Initial Business Response / [redacted] (1000, 23, 2015/12/10) */ ***Document Attached [redacted] This property has all of the landscaping completed as well as a fence around the back yard where the tree was replaced The landscape contractors removed the original tree and replaced it with the largest tree that they could manually lift over the fence It is not possible to get an 85mm tree in that location as there is no access for machinery Also, the location of the tree is against the building so the tree had to be hand planted in order not to damage the residence The tree that was planted is a Swedish Columnar Aspen which is one of the fastest growing trees in Alberta I have attached a picture of the tree in the back yard which shows that it is not planted crooked, it is just that the top of the tree naturally curves to one side The reasoning behind installing this particular tree has been explained to the homeowner on several different occasions by different CDL staff as well as the landscape contractors Initial Consumer Rebuttal / [redacted] (3000, 25, 2015/12/21) */ (The consumer indicated he/she DID NOT accept the response from the business.) As explained in the original complaint, the desired outcome is to get what we paid for, namely a healthy tree of adequate size [redacted] The current tree looks quite terrible [redacted] The tree is significantly tilting (or curved) to the south, which is not evident in the photo taken from the north, but is obvious when looking from the east or west side An undersized tree is not acceptable either The business explains that it is not possible to plant an mm tree in that location because the yard is fenced The fence has a large gate and the fence panels can be easily removed with bolts if necessary This same business has been using an assortment of man-lifts, cranes and "zoom-boom" forklifts in the adjacent property under construction for well over a year, so there are various options readily available to place a tree in our yard [redacted] Our tree is essential to us to help block the view of future developments that we don't agree to Therefore, we do NOT accept the response from the business Final Business Response / [redacted] (4000, 28, 2016/01/05) */ The reasoning behind planting this particular tree have not changed since our last response It is unfortunate that we cannot satisfy this customer, however, we believe we have done all we can to resolve this issue

There were actually many onsite visits with these clients, not only with CDL but also the granite supplier It was explained several different times to the clients by both CDL and the granite supplier that there is no specific direction that
this granite should be installed Our final email to the client in regards to this issue explained this again to the client and why no action would be taken

We DO NOT accept CDLs response as it is NOT accurate Our granite dispute was first identified on our pre occupancy walk through May 16/ From this date forward we sent numerous emails to CDL on our granite issue We had visit from granite supplier on July 13/ He indicated to us that he would be sending a report to CDL on this matter We had visits from CDL specifically on the granite issue It took months to receive a line email from CDL indicating that they would be doing NOTHING to address our granite installation concern We were never given the opportunity for consultation on granite installation direction especially after paying $for this upgrade There has never been a satisfactory explanation given to us as to WHY our granite was installed in DIFFERENT directions in our bathrooms As we did not contract directly with the granite supplier we feel it is CDLs responsibility to ensure that when customers are paying for upgrades they are consulted on installation of product especially when it has a directional pattern
