Customer's Statement of the Problem: Background: All About Drafting was hired to prepare plans for my business and submit the plans to the county health depàrtment. All About Drafting was to stay on task until the plans were approved by the health department. [redacted] (**) stopped...

communicating after the health department made incorrect assumptions.** Response: All about Drafting never stopped communicating or informing the client of any developments on the approval status. My customer neglects to mention on his complaint that he was trying to install containers that were not approved by the National Sanitation Foundation(NSF) or the Local Health Department. Due to this fact, I informed my client (Mr. [redacted]) that he needed to seek the approval of these containers and approval from the Food and Drug Administration (FDA), to establish if this business was either wholesale or retail. The client took at least 3 weeks to obtain this approval so that the Health Department can review and approve the project. When I informed my client that he needed to purchase and install NSF approved containers he expressed that it was too costly to install NSF approved equipment, his temper goes out of control, I had to ask him to stop the bulling.** did not and would not return my calls for more than five days. This was a serious set-back for our new business.** Response: The five day delay on the project was during the process that my client was seeking a resolution from the FDA and NSF issues. It was not related to All About Drafting contractual obligations.[redacted] added features to my plans without consulting me. [redacted] added features to my plans that were incorrect and against my concerns. These features changed the way the health department reviewed our business - causing more delays. These features had to be removed and re-submitted to the health department - causing delays.** Response: There were at least four meetings with my client (Mr. [redacted]) to review/approve the layout of proposed equipment. There was no design implemented without my client's consent approval.[redacted] refused to give me a copy of the plans until paid in full-without finishing the project. She held the plans hostage. I intended to continue using her drafting services, but with me dealing directly with the health department.** Response: All About Drafting never held hostage any plans. The agreement (attached copy) between my client and All About Drafting specifically states that all plans/design are property of All About Drafting until paid in full. My client requested to go to the Health Dept. at the end, after we made all the corrections, for the stamp out. The HD corrections were addressed in a timely manner, causing no delays to the project. The only extra time spent was from the FDA and NSF approvals, beyond our control. It took days for All About Drafting to contact me once the health department raised issues. I needed to speed the process. * When I agreed to pay her the remainder of the fee ** insisted on cash. We met at my bank. She promised to have the plans with her. She did not have the plans. She promised the plans had been sent to the printer. They had not been sent. All of this occurred at my bank.** Response: Plans were being printed at a local reprographic place, All About Drafting intended to provide my client with a copy of the plans, once the fee was paid in full, as agreed on the business proposal signed by my client.* All About Drafting specified a hot water heater that was ONLY available in Canada. This was discovered after the health department approved the plans. This caused at least one more day of delay finding a substitute. All About Drafting cost me $2000.00. The fee was to cover interaction with the health department. They did not finish their job and insisted on being paid in full. All About Drafting did provide plans. However, they were incorrect and required hand corrections.** Response: The client expressed the need to purchase an economical water heater, one that operated at 4.5 Kilowatts to save money. The Health Department requested a 9 KW water heater, which is more costly than the tenant was willing to buy in the beginning.All About Drafting General Statement:My client at the beginning of contract negotiations stated that he wanted to invest the least amount of money on the project, including design fees, equipment and construction. All About Drafting had to lower the design fee to meet the client's demands. AAD had to endure a condescending attitude throughout the project from Mr. [redacted]. AAD met all the contract obligations from start to finish, we don't owe any money to client. AAD does not agree that the client feels entitled to a 500.00 compensation, since contract obligations were met, in the same manner that we take care of all our clients, without any complaints from anybody else.Sincerely[redacted]All About Drafting
