First of all I would like to apologize on our behalf for any miscommunicationWhen we began the job the customer decided to add waterproofing her foundation (which I suppose is included in the 50% upcharge from her original contract) this itself took about a week to completeWhen we began to tear
out we realized that the foundation to her porch was installed incorrectly and we had to therefore rebuild a block foundationThis was also an upcharge from her original contractShe was told that the stamp we originally chose cannot be used for her steps because of the dimensionsI gave her options which was 1st- to go with an Ashlar slate stamp on her walk and a textured slate on her steps which was no additional cost2she's like that particular stamp she would have to purchase it because there are no suppliers in the tri state areaI gave her the option of splitting the price in half and we were to keep the stampsThe stamp she chose had to be shipped from California during the 4th of July holiday weekend which delayed us about another weekAfter calling multiple companies I finally found a stamp that I can rent and was not an exact match to the stamp she originally chose but was similar and it would be of no additional costI drove over miles to pick up this stamp and then another miles to drop it back offWith all of these change orders we asked for another 1/down when we were prepared to formUnfortunately we ran out of concrete at the very end of the walkwayWe proceeded to order concrete from SRM and was told that it would matchWhen we poured and realized that it was not we contacted the concrete company and they told us that the bag with the color did not break and they were going to refund us back the price of the concreteSRM advised us to get austin buff liquid color for yd of concrete and they would mix it at the plantWe repoured that area and stamped with the pattern and release she choseWhen it was time for clean up the customer stopped us and said she will scrub off the release powder and apply the sealer herselfThere is a certain technique to removing the release and sealing decorative workWe went back to see if this was done correctly and it was not, she scrubbed the release out of the joints and out of the highlighted areas which creates more of a monotoneThere is also a timing technique to applying the sealer, if you let the concrete cure too long it will have a lighter tint; if you don't let it cure enough it will have a darker tintThe homeowner chose to take this responsibility on them selfWe were contracted to install the railing for the porch and steps, she informed us that did not want us to install the railing and went with another companyShe claims in her complaint that the railing cannot be installed because all three of the steps were different heightsWe took pictures and videos of the rise of all steps and they are all 1/2"The thickness of her porch/landing is 1/2" inches which is not a step it is the top of her porchWe know of several railing companies that can install railings down these stepsWe've shown the pictures and gave measurements and they said it can be doneWe also have examples of other steps with the same step rises and they have railingsWe even went one step further and found steps where all rises were different and they still have railingsThese are not jobs we installed but we found examplesWe did leave tools at the job but we left then in a neat order and within our form workWe did have a case of water bottles on the job, it was a very hot day but while the guys were finished working we stacked the bottles by the tree and clean them up at the end of the dayThere were no garbage laying around her job over nightWe did pull the dump truck along side of her house to offload gravel into her porch, it rained while we were workingWe made the decision not to move the dump truck because it would be impossible to pull it back up the hill with the ground being wetWe at Everlast accept that you cannot satisfy everyone 100% but we can learn from every situation we faceWe deny any part of this claim is valid for a refundThe job is installed according to HBA and ACI building code standards

They told me three times they were coming and did not show. In November when I asked for my money back, they never offered to come or even gave me another time frame. I was told by the lady that she would mail the refund and she even sent me a text that she put It in the mail. She lied because it never came and when I told her I asked if she would resend. Never came. I didn't sign the contract for it to be done months out. I wanted it done in a timely manner and was told it would be done

When we entered into contract with this job we planned to do this in conjunction with a larger job since it was a very small job. We were held behind on a city contract but we are still willing to do the job. We finished this contract in November 2017. We are available to do this job but the...

homeowner stated that she didn’t want us to proceed. The deposit is non refundable but if she chooses we will fulfill the obligations of our contract.

There was no written agreement to have this done within a certain time frame. As stated earlier we were going to do this job in conjunction with another since it was a smaller job. We still stand on our word that the deposit is non refundable and we are willing to put it in writing that the job will be complete within 7 days of the new written start date, weather permitting.

First, this business is full of excuses. Marc the original prices was quoted was $4800, but before they even began the porch he raised the price an additional $2000.  He claimed he needed to rent a backhoe in order to tear down the porch.  The waterproofing of the foundation was not included in that $2000 price hike.  Yes, the waterproofing was added, but so was another $2000 on top of the already now $6800.  The interesting part was that a backhoe was never brought in or used.  The refund I am requesting is for the walk and porch, not the waterproofing; I deducted that from the request. The waterproofing DID NOT take a week, but a day to do; so this did not cause the delay.  As for driving 100 miles to pick up and then drop off the stamp used, I didn’t know it was 100 miles from [redacted]; again, excuses and lies and, again, not my problem.  When the final section of walkway was repoured, yes, I said we would clean it off and seal it because we wanted them off our property for good.  As for my washing away the release powder, I did not scrub in the joints or the highlighted areas, I was very careful to make sure you would be able to see the contrast.  Marc’s crew used a power washer to the rest of the walkway, so don’t tell me how careful you have to be; that is a lot stronger and harder than me cleaning it by hand.  I have attached a few pictures to just illustrate some of the things I have mentioned in this and my original complaint.  Everlast may accept that they cannot satisfy everyone 100%, but for a company who has been in business for as long as they say they have, they should have learned their lessons already.  I got a bad feeling about them on day one and I should have listen to my instincts then.
