No longer medically fit to exercise and have to cancel contract. Pre-paid trainer amount owed to me is outstanding
I was diagnosed with renal cell carcinoma and my specialist determined I am no longer medically fit to exercise. I sent a registered letter Nov 29/19 along with the doctor's note and my request to cancel my gym membership, and my request to have the remainder of my personal trainer sessions I prepaid for refunded back to me. I have yet to receive a refund (in excess of $400) or to hear anything from Evolution Fitness.
I want my money refunded for my unused training sessions which I prepaid for as I am no longer medically fit as determined by my specialist. I have heard nothing from the company and have yet to receive money owed.
I received a cheque in the mail about 5 -6 days after I spoke to the manager.

I had a contract with california fitness, and my contract was over on February,2018. I called and confirmed that after my contract is over....
Payments will go out of my credit card. But recently I have realized thay evolution fitness have been taking money out of my account. So I went down and told them about this and he told me he will email his supervisor and get back to me. When he got back to me said send them a letter and write about ur situation and they will get back to u and they never did. So I called them and they told me that cant refund the money for something that I have never used.
I would like my money back.
A formal cancellation letter was received on August 31, 2018, after initial conversations earlier in August with one of our Assistant managers. The membership was cancelled with no further payment.
The member's account was provided to Evolution Fitness as an active account February 1, 2018.
A refund can be provided with documentation of cancellation request prior to August 31, 2018, such as a confirmation given to the consumer that their cancellation would be processed for a specific date or an acknowledgement of the request being received. The earliest date we have for any documentation in regards to a cancellation is August 6. the consumer was not charged any payments past that date.
(The consumer indicated he/she DID NOT accept the response from the business.)
I have been charged after my contract was over with california fitness. I have never ever used evolution fitness why do I have to pay for somebody else's mistake?? Honestly I lost money for something that I have never used. It was californias mistake they should pay it from their own pocket not from mine because I have never signed any contract with evolution. They should pay me back the money they took from me after my contract was over. As I said I have never signed a contract with them it wasn't my mistake.
As I have indicated previously I would be happy to refund any payment made by XXXX if she can provide documentation to alter the facts in this case. As a matter of fact the membership XXXX has with California Fitness was still within the 2 year terms upon transfer to Evolution Fitness. The term has been completed now so all that was required was notice to cancel which was received in August and, as indicated, cancelled with no further payment once notice being received.
