report it reads that drainage issues like this are near impossible to remedy and are just the result of the topography of the lot The 2-HBW states the builder shall have the option to repair, replace, or pay the homeowner the reasonable cost of repair of any covered defect and the design, method and manner of any repair shall be within the sole discretion of the builder.Although not responsible or required to compensate the [redacted] , Evergreen requested and received a bid from our subcontractor on June 2nd and subsequently issued a letter offering to attempt to fix the issues, at Evergreen’s expense, if a Letter of Agreement was signed by the [redacted] stating they understand that the coloration of the concrete may differ due to natural components, weather, age and wear of adjoining existing concrete and would not pursue Evergreen further in the instance that coloration did not match exactlyThe contract Evergreen would have to sign with the subcontractor stated the same We mailed the Agreement letter to the [redacted] on June 10th The [redacted] refused to sign the Agreement Letter Work on the driveway could not commence without the signed agreement so scheduling was cancelled and the bid with the subcontractor became void.After further complaint, Evergreen State Builders mailed an additional letter (attached) on July 14th explaining why the warranty work had to be cancelled and that the [redacted] were verbally offered monetary compensation in the amount of the original bid from the subcontractor in order fix the issue on their own by a 3rd party vendor since they refused to sign the required Agreement in order to have Evergreen State Builders perform the work The [redacted] verbally rejected the offer to the Superintendent In a letter mailed on July 18th and received by Evergreen State Builders on July 27th the [redacted] stated they will be pursuing legal action through Washington State Department of Labor and Industries When signing up for the 2-HBW program the [redacted] signed an agreement that any claims, disputes and controversies by or between the owner, the Builder/Seller, the Warranty Insurer and/or HBW shall be settled by binding arbitration
