I followed Evolution's steps to cancel membership. An employee emailed me to confirm; I confirmed. My membership has not been cancelled 7 weeks later.
On June 4, I followed Evolution's steps to cancel membership -- a mailed letter.

This is what I wrote --
June 4, 2019
To whom it may concern:
Please consider this letter my 30-day written notice to cancel my Evolution Fitness membership. I purchased my membership Nov. 10, 2017, at the downtown Regina location.
Seeing as I am in the second half of my membership, I understand I will be charged a cancellation fee of $129 + GST.

On June 7, an employee emailed me to confirm --
Good afternoon ***,
I have received your cancelation letter but because you are still in contract till November 10th, 2019, We do offer a convenient early termination fee option of $129+TAX plus 2 bi weekly payments for your 30-day notice. Please let me know if you would like to go ahead with our early termination option.
... If you need any further help, please don't hesitate to email or give us a call.

Hello,
Yes, please charge me the early termination fee. I think I specified that in my letter anyway.

It is now July 22; my membership still has not been cancelled. It is now seven weeks after the fact, and counting. They continue to take $23.09 out of my account every two weeks. Since I wrote my letter to cancel, four payments have been removed from my account.

Today, I went on the Evolution website looking for a manager's email address, so I could CC them on a followup reply. Someone on the website's chat program (whose name I didn't note) said in order to cancel I would have to physically go to the gym and request to see a manager. He said the only email address they have is a general information email address.

It is ridiculous that they have this cumbersome cancellation process, and yet can't even follow their own rules about it.

Desired Outcome

I want my membership cancelled, and I want the cancellation fee to reflect the payments I have made since requesting to cancel. They have charged me $23.09, four times -- it should have been two times, since they require a month's notice (30 days) to cancel.

I want a cancellation for Gym membership
I have been following up with Evolution Fitness down town for a cancellation since 21st of May 2018.
I enrolled in the fitnees center in January 2018 with membership number ***. Before my enrollment I had series of back and forth with the team in order to make sure that I understood their terms and that they also understood mine. I made it clear to the Team that I had a budget allocation of $400 from my place of work for Gym and that after I have reached my limit I will like to pull out. the Sales personnel(***) encouraged me to enroll agreeing that my condition will be given consideration when the time comes. the sales personnel urged me to sign the contract even when I was pointing out the cancellation fee to him, his explanation was that it will be taken care of. I have tracked my spend to make sure that I don't exceed the amount and in May 2018 when my spend got above $300 I reverted back to the management stating my intention to cancel, knowing that I have to give a 1month billable notice which will eventually get my spend to $400 as budgeted.To my surprise the management turned against me forcing it on me that I must have to pay the cancellation fee or retain the membership even when I have narrated the agreement between myself and the sales personnel (***) and the sales personnel was not in denial. I made sure I gave them 1month as required, I also in addition sent them an SMS stating that I will exit after the expiration of the 1month notice. The 1month expired on June 21 after which I stopped all debit from my account, I had also sent in an accompanying letter to let them know that I had stopped my account from being debited. The recipient of the post mail by name *** indicated that she will contact *** to clarify my statement, up till this moment *** has not gotten back to me as to the way forward. I have sent her several emails and follow-ups but she wouldn't respond. My complaint is that evolution fitness even though they have not deemed it fit to respond or provide a feedback as to way forward, they have been annoyingly been sending all manner of bills to my email through ASF(payment Solution) and also with irritating phone calls from ASF.In the bill I have been charged for manual billing totaling a sum of $25 from June up till August and I have also been charged $ 18 late payment and also included is the biweekly membership fee of $24.93 starting from June till date. I will want Revdex.com to use this good office to intervein for me in the position that Evolution fitness is unduly attempting to intimidate me into paying for services that I never used, secondly evolution fitness does not respect agreement, thirdly fitness is for healthy people and I cannot participate knowing my heath condition, fourthly is that I am hardly available so I cannot even use the facility even if I would wish to succumb to their intimidation and lastly is that I have given a notice for my exit and even if we still have pending issue to resolve they do not have the right to keep billing me.

Desired Outcome

Evolution fitness should cancel my membership based on our initial agreement that at reaching my spend limit of $400 that i will exit. Evolution fitness should instruct ASF to quashall the outstanding bill recorded against my name Evoultion Fitness should desist fron sending emails to me with regards to bill and as well instruct ASF to stop calling or sending emails to me

First of all, I had only one gentleman customercentric membership Consultant attend to me which was ***.The second consultant was too bossy and full of himself and did not have the time to understand what my concerns were neither did he have the patient to hear me out.

I never denied having been given the required information about your subscription plan.*** did a great job in explaining in his usual manner but my position is that both myself and *** reached an agreement based on my allocated allowance for gym

I have taken time to also explain this to *** one of your employees and in her last conversation with me being on the 16th of June she posed that she will copy *** in my email for a response of which I never got any feedback even with my numerous followup emails. If my claim is false then let *** come out to debunk it openly

In my previous statement I had indicated that I had spoken to both consultants and was satisfied that the required information had been provided. I have asked both gentlemen to make a statement in their own words for submittal.
Once I received them I will submit them to you.

There are extra costs that have been charged to my gym account unnecessarily. The company claims to have charged my provided financial institution and that the payment was rejected. This appears to be impossible from my standpoint, the funds were available for debiting. Extra fees have been charged to my account for the "non-payment". Many attempts were made to contact *** from the financial department to straighten out the matter, and they failed to return phone calls. This has been the cause of more fees that have accumulated and I think it is unfair to expect me to pay for them. Eventually I was able to speak with *** and she was unwilling to make the situation right. I would now like to cancel my contract with the gym *** and I am even unable to do that according to their rules on the website because my account shows that it is in arrears.

Desired Outcome

I think that it would be fair to only have to pay for the membership fees I had agreed to pay in my contract and I would like the contract to be terminated immediately.

I am really sorry that you have had issues with our billing department. I am again sorry, but that does not sound like something we would normally do unless you had this happen repeatedly and you had had charges waived before, then yes that would be the case. I am here to help you sort out any extreme billing issues in addition to our assistant managers.. Regardless, I do see 2 requests for contact coming through to the assistants. The first on June 14, and the other July 12. I do see the credit card on file is not working. Your credit card company is rejecting our attempt to take payment, which has put your account in an arrears situation. You have been assessed a rejection fee/late charges from our billing company which I would be happy to request it's removal, as I am sure that the credit card on file has an expiry issue or such, and all we need to do it update it and carry on. You have been a member for an extended time and I would be happy to remove the service charges for you. Issues with credit cards is one reason we no longer accept payment by credit card because of fraud and expiry issues. Lots of people think if their credit card 16 digits don't change the card will continue to bill but that is not the case. Any change of expiry must be reported to us. If you are wanting to cancel then you would of course have to pay your membership dues as you would not be cancelled otherwise.
This shows the date of the attempts/rejections for payments starting in June.
