Review: We had two contracts with [redacted] of Everlast Construction LLC. The first was for our roof, the second our gutters. We have paid Everlast Construction in full for the services for our roof as it is complete. We do not find the gutter work to be complete, and as a result have not paid for the gutters. The service contract states that $1500 (now $1850 with the addition of gutters for our garage) due upon completion of work. I spoke with [redacted] on June 10th to inform him that we would pay for the gutters once my husband had a chance to view the work and determine if there were any issues. On Wednesday, June 11th I informed [redacted] that we did not view the gutter work as complete. The issue with the gutters, I tried to explain to [redacted] is this: In the front of the house, near our porch, the second floor downspout is missing two and half feet of connection to the first floor gutter. I have never seen a gutter arrangement such as this; which allows water from the second floor gutter to drain directly on the first floor porch roof. I asked if [redacted] could send his gutter workers back to the house to address the issue. [redacted] refused, stating an additional fee would be required to have his workers return to the house. I telephoned and spoke Everlast Administrators on two separate occasions: [redacted], on June 13th and on June 14th with [redacted] informing them of the missing section of gutters and deemed incomplete work. I informed both [redacted] and[redacted] that we would make ourselves available as best as we could to accommodate his gutter workers. I received an invoice on June 13th from Everlast which stated "All work is done!" There is no signature from us, the homeowners attesting to this. I received an email from Everlast Construction on June 16th stating that [redacted] would not have his workers address our gutter issue without an additional fee above the negotiated contract price. All documentation, correspondence, and pictures of the house can be provided.Desired Settlement: We would like Everlast Construction gutter workers to return to our house, install the missing section of gutter, connecting the second floor downspout to the first floor gutter. We are not willing to pay any additional fees or prices for this work. Upon completion of the gutter work, we are willing to pay for our gutters in full, a total of $1850.

The gutters are installed according to text book. You do not run liter pipes and elbows in a roof valley to the gutter below because of many reasons. Number 1, it will look hideous. Number 2, the ice, snow and rain will get trapped in the liter pipe creating a dam and won’t drain off the roof properly. Number 3, you would have to fasten the liter pies and elbows to the roof valley which will cause leaks. The standard rule of thumb for roof valley construction is to keep nails as far away from the center of the valley as possible.

Besides, I don’t owe this customer anything. The gutters and liter pipes were installed in the exact same place as the original and we get paid per foot. So she was only charged for the footage we installed. I refuse to install anything incorrectly and won’t be black mailed into doing something for free and incorrect. Besides, have you ever seen a gutter downspout in someone’s roof valley? REALLY?? Did I mention I did the gutters for cost and gave them free gutter screens?

I would ask that you remove this complaint completely solely because of the complete [redacted] request from my all powerful and all-knowing, almighty leader, [redacted], my customer that made my life a living hell. But on a positive note this is the way some people say “Thank You”. If you don’t have anything nice to say, don’t say anything at all!

I don't have documentation on the gutters to showcase whether the were installed correctly or incorrectly. As I mentioned, I had never seen a downspout simply end in a roof valley and fail to connect to the gutter itself. I had simply wanted Everlast to return to the site, explain, offer solutions and potentially connect the two together. The response I received was anything but professional, no explanations, simply statements "that it was done correctly" or something to that effect, before the owner of the company resorted to name calling etc.

I sent via certified mail a check for the full amount of $1850 to Everlast construction last week. The certified mail slip confirms delivery at 11:37 am on the 21st of June. According to my bank statements, the check has not yet been cashed. I am tired of the stress of dealing with a company that does not pride itself on customer service all the way through its jobs, and unfortunately the amount of money remaining on the contract does not render itself worthy of additional action. I don't know what my next step is since I have sent the company the requested invoice amount in full.

I had previously tried contacting you via phone today and yesterday in regards to Complaint # [redacted], I have read the response from Everlast Construction that was sent to me via the Revdex.com web address. In my previous dealings with [redacted] and through the dialog presented in his response to the complaint it is evident that he is a not a reasonable individual, and any further or additional dealings with him is not constructive use of my time, energy or effort.

I have decided to pay Everlast Construction the remaining balance on the invoice. I hold that my complaint is/was legitimate. I am disappointed that even through my attempts to contact his business and mediation through the Revdex.com [redacted] has elected to be extremely obstinate in refusing to address a simple problem.

I don't want to utilize any additional resources or avenues to resolve this matter and I find it unfortunate that this individual is not as focused on customer service and satisfaction as I have experienced with other contractors.

I have posted the check via certified mail to the business in the amount of $1850.00, and have received verification from the [redacted] that the check was received by the business. As of yesterday, it appears that the amount in question, $1850.00 has not been cashed by Everlast Construction, and I have not contacted them to find out why this is the case. I am interested in speaking with you to know how to correctly finalize this complaint as it will be closed soon (obviously with not a resolution that I had hoped for). I would like to know how I can close this case out, simply have it stated for the record that it was not resolved to the customer's satisfaction, and if there is any other action required on my part.
